I agree to a certain degree, as someone who has worked under qualified immunity, without it I would not have worked that job, it was under Inspections and to be held liable for every inch of a house wouldn't be right, and to know all the laws in inspections the book is 3 books each 600 pages plus. so there are times when QI is necessary for police officers to be shielded, I would go the route of making them carry liability insurance like doctors do for malpractice.

When the cop arrived, inside you can clearly see "a man" wave his hand as if to say "please move the man with the sign out of here." Then the cop says to Jeff they want him to leave the property and threatens him with TRESPASSING. Officer talks a second time to the man inside and comes back saying that Jeff is "allowed" to stay. I wish the man inside would make up his mind before calling the police!!!

@@johnwesterlund Most everywhere. I live in a large county in Kansas with barely 2500 people, 1 sheriff and 5 deputies, all of which are good cops because we know them. We know where they live, their family and friends and they know they will be held accountable if they act like this. That's the wonder and beauty of small town living. We had a 1st amendment auditor here. He left without any confrontational footage because he was welcomed to record our sheriff's office, our city offices and even the courtroom because no court was in session. ❤️👍🇺🇲

People there are still very upset over the death of the newspaper's owner's mother. The cop was fired and we'll see how it works out in court. And Marion county has 6 times the population as us and that cop came from Kansas city, all of ours are local guys. Homegrown boys.

No the problem is they take the word of anyone who complains as fact and that makes the person who the complaint is about guilty. The investigation entails hearsay and getting you to investigate yourself. They act like hall monitors and lie and manipulate to get you to do what they want. Your rights are tossed aside if it gets the problem resolved so they can go back to do what they do when there are no real crimes, nothing.
When they say "paid by the hour", they mean they don't care about the job, they're just in it for the money. The results of their actions are are immaterial.

For people who might not know, the request of body cam footage from an incident may approach $30/hour of video. In my jurisdiction, that covers research, downloading, reviewing and redacting and transferring files to DVD format. If four officers responded, requesting a hour of video from each (which appears to be the minimum time interval) I would have been charged $135. What Jeff is doing is not cheap.
On the other hand, Jeff makes decent enough money from these videos to cover the costs, and more. He wouldn't still be doing it if he was losing money.
Dig deep into the public records statutes of your state. They tried that BS here charging us exorbitant fees for public documents, including video. In WA, if we have the means to copy documents, they must afford the opportunity. Usually, to avoid that, documents are simply e-mailed.
Screw that! Every civil rights violation is a CRIMINAL ACT. There must be mandatory jail sentencing. Ignorance of the law is not a defense. So, I've been told.
What is concerning is when Jeff initially said and recommended that the cop contact the State's Attorney, the Mayor, Your Supervisor, the Cop quipped, "who do You think called Us here" Right there is the issue, Until all immunities and privledges are stripped in all Federal, State, Municipal and County, "Equal Justice For All!"..... I'd like to know exactly how many times he's done this before, and to whom. I'd also like each of those people to get in touch with a civil rights attorney and discuss litigation, including a Monell claim against Clearwater for a pattern of abusive behavior.

When you watch other footage of this encounter, you will see that an officer himself initiated the call of complaint. Escalated it himself to the point of "tresspass". Then, apparently gets a stand down order, before backing off and blaming someone else inside the city hall. DISPICABLE!

1st A. auditors and lawsuits happened. Not all cops are up to speed that we're fighting back for our Rights that they so easily violated and get away with it.
Yet two more cops who belong in prison. While they did reverse their position, their initial choice was to intimidate, threaten, and/or coerce a citizen in retaliation for that citizen exercising their rights, with the goal of getting that citizen to waive their rights. That is felonies under USC 18.13.241 and 242. Also note how the office was given information that the someone lied to him during a police investigation. And that how even after he said the building has audio and video recordings he could check, he doesn't seem interested at all in investigating that potential criminal conduct.
"All I can do is go off what people say to me..." or, and hear me out here, he could conduct a substantive investigation. He said there was cameras covering the entire area so it shouldn't be a problem for him to go get evidence.

That cop tried all the b.s. lies and tactics though, saying they have a "tried and true ordinance that has been held up in court for many many years" and he claims he has "cited many people for panhandling" and "they can trespass you because they don't want you here" and of course the ol "you don't have legitimate business here". There's no way this cop has made it to corporal without knowing how absolutely stupid he sounds to anyone who knows anything about the law. Of course he tried to use hearsay to make an attempt at saying he was disorderly yelling at people. Of course saying "God bless the homeless vets" could never cause alarm to a normal person.
Start lining them up to answer to Internal Affairs like happened in New Smyrna Beach Florida? That Investigator interviewing the New Smyrna Beach Officers that violated Jeff's rights. That Investigator Lt Mark Severance is pretty cool guy. He once responded to some scumbags breaking into my car in 2011. He came to my door.He was then a patrol Officer. He had Officer Holcomb as another responding unit with his K9 Buddy catch the guy.
The cops in the end figured out Jeff was an auditor . If it had just been a homeless person they would have escorted him off the property and probably arrested him. Then they could go back to whoever called them and let them know what wonderfull officers they were. Pompous a-holes !
They don't need to give you a written trespass in order to trespass you nor to enforce the trespass if you don't leave (or if you come back). Jeff's recordings are plenty good to establish he's being trespassed. (Especially given that he asks the right questions and elicits responses.)
Jeff is, imo, the best 1st amendment auditor on TH-cam. He's not doing this to stroke his own ego, to show how smart he is and how ignorant police are. He's doing it to educate and improve communities. And hopefully give more freedom to people who don't have his knowledge of the law, access to high quality human rights attorneys. Bravo, sir.

Jeff should definitely have more subscribers, he's among the best, maybe THE best. And I appreciate that he doesn't go for the low-hanging fruit like post offices and desk clerks. Lawsuits are very expensive, no guarantee of winning, and most lawyers won't touch them because there's no financial reward for them.

That's possibly the stupidest thing I have ever heard a cop say.
For people who might not know, the request of body cam footage from an incident may approach $30/hour of video. In my jurisdiction, that covers research, downloading, reviewing and redacting and transferring files to DVD format. If four officers responded, requesting a hour of video from each (which appears to be the minimum time interval) I would have been charged $135. What Jeff is doing is not cheap.
Why do we have to pay extra for our employees to do the work we hired them for ? It makes no sense.
On the other hand, Jeff makes decent enough money from these videos to cover the costs, and more. He wouldn't still be doing it if he was losing money.
The government has a lot of staff to review the requests and spin what they release in a way that makes them look good.
Facts. evidence "custodians" get paid an average of $27 an hour in my state.
Dig deep into the public records statutes of your state. They tried that BS here charging us exorbitant fees for public documents, including video. In WA, if we have the means to copy documents, they must afford the opportunity. Usually, to avoid that, documents are simply e-mailed.
We really need education for police officers on the law and people’s rights more than ever.
Accountability is the only education they need.

This is what should make it a big deal for him. I'd like to know exactly how many times he's done this before, and to whom. I'd also like each of those people to get in touch with a civil rights attorney and discuss litigation, including a Monell claim against Clearwater for a pattern of abusive behavior.
What was truly horrible was the fact that these police have violated law and citizens right many times before and a court assisted in this violation.

When you watch other footage of this encounter, you will see that an officer himself initiated the call of complaint. Escalated it himself to the point of "tresspass". Then, apparently gets a stand down order, before backing off and blaming someone else inside the city hall. DISPICABLE!

What happened to that City Ordinance that has been tried and upheld in the courts?
1st A. auditors and lawsuits happened. Not all cops are up to speed that we're fighting back for our Rights that they so easily violated and get away with it.
Yet two more cops who belong in prison. While they did reverse their position, their initial choice was to intimidate, threaten, and/or coerce a citizen in retaliation for that citizen exercising their rights, with the goal of getting that citizen to waive their rights. That is felonies under USC 18.13.241 and 242.
Also note how the office was given information that the someone lied to him during a police investigation. And that how even after he said the building has audio and video recordings he could check, he doesn't seem interested at all in investigating that potential criminal conduct.

ALWAYS GET A WRITTEN TRESPASS AND TAKE IT TO THE LAWYER NOW YOU GOT PROOF OF THEIR VIOLATION
They don't need to give you a written trespass in order to trespass you nor to enforce the trespass if you don't leave (or if you come back). Jeff's recordings are plenty good to establish he's being trespassed. (Especially given that he asks the right questions and elicits responses.)
Jeff is, imo, the best 1st amendment auditor on TH-cam. He's not doing this to stroke his own ego, to show how smart he is and how ignorant police are. He's doing it to educate and improve communities. And hopefully give more freedom to people who don't have his knowledge of the law, access to high quality human rights attorneys. Bravo, sir.

Jeff should definitely have more subscribers, he's among the best, maybe THE best. And I appreciate that he doesn't go for the low-hanging fruit like post offices and desk clerks. Lawsuits are very expensive, no guarantee of winning, and most lawyers won't touch them because there's no financial reward for them.
