    He’s going to argue it wasn’t his crust or Contaminated place they got it from. Can’t they collect some of his “jail trash” and get a comparison sample?! 💡

      They probably got his toothbrush and no telling what else from his house but the only thing that cannot be argued against is an officially recorded swab.

      I’m not 100% sure if I’m right on this or not and don’t really know the terminology fully… but lets say they do go and get something from jail trash or whatever, for whatever reason it can’t be used as permissible evidence i think.. or something along those lines, or it’s not as CONCRETE and conclusive as if he provided an actual DNA sample, because it could be “tainted” etc… according to the defense. So they have to do it in a way where they leave no holes.

      That's fine. They don't need the pizza crust considering they tore apart all his houses. They have his DNA. The prosecution just prefers to have a cheek swab. They can literally use a thousand items in his many houses, if they really need his DNA.
      He doesn't want his DNA in the national database - probably because it'll pop out cold cases linked back to him lol He won't win the motion though. They'll ultimately get the cheek swab.

    Most states provide the requirement for a DNA sample upon being charged. NY State law requires a conviction for a DNA sample, unless you comply. Screwed up state law. However, you can charge Heuermann with illegal weapons charges, get a conviction before the murder trial starts, and then swab him.

      No one should willingly give up their DNA nor talk to investigaters., regardless of guilt or innocence. A suspect doesn't need to gain the trust of law enforcement. It is up to the prosecutor and police to obtain their own information without the suspect's help.

    This is very confusing to me because I had heard weeks ago that the DNA on the pizza crust was already matched to him. The Suffolk County Police Department waited for him to put his garbage out at home, they took the garbage and got the whole families DNA samples from water bottles, etc. which is how they were able to match the wife’s hair on the victim’s bodies. Now they’re asking for his DNA again? This makes no sense.

    They have houses and houses of his DNA to compare... Toothbrushes, combs, underwear, socks, beds, you name it, his DNA is all over the place. I'm not sure they need a cheek swab, but I'm sure they will get it eventually. But they already have his DNA far beyond a pizza crust today.

    When you won't let 'em get a DNA swab, as far as I'm concerned, it's damned near an admission of guilt. If you were innocent you'd be begging them to take a DNA swab.

    Is he out on bond, or still incarcerated? Should be no problem to get it from him in jail.

      He is in jail with no bond. New York law does not collect DNA on arrest, only on conviction, unless it’s voluntary or ordered by a judge. I say the judge will order it in this case.

      He's in jail, and will likely remain forever. But right now he's an innocent man. He gets to argue through his attorneys that the DNA warrant isn't appropriate - a Judge will weigh both sides and make a decision. We don't just hold down innocent people and jab them for blood just because he's in a cage and its easy... This is the US. If the Judge rules the DNA swab is OK, they will get him down to the medical wing and draw his blood. But they're not just going to hold him down today, just because he can easily be cornered.... Do you know why? Because that DNA would be grounds to reverse a conviction! You do it right. You do it legally. You let buddy make his argument... And you let a Judge decide. You want this guy out free on a technicality? I sure don't.

    New York law doesn't require DNA unless you are convicted of a felony. This law really hampers police and investigators trying to solve these kind of cases.

      In NY state, when you are found guilty, they then swab you. They don't allow swabs of merely accused people ( no matter how certain it seems) without consent.

      Simmer down. Humans have rights, even the ones we believe committed murders. Today, he's not any different than you, he's been accused of a crime. That's all today. So he has human rights. That includes not being jabbed and having his bodily fluids drained into a syringe. He's probably the killer - but he hasn't gone to trial. He has the same human rights as you would... If police showed up demanding your DNA, you'd be able to say no too. The courts will hear each side. And it's most likely they will get his DNA. But he has the right to argue his side... This country may be turning a little loco but it's still a democracy today. Today he gets to fight like an innocent man, because he is innocent today. One day he may get multiple life sentences, and be stripped of many rights. But that's not yet.
      It's good to remember that our feelings of anger and disgust don't supercede the constitution. There is a process and the courts are following it.
      For the record, I think he's guilty. But I firmly believe in his right to a fair trial, and that includes his ability to file motions and arguments in front of a Judge.

      Under American Jurisprudence prosecutors can't force you to witness against yourself...they can take samples from his personal items but can't compel him to provide it to them voluntarily...

    Interesting to hear Ted Bundy describe the burial sites that way: Fred West always said the ghosts of his victims came up into his body when he was showing the police the burial sites. It does seem to have a 'spiritual' angle for them. Maybe it's the last way they establish control.

    I think Rex's wife continues to see him and talk to him because she has financial entanglements with him. Am sure even his business has questions for him. Also I think she may be helping the police as they need help.

      Well I am starting to think maybe she knew of this other side- after soo many years- you can tell your significant other behavior change, or less time spent at home, trips, business, work, -if this man is a serial killer as I think he has been, I think she knew he was cheating, or on his computer,looking up other women. I think there are many more ppl attached to this-I think Rex’s wife had to know or recognize change & pattern .

      @sincerity6699 she would not have noticed, because he often committed these acts when she was abroad. She is from Iceland, and when she went to visit family, that is when he picked up these women. That was part of the reason they were able to link him to these crimes. I suspect that if she has gone to see him, and in the first few days he had refused visits from reporters, it is only because they have children in common, one of whom has special needs, and I believe she is divorcing him while she can still get something out of it financially, before the civil suits come and strip him of everything

      Not according to her lawyer. He said last night on NewsNation she hasn’t even been questioned. He also said he didn’t think the DA has any evidence in this case. Why would he say that?? What’s going on???

Maybe she is working w/ police to get him to admit, idk I def think - Rex digging in the yard all times at night or early am. It’s too much noise heard from a neighbor, so as the wife I Dnt understand- how she did not suspect or know - anything. I think it’s fishy

      unfortunately I don't think it's enough. It's like if someone claiming you're cheating on them because you won't show your phone. It's perfectly possible you might have nothing to hide, but you're so upset that there's a lack of trust in the relationship and you just don't want to show it in the moment. It's possible someone innocent could be so upset and refuse to the dna bc they know for themselves they're innocent. I'm not arguing it helps someone's case at all, nor am I siding with the alleged serial killer. I just wouldn't be quick to say someone is guilty bc they refused to do a swab.

    The defendant shall not be forced to provide the prosecutors with nothing that may incriminate the defendant and tha includes his DNA. Remember that he got arrested because of a DNA on the pizza scrap, but the problem with that is, that the investigators don't know if he was discarding that pizza box for someone else or if someone else had pizza from that box. If they have his DNA from the box of the pizza, why do they need his DNA again? They collected a lot of what they called evidence but so far, they don't even know how they die or where they die, and they found nothing in his house and more importantly they don't have a confession. he doesn't have to provide his DNA because he cannot be a witness against himself and if they take it while he is in custody without his permission, then is a violation of his constitutional rights.

    How did police get Asa Ellerup´s DNA? They said they found her hair on three of the bodies. They got Rex Heuermann´s DNA from a pizza crust, we know that. But how did they get hers?
