Truelly Ndegwa is interrogating the witness in ademeaning manner, professionally he should gv the witness chance to defend himself in adignified manner,not forcing the witness to gv him answers exactly the way he think he should .interrogate the guy in adignified manner, reasonably!!
Yes. But the witness has been giving long answers to waste time for the Lawyers. He is repeating questions and even what he and others had previously said. Kigen is supporting him to continue doing this and he knows time is limited. Misat did the same.

He has very limited time and the DG was trying to dance around the questions. I do not understand where the Senate was rushing to, yet it is of paramount importance that the process should be thorough and fair to both sides. That requires time and Senate was in a hurry that I can't understand.

COUNSEL NDENGWA NJIRU HIS METHOD OF HARRASING WITNESS IS VERY WRONG
He has no time for the DG's lies. But the primary mistake lies with the Senate giving very limited time to cross examination. The witness wants to explain when his answer should be "YES" or "NO". The explanation will be extracted from him through cross-examination by his lawyer, Katwa Kigen as Sen Sifuna correctly stated.
It's not wrong it's a psychology for lawyers to agitate you in that you give information

Ndegwa is within his rights as a cross-examining counsel to ask any question while using any tone of voice to push his point home. The DG could then clarify any "yes" or "no" answer during the closing re-examination by his own counsel. It is not Ndegwa's business to make the DG's life easy. That's a role for his own counsel.
That's how it runs. Examination by your counsel, followed cross-examination by the counsel(s) representing the other side and finally re-examination by your counsel to explain any points where you might not have come out with clarity. Stop commenting here with "jua kali" framework of mind.

You don't understand? It is the cross-examining counsel's right to demand to be answered in the manner he wants and in accordance with the question asked. After the cross-examination, the DG's counsel will be given time during re-examination on responses the DG had given and which he might wish to clarify. That's how it works. The cross-examining counsel has no business going soft on the DG.

And harassing him is the work of the cross-examining counsel. It takes place in three stages. The DG was led in his evidence by his counsel. It is called examination in chief. Then he gets to be cross examined by the counsel from the other side.vThats cross-examination and the purpose is to make him sweat and speak nothing but the truth. Then he is re-examined by his counsel to straighten any areas where he could have been shaken stiff by the other counsel. Hakunanga mchezo hapo.

A soft lawyer has no business appearing in court over litigation matters. The place for a soft lawyer could perhaps be in conveyancing.
How does a subjective question demand a Yes or No answer? If you ask me if I am rich , what do mean? I know I am not but there are people who see me as rich coz I have 10 pairs of shoes while they have 2 !
You answer, "yes" or "no", during cross-examination then your lawyer will be given to re-examine you to clarify any questions where your "yes" or "no" answer might not have been accurate or adequate. It is not this advocate's job to get the DG off the hook.

You don't know how judicial and quasi-judicial matters run. The cross-examining counsel had no business going soft on an elusive DG with a forked tongue. Simple "yes" or "no" should have sufficed. Then during re-examination by the DG's counsel, he would have had all the time and "soft questioning" by his counsel to clarify and explain matters to which a simple "yes" or "no" answer might not have been sufficient. Kila game iki na rules zake. Don't judge the players wrongly just because you don't understand the rules of the game.
