@@honestchris7472 It is because if you called up the DVLA to get the address of another driver they would say it's against the law for them to give you that information, and against data protection. If you offered them money it would still be the same. Yet without your permission they will sell your address details to a private parking company for profit. Can you see the problem here?
@@hearmenow909 An individual cannot get this information but certain organizations can and those organizations include parking companies. This is from a government website. DVLA provides data to allow landowners or their agents to pursue their legal rights and resolve dispute. Landowners, private car parking companies and trespass management companies. Private car parking facilities provide a vital service in towns and cities throughout the UK. Many shops, hotels, pubs and doctors’ surgeries are affected when motorists park their vehicles in breach of a car park’s terms and conditions. Properly controlled data release from the DVLA vehicle register helps these organisations operate effectively for the benefit of all motorists. To make sure motorists are treated fairly when any parking or trespass charge is pursued, DVLA will only provide vehicle keeper details where the company is a member of an Accredited Trade Association (ATA).ATAs enforce a code of practice which covers many aspects of a car parking operator’s business. While complying with the code of practice is an important consideration for DVLA when releasing vehicle keeper data, not all requirements of the code affect reasonable cause.
@@honestchris7472 It's just legal guff to justify taking money from private companies to profit from selling your private details. Private parking is a civil matter, nothing to do with the government, and private companies have no authority over people. You may be fooled by the cover they use, but it's not fooling all of us. Let's say someone did any of the above on my property, or your property, would the DVLA still give you a driver's address?! Would they fuck.
I used a wickes car park for 14 minutes, left and because I popped back to get something else within 2 hours of leaving they sent me a £60 fine. 😂 I went to wickes and the manager just cancelled it. You can’t email parkingeye or call them to speak with anyone. It’s one of the biggest scams going. Best bet is to smash their shit cameras up and rip down their signage.
I got stuck in a traffic jam in a car park due to football match and a broken car in the queue to get out of the car park. Technically I wasn't parked and I got a charge. Those guys are scum. @parkingeye are all part of RipOffBritain.
'Reasonable Cause' to access your personal keepership details has been defined by the DVLA as membership of a recognised trade body. So basically all an outfit has to do is join the BPA and it can electronically access all your details held by the DVLA.
This company is ridiculous. My cousin's car one time broke down on home bargains car park hayle, the AA came said it was the start motor, because he was in the car park over 1 hour 48minutes He got a parking fine, appealed against the fine, got an e nmail from parking eye saying It was unsuccessful how bad is that, parking eye Ltd shouldn't even be in business it's not his fault the car broke down. They don't have a customer service and I really don't know why they are still allowed to operate.
Don't shop where these companies operate. Don't respond in any way to the claim. Make them go through the legal process. Evidence is required of their authority to operate on those premises. Ask the store manager for proof of ownership of the land. You may be surprised to learn that the public do and it is leased out or the store given planning permission but subject to conditions that parking / access is provided. If the manager won't provide it, go higher up the management chain. Become a nuisance CHARGE THEM FOR ALL YOUR TIME, COSTS AND DISBURSEMENT PLUS INTEREST. THAT APPLIES TO CONcils
Now here's a point, there's a furious row has broken out over an “aggressive” crackdown on customer parking at Aldi. Cameras record car registration details when drivers arrive AND customers then required to enter their plate number into a machine after finishing their shop Those who fail to do so, or who exceed the free 90-minute time limit in the car park, face a fine. HOW THE HELL ARE THEY ALOUD TO USE THIS TECHNOLOGY , I thought it was only the Police that could use car recolonization software access your DVLA details, but apparently not. Something is seriously wrong, when foreign nations has access, or that a third party is exchanging details with them. isn't this a type of espionage when confidential information or divulging of the same without the permission of the holder, when not in Europe now. this sort of thing is far-reaching.
@@angelamcneill1377 Hi Angie, Aldi has a 45minute time limit, I don't know how long it is for Lidl. But I bet there are no notices to let you know, apart from one under the camera, I went to see the manager and was told not to pay. I said put that in writing. He did. End of....
That claim never went anywhere near a REAL county court ever ! It was rubber stamped by the Northampton Bulk Processing " Court " that is a building operating as a UK court of law and that is the REAL crime here
I had one of these fines . Was easy todo get past them . You can appeal. Tell them car broke down. Send them a invoice from a garage that you make your self . I tell your m8 act the part . They dint even ring him. All ways around the system. Thank me later
In our town and it must be in others to if you are in Currys car park and then walk to B&M next door they fine you for "Leaving the Site" there is no fence or barrier. It really is big brother watching and they must be actually tracking where you go. Creepy. One guy was fined £60 because he went to B&M after buying an item in Currys and only parked for 20 minutes. "Not allowed to leave the site" is the new rule designed to catch people out. Be warned.
This fools use to win in court when they were owned by Capita which is an international company. PE was sold in 2019 to some cowboy from Scotland. I looked at their accounts for 2019 via a government website and they are on their arses. You can sink them by appealing to the BPA. PE have to pay BPA £35 for a reference number. Then if they take you to court they have to pay to lodge the claim. If you loose you only pay on average £200. You do not have to pay their costs if you loose and they cant send Bailiffs to your home either unless it goes to County Court but that is only if you do not pay the first court judgment.
just checked my credit file and shocked to realise i have a CCJ on there for not paying a parking ticket issued by parking eye. But i never knew anything about it and never knew anything about the court hearing etc. It was put on just over a month and a half ago. Is there anything i can do about this and get it removed ? Apparently they sent all letters to my current address but i never received them. I live in a house which is a hmo i e. Many other people live there. And things go missing all the time and literally 50 odd letters come through the door everyday. So its hard to check for my letters every day
I had one of these about 4 years ago but I parked in the restaurant car park and they had one of those systems where you put in your reg plate which I definitely did. Anyway a few months later I received a fine so I threw it away. Anyway fast forward maybe 3 years from then and I receive a county court letter and I laughed because they are still trying. I spent a fortune in that restaurant that day as well. What a shitty country when you get fined for parking in the car park of the restaurant where you are paying money. Disgusting.
I got an invoice (it's not a fine) for my car parked at a hotel I was staying at. Corrupt bastards won't let me appeal or acknowledge the reservation I sent them. We should have the same rules as the Scots, keepers are not liable to pay.
Trouble with no keeper liability is that it just clogs up courts with inane crap. The parking companies will quote Elliot v Loake, which was a Divisional Court ruling stating that it is "presumed" that the RK is the driver where a crime (or breach of contract in these cases) was committed; the Defendants will argue the toss about who was driving. You have 28 days to name the driver....if it wasn't you then just do it. And I dunno who your parking case was with, but if they're IPC or BPA members (which they have to be to get DVLA keeper details) then you are entitled to appeal within a certain amount of time.
@@Josh-uy7qy Was IPC. Claimed they put a ticket on the car with photo but never got one. Time to appeal ran out before I got the notice to keeper but it's ok for them to drag this out over 2 years. I think they know they have a weak case and i'm fighting them all the way.
Maybe they want us to... when about to enter a private car park, stop your vehicle on the main road which will inevitably block the entrance, get out and go and read from top to bottom the T&C's (and small print not visible from inside your car), walk back to your vehicle and decide whether you agree with T&C's before deciding to drive onto the private land. Maybe that's how these people think we should operate. Imagine the congestion😆
you can drive onto the car park to consider the terms and conditions for 10 minutes. If you don't agree with them you can drive off and there can be no lawful claim that you breached a contract.
@@vasyamohnatyj6708 - Great I'll park on your drive then to avoid car park charges- thanks! Btw, not all 'contracts' require a signature- common myth..
I got a parking fine from a private car parking firm. I’ve got no intention of paying it whatsoever, their signs said there was a machine and there wasn’t.
I got a PCN from parking eye recently at a big shopping centre in Birmingham. I phoned up the shopping centre to complain about this but the manager told me that parking eye had a contract with the owner of the land where I parked my car which is in this shopping centre!!! Therefore the shopping centre is condoning this behaviour
No, the shopping centre don't own the land, it has nothing to do with them. Parking eye are scum, I'm not defending them, but you are blaming the wrong people.
@@25nasar you assume that the shopping centre own the land. It's more likely that the shopping centre and the car park operator both lease the land from a 3rd party.

Pls help, invoices sent to old home address, DVLA had wrong details. Now new legal letters have been sent to new address threatening to go to court. Scared and fines are 1k. This was for a gym car park and on every occasion I went to gym but car was not registered on gym database
I have been fighting an unfair parking charge from Parking Eye for the last 2 years. We were at a private function at a hotel, entered the hotel car park from the rear where there were no signs stating what was required when parking. We stayed the whole evening, never once leaving the hotel. About a week later I received a 'fine' of £60 which I have been fighting ever since! We have been threatened with court, bailiffs etc & the charge has now increased to £175! I am still fighting this due to insufficient signage at the back of the hotel car park. If Parking Eye or any other company want to issue a fine then they need to make sure they were in the right in the first place by ensuring all guests, in my situation are able to see clear, bold signs everywhere visible to the driver explaining the rules of parking. In my case this was done yet they still want me to pay £175 for their mistake!! Get clear, visible signs please.
Late reply to this comment but how did you get on? My case has been going on for a year and I'm in court on Monday (10th November 2020). No signage and entry to their part of the car park (along with mecca bingo), the rest of the car park is 5p, I didnt even leave the vehicle. Their priority should be to keep the car park clear but it is all about making money. I was once told that there is no such thing as a law abiding driver just those that have been scammed and those who have yet to be.
My case is the same as yours I park in mews there were no signs but I got £100 parking charge today I received solicitor final notice of £170 if I don’t pay they will add interest and court fee which will be total of £295 and I will get CCJ on my credit history, I don’t know whether to pay or challenge it, what is your advice?

A Month? Ticketed vehicles- max 56 days to send notice to keeper. Non ticketed vehicles (ie camera/cctv/speeding'/anpr etc) max 14 business days to send notice to keeper then void.
Absolutely the right thing: any parking charge for on road, red route, and where the flow of traffic may well be hindered is fare. Since then Parking Eye have used two different Debt Collectors, the first gave up and sent back to Parking Eye, but still no attempt to legitimise their extortion through a court. The new Debt Collectors have increased the settlement figure to £170. At some point I may have to consider my own Court Action for Harassment.

I love situations where you get a parking ticket, and have proof you did nothing wrong. The best course of action is to ignore it until it goes to court. It costs them thousands of pounds to take someone to court and lose, rather than give them the opportunity to cancel it.
Awful advice. It doesn’t cost thousands to make a county court claim if the claim is only within the hundreds. If this was the case they wouldn’t issue CCJ’s so easily which they did with my dad after he followed the so called advice of this video and ignored and ended up paying £309 anyway.
@@emma89 They OP said ignore until court action issued, then you have to challenge or you get default judgment like in this video. If you didn't see the signs or have some other reason to defend then you should but yes you do need to reply to the claim and and go to court.
Anthony help me please i will be grateful im disabled and the car park was really busy and 1st time in my life i got fined for overstaying 10 minutes only
Yeh, don't pay if you don't care about having a CCJ on your record. I'm worried myself now as I have built my credit rating from very poor to excellent, and don't want these scumbags to ruin it. I've had two dealings with this company - the first time, 5 years ago, I received a ticket when I went through a McDonalds drive-tru in the morning before work, spent around 5 minutes on the premises. Came back to the same McDonalds around lunch time, again spent about 5 minutes driving through the drive-thru, at no point did I park there. I received ticket claiming I'd been parked there for 6 hours, their cameras had only clocked me entering once and leaving once, not twice. Luckily I managed to get McDonalds to remove the fine. I recieved my second ticket around 18 months ago claiming I'd stayed without paying in a local leisure centre, when in fact I'd only dropped my neice off and picked her back up 2 hours later, never parked there. I took advise on the internet to ignore it, so I did. But seeing they can successfully get a CCJ against me, worries me to the point of having to pay them to prevent my credit profile having a CCJ on it. So, I don't think ignoring them is the best solution, this could effectively prevent me from getting credit or a mortgage, this is too serious to ignore. They're bastards.
my advice would be to learn the basics. Especially the 10 minute grace period. This is so that you can consider the terms on the signage before chosing to park or not.
They cannot broke your ccj. They can only send letters. I dind pay parking 7 years now. But remember is only for private land. Council parking better pay.
Hi I would like some advice. I got a private parking fine with link parking. I ignored the letters and moved away. I then saw on my credit file that I had a ccj because of it. What can I do . I didn’t pay the original of 100 pounds because I couldn’t afford it and now I have a ccj against me. It will ruin my life as I trying so hard to save for a mortgage but I couldn’t even get out a phone contract because of this fine. It’s heartbreaking that suffering so much over a private parking fine. It is not fair
Id have a word with them as you can deal with this and they can do so it dosent affect your credit score i hope this helps as i khow this can be frustrating and unfair , purely on the basis as they have done this too you unfairly ,and a lot of credit firms should khow that speeding, parking fines are a way of life these days .
They win at the court by virtue of being the only party that turn up. Register to vote in elections. 9 million are not registered to vote. Complain to your MP. If enough people do it they would outlaw these bad practices.
Not necessarily true. I'd say in the parking cases I've done (150-200 at a guess) probably 20-25% of defendants don't attend. Usually you then seek unreasonable litigation conduct costs on top of the £210 or £260 claimed- so you'd seek your own fee for attending (between £150 and £250 depending on the client). Very stupid to file a defence and then not attend, either defend and attend or just admit it and ask to pay £10 a month (the companies are generally very accommodating of this).
You can ignore simple debt collection letters but it’s not a guarantee you won’t get a CCJ. My dad followed advice, ignored another company called Dcbl since 2012, they issued a CCJ this January which was confirmed using trust online, so if have a real CCJ, you HAVE to pay then.
Just a quick question: if the letter is addressed to the previous tenant, why have you opened it? It’s got nothing to do with you, keep your enormous honker out of it. Send it back as “addressee unknown”
My husband received a fine from parking eye around Christmas 2020. We appealed online, we received no acknowledgement of the appeal just further threatening demands through the post, and the charge was increased. I wrote a letter explaining our attempt to appeal, and offered to pay the original £60 charge (genuine mistake, but my husband had parked without paying, albeit for only 7 minutes, and frankly didn’t want the frustration of coming home to their letters) I gave them a choice to either accept the original £60 or actively invited them to take him to court. They accepted the £60 and we heard no more from them.
I just got a parking fine do I make contact because I wasn't the driver but the registered owner ... do I have to respond ? I read by law I don't have to give details of the driver ..
You are not legally obligated to give the driver details at all, and say that in your appeal. As keeper of vehicle you were not the individual parked. It is the driver who has the contract with Evil Parking eye not you. Evil parking eye cannot chase you just because you are the registered keeper of the vehicle and under Protection of freedom of speech act you do not need to let them know who that driver was … hope that helps
They send me a fine today for parking 10 minutes extra . Not my fault no clear signs and it was busy so i couldn't reverse out of the bay . Someone tell me what to do ? It was only 10 minutes i swear
Just dispute it with parking eye first, courts look favourably on you trying to resolve this first with the private entity. make sure you attend court otherwise they will favour parking eye. most private parking firms rarely show up in court they only do it to set an example sometimes, very likely they wont show up and you automatically win

I bought a van for my son to start a light haulage company, so the van is registered in my name. He made a delivery to a hotel, entered his details into a terminal at the reception, did the delivery in 18 mins flat.

I'm not as solicitor but I know the law . It is an offence to gain your home address from the DVLA . Data protection act 1998 .
What about sending, return to sender, no contract. Without opening letters?.

I agree DVLA should not be giving you registration details out..

Agree that is out of order. That's similar to my case which I'm fighting next month on a number of grounds.

I can happily wait 5 years for the CCJ to clear, fuck them
my advice would be to learn the basics.
Can I also mention I was parked at that spot for 10 minutes
My dad followed advice, ignored another company called Dcbl since 2012, they issued a CCJ this January which was confirmed using trust online, so if have a real CCJ, you HAVE to pay then.
bet theres loads not even give a fuck about ccjs🤣🤣🤣

You are not legally obligated to give the driver details at all, and say that in your appeal.

Evil parking eye cannot chase you just because you are the registered keeper of the vehicle and under Protection of freedom of speech act you do not need to let them know who that driver was … hope that helps

I also had a fine from parkin eye from Liverpool, my mum rang me in a panic as I'm not always at home, saying I owed £170 to this con/scam artist, (I HAVE THE TICKET!) To prove that I paid, but had to pay to put my mum's mind at rest, I am now trying to claim the £170 back, I have sent a picture of the ticket to them twice now, with no reply back from them. My mother is 76 years of age and has panic attacks
They sent me a fine for driving in and out of a car park entrance. Total time taken was less than 3 minutes. Absolute disgrace. Needless to say they won't be getting a penny.
There's a 10 minutes grace period.
@@patarciepaul 30 minutes..
fuck them, you dont have to pay if is private land.
Just write to them saying it wasn't you driving and if they'd like to know who was driving then there's a £25 administration fee. I've done it, their debt collecting dept write to you apologising and say the charge is cancelled 😗
I am still waiting for my case to come to court if they win it will cost them a lot more than they will get from me.
IVE JUST GOT A PARKING FINE. I WASNT ABLE TO USE METER AS IT WASNT WORKING. THERE 8 MINUTES AND GOT A FINE.
I bought a van for my son to start a light haulage company, so the van is registered in my name. He made a delivery to a hotel, entered his details into a terminal at the reception, did the delivery in 18 mins flat. He was "pinged" by ANPR and Parkingeye sent me, the registered keeper, the invoice. I am fighting it, and I am going to court in April - despite the hotel asking them to cancel the ticket. So my advice is DON'T IGNORE THE BILL. Don't pay, and appeal it. You might end up having to defend things in court like me, but I am happy to do that. Ill be "£$%ed if I am just going to roll over and pay £175 to do a legitimate delivery to the very premises Parking eye are supposed to be looking after. Something needs to be done about these highwaymen.
oh my god. I didnt pay 7 years for any parking with private land. Ignore them thats it.
Anyone can take anyone else to county court. If the other party don't contest it then you win by default.
so what ~~~~ dont give any money ~~~anyone can stick a notice up about anything saying pay money and take someone to court
@@Sportliveonline -correct, they can but if backed by contract law and you breach the terms willingly then 'not giving any money' is the least of your worries...
@@ef7480 when you park on private land you didnt sign any contract with them.
I got ticket from parking eye for 9 min of stoping in car park just to have a chat for my son's birthday apposite street ...
Parking eye really are scumbags I received an unfair ticket for parking at a hotel for a course that the course providers told me free parking I parked for 6 days then got 6 tickets appealed got 5 cancelled and one appeal rejected, can’t speak to anyone no customer service because that just makes their scamming easier pathetic excuse of a company🤮🤬
i had a ticket that ended up being £451 still never payed
What happened ?
nothing .think they got the message
@@rob4831 Really? I read they can take you court lol
@@jasminali6490 never happened
Parking eye and other these types of companies pays subscription fees for BPA- it’s not a gov body and BPA pays salary to their employees- and parking eye pay money to DVLA for giving general public’s info and we pay them to do all these. And the cycle continues..
I paid £6 to park in car park. 6 hours I came back 18mins late and yet they've been harassing me for 4 months with £160 fines
Parking eye are scam artists there even worse now the original owner. Has sold it! I paid £12 to park at the ibis car park run by (Britannia car parks uk) in Carlisle a bloody con for 12 hours its the fear of the fine😬 £100 only to find i could of parked for free by the manaher at the ibis but they dont tell you that. Its at the point were parling is more expensive than the fuel needed to bloody get there 😡
@@sweetooth1967 I just realised mine is not by Parking Eye but by UKPC now they're sending Zenith Collections after me lol. Just ignore them if they wanna spend money to take you to court for flipping parking theyre idiots
@@manlykscorpa until they take it to the high court and then the high court enforcement officers can come and take what you own. If they don`t progress with the case, it is because they don`t think that it is worth while but if they do, you will lose and owe a lot of money or lose your property. Risk it if you want to, I definitely would not but then, I never park illegally.
@@honestchris7472 Wanker
@@honestchris7472 bullshit, they cannot won because you didnt sign any contract with them about parking.
we should burn down all the cameras around.
If it is a county court judgement that wil Fu k up your credit too.. bastards.. I'm defending a county court with civil enforcement and charging them £500+ for costs as i know I will win the case
I get a lot of people complaining about parking eye they're now preying on hospital visiting car parks! X
Parked at hospital to visit my relative who was ill came out to pay for parking after several attempts to pay it said no charge fee weeks later go fine for £70.00 pounds or £42.00 if I pay within 14 days I’ve tried to pay several times again but it keeps saying unsuccessful I’ve had a gut full you’re right company are a bunch of corrupt bastards.

Good advice 👍
Interfering with the mail (s 84 Postal Services Act 2000)
This is an offence falling short of theft and is intended to punish those who interfere with, but do not steal, the mail of another person.
The Act states:
(1) A person commits an offence if, without reasonable excuse, he -
(a) intentionally delays or opens a postal packet in the course of its transmission by post, or
(b) intentionally opens a mail-bag.
(2) A person commits an offence if, intending to act to a person’s detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him.
The offence is punishable with up to 6 months imprisonment and/or an unlimited fine.
The easiest way out of PCNs is to write back saying it wasn't you driving, it was Mr Madeup Name of 1, Nosuch Road. This means all future letters and court action will go to this person you just made up - you will never see the letters and never get anything on your file. (If you know an empty property use that address - the letters won't even be returned to ParkingEye who will spend loads of money suing someone who doesn't exist.)
There is CCTV where they can check who was driving
@@mindisgl6556 They don't know what you look like.
Only the legislation now allows the company to pursue the keeper of the vehicle not the driver so that 'loophole' has been closed and the keeper is ultimatelty responsible.
How to speak with them
Don’t pay them well I do in away I send them Monopoly money
It's now mid Jan 2023 n I've received a pcn from parking eye sent from a collection agency demanding me to pay a £170 for a supposedly ticket issued back in jun 2021, no other letters in which I'm totally oblivious to
I'm now scared they might send bailiffs
What can I do ??
Don’t park your car by your hiuse on bailif day visit…. They knowck dont open …. They fuk off and never come back
Ignore them, all you can do
Only half an hour but he parked illegally and he should have paid the fine.
Has he opened someone else's mail? Sure that's illegal.
Everyone said don’t pay and i ended up paying more in the court .
The courts are corrupt but ive never seen the collections round here in 3 years despite over 12 begging letters 😒
£120 fine its not worth thier time😁
Fire Ice what company was this with?
th-cam.com/video/_b0jrTEGJIE/w-d-xo.html
why you go to court. I ignore them 7 years now, they cannot do nothing
I got a ccj because of parking eye
and? dont pay nothing
Out dated advice. Ignore the invoices at your peril.
Unless you want CCJ's and the inability to get credit...
That's actually incorrect. A CCJ will only be issued for non payment of any resultant court fee/fine. You would have to first lose your case and then refuse to pay.
Totally ignore any ticket from parking eye, they CANNOT enforce it . ive had parking tickets from them before and i ignore them, nothing happens .....
jonlong42 what about the ccj thing ? I’ve had one from smart parking was gonna ignore as I’ve read but not sure ?
Lol they really can.
I've done cases for plenty of private parking companies and they can enforce it....naturally they don't always win.
