    A person who never reads the newspaper is smarter than the person who reads the newspaper every day. He who does not stand up for his rights has none. Never ignore a Legal Notice or lawsuit, simply respond accordingly.

    Marshall, that was good information. Now that we have new post covid rules, if you are a tenant CALL THE NUMBER on the papers you are given ! Show up for your appointments and bring your records with you. As a LANDLORD attorney I can say most sincerely that most cases are about money. Tenant needs money to pay rent and Landlord needs money to keep from losing the house and paying the mortgage, fuel bill, taxes etc. By cooperating with your tenant attorney you are more likely to be able to help yourself get that money and stay in that apartment on those nonpayment and sometimes even those holdover cases.     Although I am leaving willingly, the Landlady/management company of my apartment did not even give us the required 30 day notice!!!! And she LIED abt the condition of the apartment too. I'm handicapped too. But I can't stand to live here anyway....

      Cynthia X Because you are handicapped, that will work in your favor. Seek an attorney now. One with shark teeth.
      One you'd be afraid to face in court.
      Don't use an attorney who is buddy buddy with the court.
      Go out of county, a big name.

      If they retaliate within 90 days of your filing a complaint to state authorities, the courts automatically view it as a retaliatory eviction. If they are found guilty they will have to pay civil penalty fines and you could also be awarded money damages. In this case you WANT them to retaliate because then they are BUSTED!!!

    some of the tenants are BS.. They know they can play the system and stay in for months without paying.. If someone is convicted once that person repeats he/she should be evicted in seven days..

      Exactly.ninknow a person who just out an application for two and go back to watch t.v. and just waiting on the mail to see if their bank statement is there's to check it their unemployment money is in it. That's so unfair for landlords..

    I returned home from work yesterday to find an eviction notice posted on my door, 24 hrs after paying more than half the rent due.
    I paid more than half my rent on time and informed the facility manager well ahead of rent date that I would pay the balance before the end of the month.
    I do not currently owe any back rent.
    I work but my hours are irregular and get paid weekly and so I don't get a bulk among of cash upfront.
    I have been searching for a more affordable place but nothing's come up yet.
    I want to know what steps to take next as I have only 48hrs left.

      Did your landlord accept and cash your partial rent payment? If so they have likely forfeited their right to evict you for "non-payment"!!

    Thank you for this video. I am currently facing eviction but studying all the laws and my rights, looking foe loopholes i.e. an error my landlord made which I have found several so far. I submitted my answer already but will be adding more to my answer today along with pictures I will drop off to the court and hand deliever to my landlord's attorney. I found out yesterday I cannot counter sue an eviction notice so I am going to take him to civil court and sue him. Do you have any advice on that? Would it be able for my civil lawsuit to be heard on the same day as my eviction hearing? I am applying for legal aid today so hopefully I qualify for an attorney to represent me. I think I'm off to a good start!

      I live in the i.e. most likely you will go to Fontana Court do not and I repeat do not use legal aid they will not help you they are only there to help speed up the process do whatever you can to pay for a lawyer don't make the same mistakes I did the courts won't listen to you legal aid will mis inform u and give you the wrong paperwork to fill out and to top that they will not help you complete the forms they will let you file it say it ok then on your court date guess what your paperwork is incomplete and you automatically lose the case get a lawyer they can get you 12 months meaning that the landlord will have to pay you to get out at least $12,000 no bull get a lawyee

    What if you pay every month your rent and your landlord is a slumlord and he kick you out and locked it up and have your blood pressure pills in there can he get fine for that and he's got a lump sum from the program from the state of California and he's got another one pending but he locked you out with the 12 year old minor can somebody get suspended on that or find a big fine on that can you give me some helpful answers for this

    any one who reads this ,if yu have any advice i could use reply. ive been a good ten, in a bad apt. i have no lease . its day to day. that what i thought the la l. said. i gave month rent, deposit,security. plus 300. to have my dog... the church helped me get the security and deposit . i found another place i want back the security and 300. but i did not give him a months notice yet and i am leaving the apt. in better condition that what was rented... the apt. has had one problem after another.. i just want what is mine.

    I've been served eviction papers I have a case management hearing next week. I can't afford a lawyer and do not qualify for legal aide. I'm trying to get some help with representationin petrified of what will happen next week. I'm a single mom to a special Needs child who is non verbal. I do everything alone. I have no support system and have only received 3 months of child support in 2 yrs. I fell behind months ago when I lost my only child care that I didn't pay for and was approved for assistance through the covid funding but by the time I got approved they ran out of money. I applied to another program but they state there are 200 applications before mine to review. I work full time I can barely afford groceries no less rent and bills. I did qualify for pro bono bankruptcy lawyer who is helping me do that now but he states unless I can get help with this rent I will be evicted. I did submit a letter of incomefrom the state from that covid program to help prevent eviction but I won't know what that will do until I go to court.

    If you don't have $2,000 to pay on your rent, that's OK. Get a $10,000 legal aid to defend you in the court!!! CLASSIC!

    My daughter's landlord took this month's rent within the 5 day notice to evict, then still had her evicted today, bc he didn't want her service dog there, who is fully trained and certified to her! She was only 2 days late for rent, and had never been late. She's a single mother of 3, and her son and her both have disabilities. He came on to her, then when she rejected him, that's when he started to fish for any reason to get her evicted. The landlord and the judge both broke 2 laws today with not allowing her service dog, and stealing her money. I think this is a private mortgage. Does she have any rights at all, and can the judge and landlord actually get away with breaking 2 laws, and evicting her like that?

      Not an attorney but I don't see how. Are you sure the dog is a certified service animal? Not just an ESA or similar title? There are differences.

    If the money order for your rent is lost or stolen from the leasing office are you obligated by law to help them recover it?
    My leasing office was robbed and they are trying to intimidate us into doing their work of recovering it, tracking the money order etc. And had the nerve to say if we don't, they can't work with us and our account will be charged in full amount. Work with us? They mean us work with them, they are not doing us any favors. I paid my rent and can prove it. By law what are my rights/options?

      i live in NJ the same thing happened to me ...i gave my money orders to the clerk who works for the owner of my building.. 2 days later they claimed it was lost then asked me would i get a replacement money order from Western Union...i did

    BS!You're told hold back your rent,put it in an escrow account-first off in order to put it in an escrow account both you & the landlord need to sign!So,ok,you have notified your landlord several times in many forms about the repairs to no avail!You send him a formal certified(even notorized)letter listing the repairs & stating you will be holding back your rent until the repairs are done!From here two things can happen-#1 the repairs get done but later the landlord evicts you or #2 the landlord just out & out takes you to court & evicts you!I know!I will never exercise my rights as a tenant because it's a waste of time & effort!

      My experience is that LL has bills to pay too. A LL cannot pay bills with the promise of some future payment from a tenant. Unless this is some long-time tenant that has has a spotless record until just now, then you need to take legal action. This is your business.

    It is fine I needed some advise about the situation. The apartment was so roach infested the spray guys hated to come in. It was that way when I moved in 2013 in april. No matter how much they spray it wouldn't get rid of them. I wanted to move a long time before they threatened to take me court. The old carpet was thread bare.
    Anyway I am glad it is over with. Maybe the ones that move in won't let him get by that easy. 🤔

      I have the same problem this place has roaches when I moved in I mentioned to the maintenance man few days after moving in he acted like it was my problem. Now I've tried and after 3 yrs it's just unreal the infestation not to mention it's a mobile home and there were issues I didn't see moving in. It's like a lemon car looks good till u drive it but by then I have already moved in giving them all my money. No she's being spiteful towards me and I'd like to move but I need time to come up w a deposit towards a new place what I'm wondering is how long I'd have to do that during the eviction process I read it could take a few mths to get a court ordered eviction?

      @@aprilencinias9361 I have the same problem in place I moved to from the other. The landlord thinks he can come in and evict me on the spot. He even gave me a note. I told him in 2018 it wasn't my fault. He said don't give me that!.
      I had lost my debit card and was waiting for a new one, the guy I talked didn't process it and waited 2 weeks. So I called again and got in 2 days. I went to the housing place where process the eviction notices and she told me they can't evict you on the spot. They have to go through a court process.
      This was in the middle of March and you have so many days to pay your rent before late charges.
      The lady at the court house said if tries to do anything tell him to talk to me.
      Well he didn't try anything. Now this has been on for 4 years. So the late charges are paid off , and he hasn't said anything since. I got tired of being hassled. They have to give you 30 days to pay your rent or move even if you go to court.

      I don't owe her rent paid in full they popped an inspection on me out of no where 1st time in 3 yrs they are ok w me if I get everything perfectly spotless I had been sick and fell behind so I've been catching it up but the repairs are not my fault and during pandemic nobody was going into anyone's house at that time and the last maintenance guy is tell him something was wrong and did nothing so now I get a letter saying because I didn't pass the 1st inspection there will be another on 30th ok I'm fine with that funny thing 1st inspection on the 9th the maintenance guys has known my kitchen sink and toilet leak has not mentioned repairing at all it's been 15 days and her other thing my bf who's here allot she wants me to pay for app fee to do a app for him to be here on lease when I told her he comes over Alot but lives down the street and if he gets approved my rent can be increased what I rent a 3 bedroom for me and my son 2 people how is it she can increase my rent I don't even have a family big enough for a 3 bedroom and says because I didn't pass 1st inspection she's decided I can't have my car here but pets are allowed up to two like she's retaliation honestly . So idk what to say to her I don't want him on my lease and don't want to give up my emotional support animal I've had 17 yrs I don't have money for a new deposit to move right now. And I gotta tell her something soon if I let her evict me I'm wonder how long I have before we have to get out if it's enough time for me to save for a deposit

      @@aprilencinias9361 they are just trying to put pressure on you to leave. It is stupid they won't let you have your car. It shouldn't have anything to do with an insepection. My landlord doesn't want to fix anything thing here.
      He finally fixed the parking lot , it was full of pot holes. It has been this way 5 years or more probably. You need to go to the hid housing place where process the eviction notices and see what rules are at that place and see if can have your car there. They should have parking lot.
      I think my landlord has been reported because they said they knew about him.

    I was helped from legal aid but there was no help in my case really because my case was not a quick case it was and is a long court caseIts not for non payment of rent its a retaliatory case that they say I have a dirty filthy apartment and dident fix it so a no compliance to fix rent violation its so not true but anyway legal aid couldent take the case and no pro bono or legal college etc will either because it is not a expedited case. it really saddens me because I'm on ssi and am getting evicted for other then non payment of rent I cant get help I don't know what else to do I'm i low income section 8 andsection 236 and section 101 subsadised housing and after 4 yrs of uninhabital conditions I reported them and am getting evicted for made up reasons 3weeks after reporting and no help sad I have court jan 10 and need help at least prayers

      I am having the same problem. i have no way of moving my things to different place and I am having problem keeping my place clean to like it should be. I don't drive. He has given me 30 days to vacate or take to court. I just turned 65 years old last month. They don't care how disabled you are.

      This could VERY well be determined as a retaliatory eviction. Call your state's department of human rights and file a complaint. There is a deadline though, in my state the deadline to file is one year. I wish you the best! I am I the same boat as well!! 😢

Landlords get away with the stinkiest crap, it's time to offer the people some common sense approaches to protecting themselves. Suing in court is a definite must. Filing a police report is a definite must. The problem that most people are saying, is that only landlords seem to have access to attorneys. They can sue on their own but they must have their P's and Q's in order. There has to be an attorney somewhere who will take these cases who doesn't care about money. But... Thanks about 1 out of 10,000 attorneys who don't care about money.

      Lisa Cameron Definitely going into prayer for you as of now. Legal aid is a lazy bunch, they only like to help you get your birth certificate and things like that. Nothing that requires real confrontation. I'm too old but I should have gotten my law degree years ago and started helping people like you. God is aware of the this, you should file a police report and sue in court, and start a GoFundMe page to get awareness, as well as TH-cam videos on your TH-cam channel here. Call code compliance to inspect what it is that the apartment management says is your evictable offense. Lawyers won't take your case, they side with landlords. Judges side with landlords. Go Pro Se, represent yourself and sue then fir retaliation and damages. It might keep you off the street. If not, it should put you back in a place quickly. If you're on section 8 or the like, winning your lawsuit will reinstate your section 8, but go somewhere else to live. Best wishes. Prayers your way.

    Hello i just received a 3 day pay or quit notice .. which is oddly expected i guess.. i rent with my little brother and my boyfriend, i work part time online, and they're away at alaska for 3 months ..they left in June on the 6th, our rent is 999 even.. we're behind only 335 left of that for june and we were planning on paying July and the rest of june on the 7th (of july) i think its just a communication problem as of ..i thought my brother emailed him, liked they discussed before he left but my brother didn't contact him, and my number changed as of the 15th of june. .YES I FORGOT TO TELL MY LANDORD THIS. .so now hesnthinking we're on BS he's exact words but in fact we're are not..and we're only behind for june 335 [+] late fees 30.00 and were not considerednlate until the 3rd of July!! What do i do ??

      Not an attorney but I can suggest you pay in full, and fast. Borrow from friends, family, neighbors, your church, community charities... anything.
      You may know your reasons for not paying are real, but real or made-up they add up to the same thing- your rent isn't paid.
      The LL has bills too and he can't pay his bills with your promises.

      This was years ago, but thanks. The landlord was arrested later that year after we moved out . But before we moved he sent over random ppl he met through CL to collect monies that was already sent to his account. He was arrested for wire transfer fraud or something 🤷🏾‍♀️ he was a slumlord and schmuck ❤

    Only thing is that legal aid doesn't help not on your side your voice isn't heard and your rights are never told you you and everything that happens isn't in your favor.keep in mind that all judges and lawyers are property owners and they aren't going to do anything that doesn't benifit you.

    I've been to legal aide where I live & they offer a number of the lawyer. The lawyer told me he didn't help people with my case.

      Typical! That's all I've ever heard from my local legal aid in the 5+ years I've contacted them for various reasons! They never seem to be able to help. The attorney there I spoke with even gave me wrong info! Legal and has been a joke in my case. I've received more help from Google and researching on my own!! Sad state of affairs everywhere it seems. 😢

    A note to all Tenants to you do have rights as a tenant.
    To note that landlord's does enforce a lease agreement with the tenant.
    If the tenant knows that they are struggling and unable to afford the rent let the landlord know before hand.
    It's not the landlord's responsibility to take care of non-paying tenants and for some reason the law is implemented otherwise.
    Remember if this is being done on multiple occasions where tenants make excuses for not paying rent landlords will oversee tenants taking advantage of their kindness.
    The contract agreement will be breached if the tenant fails to pay the requested amount as discussed with their landlord.
    Whether the tenant's gets a lawyer or not they are still liable for paying unpaid rent.
    The reason for the notice to the tenant ,the landlord's know it's going to be a hassle everytime he\she logs a court order to get their money.
    That he or her may not receive.
    Landlords has bills to pay as well what is also questionable to this lawyers statements made.
    Who is responsible for paying the tenant's out the government?
    And if the tenant does qualify grant from the courtroom will they pay the backlog they owe or will it be paid by the Grant holder?
    In cases of a Grant ,if the tenant has a previous case with a bad credit rating with the credit bureau the tenant won't qualify for a grant ,resulting in the tenant be given notice(On the breach date of the contract.),that they should vacate the premises effective immediately as they are staying on a property they can no longer can afford
    The landlord is thinking long term if the tenant stays longer their rent will get them more into debt with the landlord which he\she is trying to prevent the debt amount from increasing.
    As for another note pointed out in this video ,is that they can report the condition of the property long term tenants can deliberately mess up a place by not cleaning,opening up windows,sweeping.
    Final note if the premises is broken terrible condition,facilities,infested with rodents ,why does the tenant stay on premises knowing that it's bad, here is the answer.
    THEY DONT WANT TO PAY RENT.
    Long story short the tenant is still liable for paying any outstanding rent as per their agreement with their landlord.
    And to note that a the tenant will need to contact and pay their lawyer making them in debt to the landlord and their lawyer.
    So they don't have much options as they decided not to vacate premises when they were given notice.

      28 days to answer the complaint from the date you are 'LEGALLY" served with "process". Many courts in Ohio are illegally (not following court rules) sending notice via regular mail to serve the process.

      File all documents and proven with you statement of violations and file form 95 damage claim injury for breach of contract

      Put a lien on their property and make them pay the judge can't remove your lien nor can owner unless he pays

    Legal Aid dragged their feet on getting me a lawyer and left me at the mercy of a highly abusive landlord the sheriffs that she incited against me. I'm still waiting for that lawyer...!

    It's so much easier to just let yourself be evicted. Unless you're sure you're being unlawfully evicted or you've definitely payed the correct rent, you're just better off moving out.

      An "eviction" shows up on your record. You don't want that.

      I know I won't rent to anyone with an eviction on their record, and it shows on credit report too, that can make it difficult sometimes, for loans in the future.
      Always better to comply with lease terms or NEGOTIATE an early release so both parties can move on easily.

    Why somebody wants to stay in a place where they are not welcome anymore?.. that's unfair for landlords. Is their home. They have rights to be happy in their own home.. this people should just go find another place..

      Hello, is it fair when a young kid who gets a government grant to buy a house that tenants have been living in for 12.5 years, turns around and tells them the day that the house sale closes that they have 30 days to move out? And, he still wants the rent for the next month? Yet, while they were waiting for the loan approval, he and the seller's broker told these tenants that they were going to be able to stay; that they wanted to keep the tenants and make money . And the broker even told them that they didn't need to look elsewhere, but they did anyway, for months, and could not find anything. How about the 12+ year tenants who pay their rent on time every single month? How about their shelter and safety? They cannot get an apartment because all of the rents are literally a thousand dollars (and higher) more than they're paying now. Do they have rights? They've never ruined the property, they've paid their rent every month, they work 12-14 hours a day and have had the same job for 25 years. Is it okay for a coward like this to do such things and leave honest, hard working, 12.5 year tenants essentially on the street because he has delusions of being some high rolling house flipper? Nah, I think not.

      @@Nina0116SJR usually a house won't sell in one month. Usually they told with 3 months ahead. . Still they have to look for a place. Is a fair the owners has to sell and can't because somebody don't want to move. What if the owner has a family emergency and need to sell the house.?. What if the tenants been rude and cold and don't want to move out and when told are even more unrespectful. Is that ok?. The tenans.never have family or friends who can help them or go to but before they have many friends . Weird. .

    These landlord act like victims when they are making out with so much more the raised rents 20% property value went up they are definitely getting there money back and some plus 20,000$ government grant they don't pay back PPP loans they don't pay back it's kick backs stimulus kick backs ,stop your crying and accept your mistakes you should of bn humble about this and done the right thing .

    Our landlord has not given us any written notice. He threatened me over the phone because we said we want a notice of remedy. We have the 750$ rent money. But if we pay that (6 days late) then we won't be able to relocate and maintain. This place has black mold, it had a gas leak after I had our newborn son and he told me I SHOULDN'T HAVE CALLED THE GAS COMPANY! WTF! I'm sure we're not the only family he's renting out unhabitable properties too. We've been quiet about the issues, but now he's threatening eviction. I said go ahead. A hotel room and storage unit will be cheaper now.

      You can expect whatever you want but that's not going to happen unless you have a very nice landlord or you qualify under the moratorium when it's in effect.
