    You are 100% correct, professionalism is Paramount. I purchased your contract bundle pack. and always use your Non-Refundable Retainer Contract...it is excellent. If I was in this situation, I would refunded 1/2 of the retainer, and possibly done the memoir edit you discussed as well. I am pretty sure this would have worked out best for all, just my opinion.

    As a business owner and someone with integrity, I don’t care what I have in my contract. That guy will get 100% of his money back even if I’m down at the end of the day my brand value is worth any dollar that is given to me regardless.

    This comes down to being a "better person" and avoids backlash and outrage in today's world. This does defy business rules. A contract is a contract but if everyone hates you and wont do business with you after this, it might be better to give the money back. Things like this go viral easily and the public isn't business friendly that much anymore. I actually gave a refund when a groom died a month before the wedding in 2022. it didnt end my world.

    Although I agree with you about buddy’s (videographer ) lack of customer service I’m willing to bet the groom to be or was to be said some pretty nasty things and made threats to trigger the videographer. I bet those things were kept from the media. Anyways, I learned something today, the difference between “Deposits” and “Retainers”. Thank you for the wonderful lesson.

    Although I agree with the non refundable retainer and it is up to the videographers discretion whether to refund or not, this situation is glaring proof that the love of money is the root of all evil. Its clear that videographer did not possess empathy, integrity, or really courage. Refunding that client would have done a lot more good than being stuck up about the contract

    In my experience, there are clients who lie about their life status. I've had a client say they had to cancel a party because they suddenly became ill, but they actually did still have the party and in fact posted party photos non stop.

    • @FlashFilmAcademy
      @FlashFilmAcademy  2 หลายเดือนก่อน +3

      Legally if you can it a deposit it is. Even if you can it a non refundable deposit. There’s been multiple photographer based court cases that’s has proved this.
      You can NOT call it a deposit. If your paperwork says that and NOT retainer the client can get a refund. You can try to fight it but why do that when we can just change the word.

    Before I became a businessman, I was a person with feelings and a conscience. I once constructed a memorial slideshow for a co-worker whose father had died. Upon reviewing the slideshow, she broke down😢. After she
    recomposed herself, she asked how much it would cost. I couldn't humanly bring myself to charge her in her time of grief. That was over three 3 years ago. She still refers clients to me to me till this day. It's not always about the money. Some things are just far more important than money.

    At the end of the day, we are human begins. He has the right to say no but he has no right to disrespect the dead or the people that support your business. The things the videography did is a reflection of who he is. I would refund this on this account knowing that the family needs money to bury their loved one.

    He should have given it back in full in this curcumstance or at least a portion of it ( which should be laid out in the contract ), I say it once and I say it again, Id rather be in business then be right ,Yes If the client cancels for no reason then don't give it back , some times they will book multiple videographers and photographers to make sure they have one on there day.

    Not refunding is going to cost so much more.
    While I like your suggestion of offering a slideshow, that conversation should be AFTER the money is returned. I appreciate your position that it should be at your discretion but a part of your humanity must die when your primary thought is "How do I keep the money and remain in good light?".
    I also understand the skeptical hesitation a business owner must face because I gotta say, getting refunds would be pretty low on the list of things to do if my fiancé died. As stated, (ignoring the death for a sec here) this is a sucky position to be in for a freelancer/business owner.

      I agree the thing is this. These are why retainers are important to protect yourself as a photographer or videographer from situations like this. I don’t think he’s getting publicity because he didn’t want to refund the deposit. I think he’s getting publicity because of how he handled it now let’s be honest we don’t know what all the groom said or did to this Photographer, we only have the Photographer record and actions to judge him by
