I don't think it matter which specific miner you take, as long as you take it from the right reserve (uncommissioned miners / free zone). In the case where it is empty but you have miners in the miner pool, you may take one of those instead. Rulebook page 13, middle-right of the page. In the end, it technically makes no difference. You can take the right-most, or any miner from that reserve. It's just that by explicitly saying "right-most miner", there's an implied importance to the miner order in the reserve, and there is not.
