Over here in Germany you can do this with a beer that has alcohol in it. I mean they would certainly stop you and ask for a breathalyzer test, but as long as you are under 0.05% they would just let you go. It's just not illegal to drink alcohol while driving or to drink alcohol in public, as long as you are not exceeding the legal limit for operating a vehicle and as long as you are not endangering yourself or others in public.
Until they claim your driving is impaired. If you do any driving mistake they can fine you even if you are under 0.05% if you are under the influence of alcohol.
@@TheMadaccountant Not if you are below 0.03% though. And in the short timeframe between greeting the police with a beer in your hand and getting stoped a mistake is unlikely. Another plus is that police has to proof beyond a reasonable doubt that you were actually impaired. You don't even need to take part in any tests without a warrant and police is very carefull when they ask a judge for a warrant. If the BAC is almost 0 and no other drugs can be detected, they might be in some big trubble, cause the judge will ask what they observed that made them believe the driver was impaired if he/she actually wasn't. There was a case just recently. A driver refused to take part in any test and just minutes later a devastating fatal crash happened. It turned out that it was the driver the police checked on just minutes before and that he was well above limit, but they had not enough to get a warrant.
But that is the name of the game. We all need to decide as a society how much freedom from government intrusion we want and how much safety we are willing to give up. In this case it was not enough evidence to keep that driver from going on with his deadly drive, but this is how German law works in contrast to Austrian law where you have a implied consent to breathalyzer tests when driving and can be fined if you don't comply.
I'm defo watching again. Third time is the charm, and by this logic, this video stays, and TH-cam can't take it down. This is your uno reverse card to them, and they can't do anything about that.
