    The breaching is valid only if it's enforceable or else no company can sue you for dual employment.
    Because the contract is one sided and one sided contract is void which is not enforceable because you're stopping someone for their livelihood. Our Constitution has mentioned about the rights to livelihood. And no company in India are above our constitution.
    Breaching is valid only if we involve in any kind of misconduct, privacy breaching, harrasment, etc. Stopping someone from their livelihood is not at all valid.

    Bonds/agreements/contracts to restrain an employee to leave employment is void and such bonds are hardly enforceable in the court of law there is hardly anything legal likely to happen in such scenario.

      No while employment is active it is actually valid. Post employment non-compete clauses are not valid in India though.

      @matrixlnmi169 depends how damaged company feel about the act, they can send legal notice to the employee and then the court case follows

    I have dual employment issue. Got PF overlapping issue for 5 months and Terminated from Capgemini by last year. So couldn’t apply jobs and background verification getting failed. Any possibility to resolve this issue??

      Check with your organization from where overlapping happened and ask them to update.

      Apply in startups or mid level companies which do not care much of background verification. They need your skills unlike big Indian MNCs like wipro Capgemini etc. I don't think even big foreign MNCs will bother about your dual employee status of 5 months. Have a proper explanation for that, more importantly improve your skillset then you will get jobs in many companies . Best of luck

    Even if you don’t sign your I’ll have 2 PF accounts for Same duration and it will be a big noo in other background verification. So don’t fall for such trap . If you want to earn passive do something else Which does not have PF or preferr cash

      Definitely...unless it is a disciplinary termination.if it is performance based termination, please improve your skillsets, only improving skillset and doind good projects you will get job. Btw why can't your old company asked you to resign instead of termination i mean your relieving letter says it is terminated? One more thing many companies say day of joining and day of termination. Which is perfectly ok, which says it's last working day , not terminated. Even when I resigned from my company because of another offer, I got relieving letter as day of termination. This is a big Indian MNC. It gives like that to all.

    FIRST OF ALL IT US ILLEGAL FOR COMPANIES TO MAKE A CONTRACT THAT DOESN'T ALLOW PEOPLE TO WORK TWO JOBS TI SUPPORT THE FAMYILY CAN U TELL ME NAME OF COMPANY THAT HAS THIS VERBAGE ON THE LETTER SO YOU CAN SUE THEM
