I'm overly curious. Could the land owner have possibly proceeded with his development without removing any trees? Could he have received a waiver that would allow him to remove some or all trees? What recourse does he have regarding the overall value of his property if he can't develop it as he wishes, are there funds that compensate him for essentially not using his property so he can watch trees grow? One would think at the very least he would be allowed to remove trees if he also re-planted some elsewhere. I am aware that perhaps this case was prosecuted because he took matters into his own hands and just chopped away, but I'd still like to know the answers to my questions, which would be relevant had he contacted the proper authorities prior to the development of his property.
