I'm 100% for this legislation my question is, if this bill is to promote the use of land for public interest what about all the state owned land that has been barren and under utiliazed for decades who expropriates that?

Any minister or government executive may refuse to implement any law they legitimately believe to be unconstitutional, and all ministers are sworn - first of all and above all else - to uphold and defend the Constitution of The Republic above any law that is subject to it. If McPherson truly believes it to be unconstitutional he is not only within his rights, but is obliged under oath to not act in contravention of the foundation of law in SA.

Fact 1) The constitution is the supreme law of the land Fact 2) All laws and regulations must conform to the constitution Fact 3) All government executives are sworn in to uphold the constitution Fact 4) If an executive encounters a conflict between the constitution and a law or regulation, they are under oath and primary legal obligation to firstly uphold the constitution. These are facts, and the facts don't care about your feelings.
