Also regarding the the copyright claim from Fox I'm pretty sure this is how it happened. So fox didn't actually seek out your video and put a claim on it and it was all automated. How Content ID works is it can detect audio and video. What Fox and other networks that choose to with their TV shows is they upload the full length TV show to TH-cams Content ID server so that if someone tires to upload a TV show to TH-cam it will scan what's in the server to see if it matches anything on the Content ID server. Then in this case they uploaded the family Guy episode to the content ID server and since they used your clip in the episode that was also part of what was uploaded to the content ID server. Then when it scanned youtube your video matched the audio and video of what was on the family Guy episode causing a Content ID claim on your video. This also works the same way for music uploaded to TH-cam too if it matches what's on the Content ID server it will create a claim. TV stations can also detect their watermarks in videos too.

He doesn't own anything except any talking done over the top of the video, which Family Guy stripped out and put their own in. So, if anyone has a case, Konami does against Fox. Fox was 100% in the right to "steal" this content if they had permission from the original owners: Konami or Nintendo.

I am not normally one to comment on youtube videos, but I was led here because of the huge media coverage on it following the Family Guy / Fox Fiasco. I have to say you are a very honorable and compassionate person, sw1tched. A lot of people in your shoes would be considering legal action against Fox and such (as mentioned in the comments quite a lot), but to just be thankful your video was back without too much of a hassle and even thanking them for the acknowledgement that it exists shows an honor that's rare in this world. Kudos to you for keeping a clear head.

I know. I think it was reasonably resolved myself. Though, I will say that TH-cam really needs to look into their "Automatic" screening process and maybe update it so that it can contact both parties about the issue to confirm or deny "infringement" before instigating an auto-take down. It would involve a little more red tape, but it would avoid things like this in the future.

Then in this case they uploaded the family Guy episode to the content ID server and since they used your clip in the episode that was also part of what was uploaded to the content ID server. Then when it scanned youtube your video matched the audio and video of what was on the family Guy episode causing a Content ID claim on your video. This also works the same way for music uploaded to TH-cam too if it matches what's on the Content ID server it will create a claim. TV stations can also detect their watermarks in videos too.
Okay fine, but why in the world would they use someone else's content commercially without contacting them first? Do they have zero understanding on how copyright works? 4 years later and this still blows my mind how fox thinks it is above the law

@@BluecoreG Technically it’s not copyright. The only thing FOX/Family Guy used was the game footage (which isn’t owned by the uploaded, but rather Nintendo/Konami). They added their own audio, making it fair use.

I'd argue Fox or Family Guy producers owe you some money. I don't think what they did qualifies as Fair Use at all since they used most of the clip and it was used in a for profit basis. Nice to see Fox getting caught infringing your copyright.

So, if anyone has a case, Konami does against Fox. But, I am sure Fox covered their bases by getting permission from Komami before-hand.
Fox was 100% in the right to "steal" this content if they had permission from the original owners: Konami or Nintendo.

I think he has a better fair use argument than Fox. he is criticizing and analyzing the game while Fox just ripped him off. it's not just talking over but also him playing. removing the sound shouldn't be enough to say it isn't his creative content derivative from Konami's and Nintendo's copyright. granted he did not ask Konami for permission but removing the sound should not be enough as long as it shows him playing.
"Playing ability" isn't copyrightable. Fox may have done something shady, but they are 100% in the right if they had proper permission from Nintendo. Like I said: this content belongs to them. Nintendo can send a takedown notice to YT and have this video removed and they would be 100% in the right as well. They own it the content. This guy doesn't have a case whatsoever. It'd get thrown out if he tried.

I am not normally one to comment on youtube videos, but I was led here because of the huge media coverage on it following the Family Guy / Fox Fiasco. I have to say you are a very honorable and compassionate person, sw1tched. A lot of people in your shoes would be considering legal action against Fox and such (as mentioned in the comments quite a lot), but to just be thankful your video was back without too much of a hassle and even thanking them for the acknowledgement that it exists shows an honor that's rare in this world.

I know. I think it was reasonably resolved myself. Though, I will say that TH-cam really needs to look into their "Automatic" screening process and maybe update it so that it can contact both parties about the issue to confirm or deny "infringement" before instigating an auto-take down. It would involve a little more red tape, but it would avoid things like this in the future.
