He isn't even really making an exception. Judges are given discretion. He is exercising that due to circumstances.
He's a judge, but he's also a human being. Too many forget to be that nowadays.

One of the basic tenants of criminology that is taught at my university is that crime tends to be a result of circumstances and societal conditions. In order to lower crime rates and promote rehabilitation, society must push to improve the circumstances in which those who commit these crimes exist. I'm not saying that a few parking violations are a crime, but that I think Judge Caprio recognises and appreciates that throwing people into a deeper hole than which they are already in does not serve anyone. Why further derail someone's life for a victimless offence when there is nothing to be gained and a lot to be lost? Its the same reason why (at least in Australia and some European countries), there have been big pushes and steps towards rehabilitation as opposed to punishment. Incarceration for those who cannot be rehabilitated? Sure, it protects society from harm, however there is much to be gained from steering someone towards the correct path as opposed to locking them away and then releasing them with no concept of where to go afterwards.

The fact that she says, "Thank you, your honour," right after what the judge said even though it's only going to leave her with five dollars really got me. She is grateful and not trying to take advantage of people's feelings, even though after paying the fee she'll practically be broke.

Perhaps it might be during a terrible period of life such as the one this lady was clearly experiencing? Or perhaps during a period when everything is going ‘super well’ but a decision that could take all that away rests is in the hands of a person with zero understanding or consideration?

From an outside perspective (I'm from the UK), it seems that this trail of thought is particularly prevalent in the US because of how culturally there's a focus on an individualistic lifestyle rather than a communal one. Having an established and compassionate welfare state in UK has worked especially well in expanding community cohesion, everyone is equally entitled to a level of support financially and emotionally.

very nice. The judge is very respectful and humble. The fines and prisons should be for bad and careless people to deter them and not for the those who are going through trauma like her. Her story seems to be genuine. I think he made a good decision.

I just started watching this judge from a pop up yesterday and am astounded at how compassionate and real he is. I imagine God to be like this. He is the judge and can punish me anyway he sees fit, but has love and compassion for me and offers a hand to lift me up out of the mire. What a wonderful human being. Imagine what the world could be like if we were all like this judge.

I have seen this video more than once, and it tears my heart out each time. This poor woman has suffered one setback after another and was nearing a breakdown. I can't believe Social Security cut her check because of a lousy $75 back payment owed by her deceased son! Losing her son should have been enough payment with interest! That's our government working to get every penny for the coffers! I am so happy to learn she was able to get some financial relief through GoFundMe, and I hope the money keeps coming in. It will never replace her child, but at least it will help reduce her daily struggle to survive. God bless her!

Agree. Well, this is one of the few, very few judges, who actually knows what his job is. A judge's job is NOT to interpret and apply the law. A judge's job is to make sure JUSTICE is established among people and entities. Most Americans confuse law with justice. Judge Caprio ESTABLISHED JUSTICE BEFORE A LAW THAT WAS LEAVING THIS WOMAN WITH NOTHING. Judge Caprio KNOWS what his job is.
What is blind is not justice, but the law, because it is the same for everybody when applied as such. Justice is vision. Great judge.
