madam apne ye padhaya toh bhoot badiya hai bss jo section mai b ki jagha a krr diya. a is for cruelty not for desertion. and ek doubt hai ye jo cunstructive desertion ha isme toh section apply he nhi hoga nah jab 2year ka physical separation without any excuse he nhi dikhra toh kese desertion ke ground mai calculate karenge yee toh bss ek theory ke rup main he rhee jayega ground.

till now divorce case is running in d court...
2018 to till now 3 years! Is 3 years considered as desertion! Pls replay
If the spouse filed a false case of dowry but still they are not living together more than 2 years. In this condition is it applicable or not??

Maidam koi section 9 laga de desertion petition file karne ke pahle .
Maam agar husband higher education ke liye foreign country gaya for 2 yes and then udhar usski job laggai and he wants his wife to come with him but his wife refuse to come and stay with his family, kay wife desertion file kar sakti hai?
is desertion work, (1) if spouse wants to come after 3 years separation and before petition? and (2) if wife lives with her parents and she is not coming because her parents does not want to send her due to their ego?
If spouse wants to come home before filing a petition by the other spouse then no, desertion in this case won't be a ground for divorce. (The reason is that, desertion ended the moment the offer to come back was made by the spouse and the communication was done)
Hi , since 2021 my husband and me are separated and he is not in contact (no phone calls and not coming to the home i was leaving with my parents). Now i have sent a lawyer notice asking him for mutual divorce and now he is speaking through mediators and telling that he would not like to give divorce. All this he is doing is just because of money and the property i have. Now i Don't have trust in him I want to take divorce. Can I file a case on the bases desertion .

@@ashu4227 see there's a lot of difference between a question given on limited facts and answering it according to the given principal vs what the real situation is with both sides(i.e. with proof) and filing a suite in the court of law to resolve a problem...
