I had a deferred claim that was referred for an independent medical opinion. The IMO took about two weeks. I was granted a scheduler 100% P&T as a result of the IMO.
Thank you, of the 3 claims I have 2 that were "Deferred" and they have not let me know IF they are waiting for ME to provide evidence or if they are still "investigating" Thank you for the information and will share with my VSO, but your video at least helped me KNOW the terminology better
My Last 6 yrs in the US Military - it is documented in my Military Medical Records that I was treated at least once every 3 months for Chronic Bronchitis and Pleurisy. The VA Hospital/Clinic provided Continue of Care for Chronic Bronchitis and Pleurisy after my US Military Service, every 3 months afterwards for 4 years. Then Private Medical Physicians took over and continued to provide such Medical Care and Prescribed Medications. The VA had DEFERRED my Claims for Chronic Bronchitis and Pleurisy since 2005. When inquiries are made what additional information is required? The answer always is that they have all the medical information needed at this time, no further information is required from the Veteran. Is there not a TIME LIMIT on how long the VA can continue to DEFER such a well documented Claim?
I had a DBQ in 2012 just after separating from the service with a favorable diagnosis for tinnitus saying more likely than not greater than 50% that it is related to military service and never received a rating, denial, award, deferral so in June I had a hearing test and told the doctor about my tinnitus at the VA then put in a claim and had a C&P exam for hearing loss and tinnitus and the hearing loss was denied which I knew it would be but the tinnitus claim was deferred. The uploaded my DBQ from 2012 so the VA should not deny my claim for tinnitus.
I got back around 4 deferred claims. This is as of last week. The VA hasn’t mailed me or contacted me to let me know, I found out while checking my Va.gov account. Will they mail or contact me to let me know whats next? ***EDIT*** 2 weeks ago, the VA called me in for my final C&P exams for 2 of my 4 deferred conditions (neck, low back, bilateral feet, right elbow ulnar). They only did C&P’s for neck and lower back and awarded me 10 and 20 and just a few days ago, they denied SC for feet and right elbow and all of my claims are fully closed. So now, I’m sitting at exactly 90%. I plan on appealing and hope to raise some to get me to 95 (100%)!
I filed OSA secondary to service connected GERD & Type 2 Diabetes secondary to service connected Hypertension. Claim came back Deferred "Pact Act". what now??

So if your claim is deferred do they continue where they left off once they have the required evidence or does it “start over”?

I got deferred 1998.70% ptsd....was finally granted 100% ........2019....no answer as why it took so long
What is the likelihood of a granted Deferred or denied claim

So deferred is the same as a demand, correct ?, Can we waive a deferred claim ???

yes, the longer they take…. 1 month… 24 months, you will get the amount of your awarded disabilty for those months you waited .
Mine is for the back lower left and right extremity
What if there is no new and relevant evidence but there is a CUE present that led to a denial of an earlier decision?

The VA also has a duty to assist and should be trying to obtain medical records as well so they can finish the claim.
