    We will explore some strategies that may help reduce your risk and increase your recovery by using an Offer of Settlement.
    The Offer of Settlement laws and procedures are very complex and have undergone numerous changes since they were first created. This video is a simple overview of the Offer of Settlement procedure. But every case is unique and there are lots of variables that affect each Offer. But this video should help give you a basic foundation of how you can use them in a personal injury case.
    Most people have heard that in England, the loser of a law suit has to pay the winners attorney fees. Well in Florida, we have a similar law that says if any party offers to settle the case with the other side, and the other side rejects the offer, and you go to trial and win by more than 25% of your offer, then as a penalty to the side who made you go all the way to trial, they may have to pay your attorney fees on top of your award.
    This sounds simple enough, but let me tell you it is very complicated.
    There is a lot of strategy that goes into deciding how much to make an offer for, when to make it, and for how much.
    Offers of Settlement are common in personal injury cases. In a typical car accident case that is litigated considering how to send an Offer of Settlement is very important, as well as understanding how to respond to one if it is sent to you.

    I wanted to speak with him but haven't received anything. I am praying that I hear from him soon. I am falling apart and he is the first person I saw who made me feel there was some hope. I've never come across someone who showed so much compassion or has shown his knowledge in such a way..I desperately need help and hope I hear from you soon @mattlaw

      MattLaw how are you thank.you for the helpful information I have question does the policy limit apply if you go to arbitration or trial what about if the Arbiter award more then the policy limit how it's going to work please explain to me

      If you are in Florida, and you recover more than the policy limits, then the at fault person should pay you the amount over the insurance policy limits. However, if the insurance company acted in bad faith toward their insured, then the insurance company might have to pay the excess above and beyond the insurance policy limits. But you need to talk to your lawyer about this. Bad faith is a complex issue that will require an attorney to help you.

    i was involved in a car accident ( i wasn't my fault ) now my lawyer is telling me that is i settle with the offer they gave me they might not be any money left for me ( it was a horrible exp they treated me like i work for them they still doing it ) i ask to be in charge of my medical bills he say i can pay them in full if i like but they has to be paid ( before on when settlement money comes ) i understand the liens but how about those collections ? does he has to pay that ? is he breaking any rule by letting my bills going to the collection ? he is blowing my phone now asking me what bills I'm am going to pay what can i say? thanks

      When a settlement happens, you want to pay the bills to protect your credit. Some of the doctors may have been paid from your no fault insurance, or your health insurance, or some other source. You need to sit down with you lawyer and go over all of your bills and figure out how to pay everyone. You don't want a bill showing up 3 months later. Or find out your health insurance wants their money back. Make sure you and the lawyer talk about all of your bills and who is getting paid.

    I got hurt in job in japan the first lawyer did sold me Out for
    the company Than I fire him. and got a new one . The interesting is
    that this second lawyer after we finish the settlement for salary
    he went to court alone and i think negociate the final settlement
    alone ????????????????? I am not well sure about becouse we cant
    read the japanese letters so my question is can a lawyer an judge
    alone decide about how much worth my case ????????? I am waiting
    to go to court and lawyer didnt accept my calls and e mails , fax
    nothing now i have this new ???

      Hi there Blessing. I don't know how a lawyer can resolve your injury claim without your knowledge or approval. I suggest you send him a written letter asking him to explain where your claim is, and find out what he may have done. A letter is always the best way to contact your attorney because this is a written document that will accurately reflect your concerns and hopefully his answers.

      Hi Blessing. I don't know how the laws work in Japan. In Florida a workers compensation case requires the injured person to be involved in any settlement. There are many issues and questions you will have. I suggest you write a letter to your lawyer and ask them to explain where your case is and what happened.

      You are 100% correct. Serious injuries can't be fixed by money, and the amount it takes to make up for the losses is quite substantial. With less than half the cars on the road carrying the right insurance, we can only buy UM to protect ourselves.
