Many years ago I had a friend that had a pool. Now I was not that close to him, he was a school mate and we did go to the same church so even though we socialized offen we weren't really not that close. There was an occasion when I ended up dating his best friend. One weekend when my BF knew that friend and family were out of town we snuck into their back yard and went swimming. To say you would buy and then discover a pool implies: 1) You never walked through the house, virtually or in person. 2) You never had an appraisal done, which would 100% include the pool. 3) You have an improper insurance policy, which must include having the pool. 4) You never had a home inspection done which must include pool safety compliance. There are other implications, but if you have a mortgage, you'd never be able to buy the house without 2, 3, and 4. In order to declare a person's private property into a community area, you would have to re-zone the residential area into a community one, and compensate the owner. The HOA DOES NOT have the authority to do so. Only the city, county, state and federal levels have that authority. Not only did Karen expose the HOA to massive liability issues, (insurance, health laws, taxes, lifeguards, etc), she committed major civil and criminal acts of tresspassing, theft and harassment.

No, using your pool is one thing and still trespassing, but nothing says that they are allowed in your house! How are they even getting in? I will report them all for trespassing on private property. The title story: if the HOA declared my pool and private property a communal area i would get my lawyer to draft up a contract for the HOA, it would state "as the pool is now communal property seemingly owned and operated by the HOA and is not my private property, i am not obligated to pay for it's upkeep, repairs or costs to keep it running, from this point on i will be sending all my bills linked to the pool and it's continued use to the HOA, also i will be adding a rental fee for the space the pool occupies on my private property and a fee to use the amenities inside my private property, after receiving this letter if the pool is still being used under the instruction of the HOA i will take that as confirmation of the contract and will start sending invoices and requesting back pay for the use of the pool."

Many years ago I had a friend that had a pool. Now I was not that close to him, he was a school mate and we did go to the same church so even though we socialized offen we weren't really not that close. There was an occasion when I ended up dating his best friend. One weekend when my BF knew that friend and family were out of town we snuck into their back yard and went swimming. We knew we weren't hurting anything and made and extra point to make sure everything was well cleaned up before we left but even though we had never been caught I still felt guilty for what we did.

He just had neighbor towed without warning. It could be that someone in the HOA had told him where he was parking was okay vs. where OP was parking. We don't know. But it was really low to have neighbor towed without warning or explanation. OP needs to quit thinking they're some kind of hero or something. They didn't give the guy a warning because they were a chickens**t who didn't have the nerve to warn him because neighbor would then know it was him that had him towed. If the pool is declared as public property, then the HOA is liable for insurance, maintenance, and meeting all safety regulations such as having a lifeguard. Furthermore, you need to have the area rezoned as a public area. Karen did NONE of that, so this was tresspassing and damage to private property. HOA bylaws do NOT override city ordinances. That lawyer didn't know jack squat. I would have called the cops the first time around.

Pool story is complete BS. As anyone who owns a home knows, you don't buy a home and “discover” it has a pool. Also, the HOA making your private property public is complete BS for reasons far too numerous to list here.
Guess you didn't hear the whole story. You can certainly buy a house and the realtor can either forget or fail to mention it has an in-ground pool. Next, the HOA Karen overstepped her bounds and didn't do the proper paperwork. First of all, the HOA needs to have the private property re-zoned into a public one with the city. Karen didn't do that. You need to have the area certified with the Health Inspector. Karen didn't do that. You need to take on the insurance liability, upkeep of the pool, utilities and hire lifeguards. Karen did NONE of that. She just wanted to take advantage of OP's pool. That's why she got slammed when the cops stated that she didn't have any paperwork showing she and the others had a legal right to be there. What she did was flagrant trespassing and property theft.
I would have called the cops on the first incident and have that HOA lawyer fired for not knowing basic property laws. I would have also demanded the HOA be dissolved for reckless child endangerment, overstepping its bounds, and allowing for Karen change the bylaws, which do NOT override city, county, state and federal laws.

To say you would buy and then discover a pool implies: 1) You never walked through the house, virtually or in person. 2) You never had an appraisal done, which would 100% include the pool. 3) You have an improper insurance policy, which must include having the pool. 4) You never had a home inspection done which must include pool safety compliance. There are other implications, but if you have a mortgage, you'd never be able to buy the house without 2, 3, and 4. If you are buying straight away with your own cash, then you are just a complete moron, especially for not doing step 1. I guess, in some corner case, this scenario would be plausible for an idiot with too much money.
The explanation for all the steps they would have to do to make it available to the entire HOA is also completely off. The only way to do it would be for the HOA to enter into a transaction with the land title holder (likely the bank) and get city approval to subdivide the plat- this requires agreement by the bank and the city (which they would almost certainly never give). After which the property would still be privately held by the HOA, not public. Any attempt by the HOA to do anything else is theft, trespassing, and probably numerous other crimes.
