If I was in this situation, I would refunded 1/2 of the retainer, and possibly done the memoir edit you discussed as well. I am pretty sure this would have worked out best for all, just my opinion.
As a business owner and someone with integrity, I don’t care what I have in my contract. That guy will get 100% of his money back even if I’m down at the end of the day my brand value is worth any dollar that is given to me regardless.

Although I agree with you about buddy’s (videographer ) lack of customer service I’m willing to bet the groom to be or was to be said some pretty nasty things and made threats to trigger the videographer. I bet those things were kept from the media. Anyways, I learned something today, the difference between “Deposits” and “Retainers”. Thank you for the wonderful lesson.

In my experience, there are clients who lie about their life status. I've had a client say they had to cancel a party because they suddenly became ill, but they actually did still have the party and in fact posted party photos non stop.
Legally if you can it a deposit it is. Even if you can it a non refundable deposit. There’s been multiple photographer based court cases that’s has proved this. You can NOT call it a deposit. If your paperwork says that and NOT retainer the client can get a refund. You can try to fight it but why do that when we can just change the word.
i would think that a person should have verifiable proof of death before giving money back also if a person would lie about death, I would never want to even do business with a person that stoops that low. You can only imagine what else they would lie about or get you caught up in.

The things the videography did is a reflection of who he is. I would refund this on this account knowing that the family needs money to bury their loved one.

He should have given it back in full in this curcumstance or at least a portion of it ( which should be laid out in the contract ), I say it once and I say it again, Id rather be in business then be right ,Yes If the client cancels for no reason then don't give it back , some times they will book multiple videographers and photographers to make sure they have one on there day.
He can keep the money. What's important is people know his name and where he operates his business. This error in judgement will cost him his business.

Not refunding is going to cost so much more. While I like your suggestion of offering a slideshow, that conversation should be AFTER the money is returned. I appreciate your position that it should be at your discretion but a part of your humanity must die when your primary thought is "How do I keep the money and remain in good light?". I also understand the skeptical hesitation a business owner must face because I gotta say, getting refunds would be pretty low on the list of things to do if my fiancé died. As stated, (ignoring the death for a sec here) this is a sucky position to be in for a freelancer/business owner.
I got a feeling they are leaving out a lot of the talking between the client and the videographer. I feel like before he made that website they were already fighting verbally and they dont mention that in this video. in this video its like the client asked nicely and that's it

There is also the risk of horrible P.R. Sometimes it's worth it to cough up the deposit. The videographer sounds like a total POS.
