Lvnv started a lawsuit in june. Now January they still have not service their claim. I filed a motion due to non service. Had a hearing judge ordered reservice. Back in nov. Now in January still no service. Anyway on how to proceed
Eventually the judge is likely to dismiss it if thy don't serve you. But by filing the motion, you alerted the judge that you know about the case and probably delayed that result. I would just keep an eye on the docket. Do you live in the same county they sued you in? If not, LVNV has probably broken the law and you might be able to counter-sue them and wipe out the debt.
I read some people saying in the comments that if you send a cease and desist letter, the debt collector will take you to court. I think it is good to send this letter when you have a good lawyer by your side. But most people are really struggling because they are low income people who cannot afford a lawyer to help them with it.
Question- I debt collector got a judgment against me. My wages got garnished. I have one more payment left. Can a debt collector get a judgment against me without it showing up on my credit report?
Hi! I've recently been served by Velocity Investments, LLC for just over $10k. My only source of income is disability with the VA. I've responded to their complaint, denying I owe them the debt. While waiting for them to make their next move, should I email them a form showing that's my financial situation? I don't work, and haven't since exiting the military. Thank you for all you do! -Evan
I don’t know what state you’re in, but it sounds like you’re on the right track so far. If you’re in Florida, give us a call and we can help you. Otherwise, you’ll probably wanna talk to a lawyer in your state who handles debt defense cases. But whatever you do, don’t give them any financial information just yet. See what they are bringing to the table 1st.
Most uneducated poor people can't afford to take them to court. How do you eliminate a company that keeps contacting you years after the debt was made? The CC Company keeps renewing the debt saying they only want assets if you ever get any. Thumbs up to your video.
@@thomastommy1192 If you're in Florida, call us. If not, find a lawyer in your state who handles "FDCPA" cases. If they find a way in which your debt collector has broken the law, they can sue the debt collector for you.
These guys are fabulous, saved me from an LVNV lawsuit
That’s fantastic!

Almost all of our clients are struggling and we’re able to make it doable for them.
Thank you for this video!! I wish you practiced in Texas :(
There are two Texas lawyers you may want to call: Bill Clanton and Daniel Ciment.
@ Thank you so much!!!!
@@danielrichard1857 You're welcome!
Hi, what do you do when they send statements of the debt, but no signatures. Should someone still send a cease and decist letter?
We look for ways in which they have broken the law, then we sue them. In such a case, the debt collectors pay for the legal bills.

Sounds like they already got a judgment. It might not show up on your credit report, but you'll definitely want to check that.
@RWlawFL i have been checking and all 3 major credit bureaus are not showing any public judgements
@@njmark70 That's good.

@RWlawFL thank you for your response! Unfortunately, I'm out here in Idaho.
@@evanpeterson1885 I wish I knew someone out there, but I don't.

When a debt collector breaks the law, your lawyer is free. So there’s never going to be a problem “affording” to take one to court.
@@RWlawFL How do I get that legal help?
