    Attorney Vincent, you're doing God's work. (After been wrongfully terminated after coming back from FMLA leave) I met with my employment attorney yesterday at 3pm. After I left, by 4.09pm, she sent them a demand letter. Liked her before physically meeting with her. Liked her more after meeting with her. She's no joke, she's a Partner of the firm, which mean she's no slough. Please wish me luck.

    Currently I’m involved with the EEOC. I filed a charge against my employer for discrimination (age, sex, disability). They wrote their position statement with 2 affidavits that are blatant lies. I have a lot of documentation that was submitted with my charge. It is currently in the investigation phase. I will be responding to their PS. What is the best way to write it? Paragraph form? Respond after each statement they wrote with my answer?
    My last question is, when is the best time to retain an attorney? I was willing to do mediation but my employer was not.

    Thank you for this video! We had to send a demand letter on our own to a large company. They’ll probably ignore it which will bring us to small claims court. Hoping they make it right so fingers crossed

    This is super helpful. I had my first chat with an employment attorney today that mentioned demand letters and that she doesn't do litigation. Hearing your rationale makes so much sense why shes not for me.

    I had a high success rate with the demand letter process. Didn’t have to arbitrate or litigate. I got $70K. Not all situations are equal though.

      My uncle (NY STATE Supreme Court judge) would have loved you. He was an ardent admirer of Supreme Court Justice Brandeis and often quoted him: "People
      have the right to be let alone" and, while he uttered those words in the context of
      search/seizure, those words continue to ring in my head while fighting harassment case in NH where there is not a SINGLE attorney who comes close to your acumen and character--and the pine paneled basement? Priceless!

    Do you have any thoughts on the EEOC hearings process available to federal employees? Is it worthwhile, or would it be better to skip it and go directly to federal court?

      We do handle workplace discrimination and workplace sexual harassment matters in all 50 States, but I always tell people to check their local options first. Your local options will generally be cheaper.

    Is it typical for the employer to reject your demand letter and request a lower amount? If the employer mention that they feel they can fight your case, is that a typical statement? My case against the employer is pretty great with a number of evidence and witnesses to prove discrimination, retaliation, and harassment, and also having a clean employment record (employee evals, attendance etc) and I'm not sure why they would risk taking that to court. Also, is it wise to go to the media since my attorneys have to file complaint in court?

    Hi Vince,
    I have a small scenario for you.
    A law firm professional gets terminated but the pre-text is racial discrimination. Said employee’s counsel sends a demand letter, X company denies allegations. Now, the employees counsel states they will file an EEOC charge, and X company’s attorney in writing retaliated and terminations the employee the next day. It has been 7 months and now an EEOC charge is filed. What could be a typical response from X company or their defense?

      Our firm waits ten business days, as aggression of part of our model. A pro se litigant will generally want to wait longer than that I think.

    I was terminated, first thing said is we honored your FMLA! second was most of your points are you punching in late.. Red flag I'm never late. They sent my points and dates I received them. 2 days were FMLA days. I called in left voicemails saying it's FMLA. Never thought to record me calling. That's what I'm needing right now. Thought my phone records would work. But attorney denied to help. What do I do. I have papers from Met-Life approving the days.

    I'm being represented by an employment attorney. There were inaccuracies all throughout the demand letter to my now ex employer. To the point I would call them outright lies. I told my attorneys via email everything that occurred. The demand letter didn't even get names of my supervisors correct. I'm concerned that this letter makes me look like a liar. Is this a strategy or did they just not read the details of the events that occurred? I'll give an example. One male I worked with asked me inappropriate questions and the demand letter stated that I told this person to stop with the inappropriate line of questioning but that he continued and the following month "propositioned" me. I never told my attorneys that this person did that. I sent them an email with a list of the errors. One of the attorneys on my case gave me a call and said that they don't want the employer to know all the cards they hold so they just tell a third of what they know. He said the errors aren't really a big deal because if this goes to court it will be what is filed with the EEOC that matters and not the demand letter. I'm sure they are right about that I'm just worried that this demand letter will not be taken seriously.
