In other words, we were an independent power fighting against Britain. We gained our independence the moment we declared it. If we lost, then America would simply have been independent for 7 years before being ruled by another power once again.

A nation fighting a war for independence can make trade agreements, form treaties with other nations, and anything else a nation not fighting a war for independence can do. If they lose, they lose their independence.
