Merriam-Webster states the "First Known Use of smiley Adjective 1848" Franklin Loufrani in 1972 "legally" trademarked "smiley." Today if one uses the TAG "smiley" on an online marketplace, The Smiley Company LLC. may do a DMCA takedown for the product. Even if the product has NO ubiquitous yellow "smiley" face on it -- they did a takedown on one of my products.

I'm trying to figure out the origin of the headshot smiley, the one with a bullet hole in the forehead with blood dripping down the center. People often think this is from the Watchmen. However the "comedian's badge" is a smiley with his blood on it. The blood is at and angle and it does not come from a bullet hole. A t-shirt with the headshot smiley is seen in the 1994 System Shock, but I'm pretty sure I've seen people wearing similar shirts earlier. It's possible it was inspired by the watchmen (1986) but it is not the same symbol. I'd really like to know in what context this specific design was first used.
