The law in Australia is that you can get in the water within 100m, once you’re in the encounter is on the whales terms, they decide how close to come to you. Chasing them down is not what happened here, yes we were looking for them (hence the experience) but you can’t chase a whale down by swimming, once you’re in the water the whale can easily swim away if it does not wish to be near you. We were stationary once in the water and the whales hung around us for almost 30 minutes.
Well all I'm saying is it sure does look like the boat is actively driving at the whales and is less than 100m, which then you proceed to get in the water so seems like a violation of the whales' space and the law. I don't think the whale accidentally flipped the guy. They are very intelligent and know exactly where their bodies are in the water. The whale likely felt threatened and thus flipped their tail at the guide bcuz you guys were too close.

For many, we will never be able to experience this directly so you sharing this gives us the opportunity to experience it vicariously with you. I've been whale watching off the coast of Newfoundland twice. Once off the side of the Port aux Basques ferry, between NF and NS. And another time on the Belle Island ferry. I didn't know they were near Aus! I figured the water is too warm for them! WOW!
Please don't do this again, even though it was fun... but in the US: "Federal law requires vessels to remain 100 yards away from humpback whales in Hawaii and Alaska waters, 200 yards from killer whales in Washington State inland waters, and 500 yards away from North Atlantic right whales throughout U.S. waters." and turtles are protected too in Hawaii....
If we get the opportunity to swim with whales again we will definitely take it. It’s a rare opportunity and a beautiful experience. We have similar laws in Australia, the whales need to be 100m away before you enter the water, then if they come to you that’s okay, once you’re in the water the experience is completely up to the whales, they can dive down or swim away if they want to be near you. We didn’t jump on top of them, they came to us

They’re scientists and licking they got many views, close up like you but the water was crystal clear. It was so beautiful and she later told us to watch the whales eyes bc they’re really looking back at you. It blew me away. Thank you again. We couldn’t have more respect for whales and the ocean, it’s one of the reasons we wanted to swim with whales because we admire them so much! This was a 1 in a million encounter where we had no control over the situation and are just so glad that it was so gentle 🧡
Yes but you have to respect their space. And it doesn't look like you are you won't be happy until the whales are attacking your boat as the orcas are now doing

It was such an amazing experience! The whales were super curious and getting so close to us but not acting agitated at all. That whale got so close it touched the end of the rope we were all holding on to. Then it flicked its tail like we would flick a fly away and a him just happened to be above it 😅 total fluke and not aggression at all.
The guide had no idea the whale would try to come that close to us and honestly he handled the situation very calmly and professionally in our opinion… what we got was a crazy experience with an incredible memory, no one (whale or human) was hurt. Also it’s a humpback whale so not the biggest 😅
@MaxandJacqueline I did a swim with Aqua a couple of weeks ago and they were an awesome lot. Michael was a great guide and I also have Adam on my videos yelling "get in the boat" just like in your video. But for a different reason. Such an epic experience!!

It was an accident, I read the article and the divers were using a rope that the whale accidentally touched with its tail, so the whale instinctively flicked its tail and the guide happened to be at the perfect place.
When you do anything with wildlife you can't predict how the animal will act so yeah maybe there is some danger/risk but so is getting into your car and driving down the motorway. Luckily no one (human or whale) was hurt 🫶
