    They ABSOLUTELY ARE RESPONSIBLE for ensuring that the upstairs neighbors are not disturbing the place or else they cannot use it as an AirBnb. PERIOD. They could have easily notified the upstairs people in advance.

    Even if it's not their property they knew there was construction going on and should've notified her. Who would knowingly go on vacation and spend that amount of money on a rental unit to listen to construction. They did this lady so wrong and it's going to come back to bite them in the butt.

      @@xfga4531 Who said anything about controlling construction? They can't control construction but they can definitely control how they treat people.
      If you're renting out vacation property and there is construction going on you have a duty to inform your renter. Allow them to decide if they want to come. Don't withhold information that could ruin someone's vacation that they're paying good money for.
      The fact that the defendants knew the entire history about the people that were doing the construction let's me know they had some type of window of time to inform the plaintiffs. They could've even offered a discount. There's no possible way the defendants we're renting out that property and didn't know especially since they had to make sure it was cleaned, prepped, etc.
      If you want to retain someone's business while also building your business this would NOT be the way to do it.

    I work out there. It usually is pretty quiet and before construction begins, everyone on the block gets written notice - well in advance. They knew about it and they're playing ignorant in court. Foul of them not to warn her.

    I kind of disagree... these people are renting out their unit (making a profit). If that unit is unbearable to stay in due to construction (even if they didn't control the construction schedule), the person paying should have some sort of recompense. Especially if paying $5.5k for a week.

      But they did not notify the owners of the noise issue, they assumed it was a lost cause, so chose not to allow owners to resolve it & then sued for compensation over it.....that's a bad faith argument & a money grab.

    What if the landlords knew that there was ongoing loud intermittent construction upstairs that summer and chose not to inform their tenants? I believe that would be false advertising/breech of contract and worthy of a partial reimbursement.

    I have a condo that I rent by the week in popular tourist destination. If something occurs that causes a real disturbance for the guests, (even if beyond my control and not part of my condo) I give a full refund. It doesn’t happen often, but it’s my responsibility to deal with other owners if a problem is coming from their unit. It’s certainly not the responsibility of the paying guest who has no idea any disturbance will happen!
    JJ is off base on this one.

    Why are they renting out their house if they have no control over the top unit??? Legally they aren't responsible for the Construction Noise because they have no control over it but that's why they shouldn't be renting their unit in the first place because $5300 is a lot of money to have no control over noise. I would be mad at hell paying you all that money and have to hear all that noise overhead every day of my vacation. ..👀

      I think it's a duplex, in which case each apartment (or floor) was probably independently owned and not part of a complex or association. LOTS of those in Ocean City.

    I’m from South Jersey. My aunt has owned units and now a home in Ocean City for 20 some years. I know tons of people who rent, and several who own and rent in Ocean City. Until this video, I have never encountered a single person who would pay $5300 for a week in a first floor of a duplex for NINE PEOPLE that’s marketed with the word “SHABBY” in the ad. My mind is blown.

    Defendants should not be held responsible for the construction noise, but plaintiff should be able to have peaceful enjoyment of the premises. Plaintiff should have gotten money back and defendants should sue the owner of the other unit

    If the rental was east of Philadelphia then we can assume she was not far from West Philadelphia and I’d like to assume that is where the defendants were born and raised. It would be simple to assume when they were young on the playground is where they spent most of their days . Sometimes they would be chilling out , sometimes maxing out and others relaxing out and at least once playing B-ball outside of the school .
