I am from Jammu and sir I want that article 35-A should be repealed... I am a permanent resident but the condition of non-permanent members who have came here after independence are not given right... just think their children’s are still not getting admissions in engineering colleges and medical colleges... this is an utter shame for us.. we say that India is independent... but these people are still living in pre independence era... no rights.. they are living a petty life..

35 A must not be revoked.If it goes against the IC then why they executed.Actually Indians wanted to control Kashmir first some how which led to accession by luring Hari Singh in their false and shallow promises.
Whatever it is written in Original Constitution of JK,We don't want it to be mutilated.
For what west refugees are kept in JK.That was a result of partition,they must be provided with land in Other states but not from Jk.Only those residents who are from POK can be settled in JK.Why Indian Govt Keeps west refugees in JK probably to change demograhy of Kashmir.IG tried to increase Hindu population here which will pave way for favourable plebiscite
Don't try to persuade JK constitute others from their own perspective and in their own interest.Do come out of colonial mind set.Do narrate it according to its real spirit.

1. Article 370 and 35A both are unconstitutional because if any law comes in force by presidential order it should be passed in parliament within 6 months. But no such bill or act implemented. Without implementation in parliament All the laws made by president are temporary.
2. Due to article 35A, Article 14, 15, 16, 19, 21 All the fundamental rights are getting abused as per non residents of Kashmir. So ofcourse, it is a discriminetory article.
3. With these articles and autonomus status, How much did Jammu and kashmir Progress in any prospects like employment, safety, Peace or economically too.
4. Apart from political agenda, No problem is there to be with single constitution.
5. Dilution of this unconstitutional article can be a beneficiary step not only for Kashmir but also for the betterment of India too as per trade and it would be able to boost indian economy.

My opinion on the topic goes like this :
1. Article 35A was not included in the constitution by special majority in Lok Sabha. SO it is against Article 368 of the constitution. Even though our Constitution is not the an ideal constitution, all the deliberations during the shaping of our constitution shows that it is one of the best one and it is a living document. So considering the importance of A368, Article 35A is unconstitutional.
2. Since Article 35A was made into effect on 1954 and then Article 370 came into existence and no changes were made in A 35A after Article 370 it states that Article 35A has to be reviewed now.
3. Also Since article 35A is against the fundamental philosophy of Indian Constitution, and restricts the fundamental rights enshrined in the constitution(Such as Article 16 equality of opportunity, Article 14- equality, Article 21- right to life and liberty)
it should be revisited.
4. It also puts blot on the Very first Article 1 (India shall be a Union of States) and giving is against Unity of the confederation. Article gave special status to so many States(A371) , and it is very much important to see that only one state should not be given Special powers and autonomy since India is a Union Of States. What if situation arises if all other states demand for special autonomy since each state in India is unique in Its own respect.(For example North Eastern states and recognized by UN as Biosphere reserve)
5. Also Article 35A is contradicting Article 300

My Views on 35A:-
1)It violates the fundamental rights.
2)It acts as a Bread and Butter for many Political parties who have literally massacred the Humanity.
3)India's Soverignity is also at Threat due to such unfair acts.
4)The present NDA government is atleast trying to wipe off such article from the Indian constitution.
5)Article 35A and 370 were Enacted By Jawaharlal Nehru and Sheikh Abdulla for their selfish motives. Infact the Creator of Indian constitution Dr. B. R. Ambedkar didn't wanted article 370 in the constitution as he feared that in long run it would be Threatful for Republic of India.
6)Article 35A should be totally wiped off as it is Constitutionally incorrect and imparts partiality.
7)With central government even more stronger this time,This is the Ideal time to Uproot the article 35A.
8)Jammu & Kashmir are integral parts of India and there shouldn't be the biased laws for any single state debarring the fundamental rights of other citizens of India so I think Article 35A and Article 370 should be rectified and ammended for the betterment of a country.

This is our right and no one can take away this article. If any attempt to abridge presidential order act 1954 is done by the govt then all the constitutional provisions which were extented to the state of j&k will also get abridged...!

buying of land by outsiders is not restricted to kashmir alone, even they aren't allowed to buy land in Arunachal, Himachal, Nagaland, Mizoram, megahalaya and Manipur (excluding hill) state and some restriction in tribal belt of central indian too
added to that to enter Arunachal, mizoram, nagaland you outsiders need ILP (registration) before entering the state
And as a ne indian i completely oppose buying of land by outsiders because by doing so they will reduce native indeginous people of state to minority like it happen in Tripura or happen to rest of indeginious people of world where now they posses threat to them culturally, socially, economically, politically and of course naturally

When people of Kashmir do not accept signing of 'Instrument of Accession' by Hindu Rajput Maharaja Hari Singh then ruler of Jammu and Kashmir, then why India is worshipping Article 370 and 35A for the last 70 years which is totally against the sovereignty, security and integrity of India? Abolish Article 370 and 35A without further delay and pump people of all caste and creed from all over India into Kashmir to change demography.

Historically, Kashmir has always been part of India. 'Srinagar' does this name any way sound Islamic. Anantnag? Vijeshwar Vihar, now renamed as Bijbihara. Same way the Kashmiri Pandits have been thrown out of their homes. So just by ethic and religious Genocide, you can not say that Kashmir was never part of India. It is, was and will remain an integral part of India.

But not have little bit knowledge regarding ...was Kashmir state of india before 1960...?...due to some problems and faults J&K join INDIA and becomes a best friend of india and now a good state. ...in Kashmir about 60% are indian fans and want india to be their nationality and 35A their backbone. ..if 35A will dismissed from Indian constitution then these 60% Kashmiris will also join to separatist leaders of Kashmir and india will lose 100% sovereignty from kashmir. ..

*but*
If it is so than we should have to rethink over the entire constitutions as there are many drawbacks in the constitution of the same kind.
For example
1. Special category states
2. Reservations for SC/ST
3. The constitution talks about eqaulity *but* it starts the concept of unequality saying SCs and STs and others. Why constitution itself discriminate in this case
4. some DPSPs are against FRs.
And so many things are there.
Should the whole constitution be rethink?

Definitely this article is discrimatory...if non-permanent people will not get benifites of gov job,cannot accure land in Jammu and Kashmir then Jammu and Kashmir people also should not get the benifites of main land India . They cannot enjoy double benefits.If they want equal benefits they should be equal to nonpermanent people.

First of all thanks for this very important information.
In my opinion article 35A should remove because of below reasons:
1. It violates the fundamental rights of Indian citizens (non J&k residents),which itself is unconstitutional.
2. No one can purchase or setup their own business other then J&K citizens, which leads to less competitive market and less development and less job creation, which eventually leads to terrorism activities.
3.this is very unfortunate for refugees who came India and not considered as J&K citizens, they can not even vote for the election and can not enjoy the rights,which has been given to J&K permanent citizens , which is creating unhealthy environment among themselves.
Jammu and Kashmir is an integral part of India. Being a citizen of Jammu and Kashmir, I encourage the government to revoke the article 35 A. Separatist elements will bark even in the comment section.

After seeing some comments in the comment section I genuinely felt that people have started to feel that these discriminatory rights given to them are their fundamental rights.

It can be taken as a lesson from the history that any such constitutional provisions or any such amendments are made inside the constitution should be amendable.
this article was is also made temporary but now because of political influences and political means they have become kind of permanent in nature.

It's not India who gave us art 370 and 35a .....but it is my Kashmir who give india powers on communication, defence and external affairs of kashmir.it is Kashmir who give power to India in Kashmir bcoz Kashmir was independent in 1947.
Thank you sir. My view is, we should not jump directly into this article for its removal. We should make a clear policy or provision to bring a political, social and economical stability to the region, which would come up if we remove Article 35A.
First of all, respected sir, thanks from the bottom of my heart... for this immensely useful information and throwing light on the hidden aspects of the issue...
secondly, coming to what should be done, in my view , there is only one solution for the big and bigger problems that the indispensable and beautiful Kashmir, along with all citizens of India is facing... we need to change the scenario of these kinda issues from political to those of national interest. Undoubtedly, the solution will come from the centre and some constitutional remedies, but keeping in view that when something is right for someone, may be wrong for another one... thus framing some rules that on one hand do not harm the permanent residents of Kashmir and on the other hand do not deny the residents of other States of the several fundamental rights explained. Fundamental rights are called so because the very basic rights for every citizen of this diverse country lay down equally and because of some political blunders in the past, the present cannot be allowed to burn lives, property, integrity and sovereignty of our INDIAN REPUBLIC. Due to the various concerns ..the constitutionality is decided by supreme Court but the immediate repealment of article is spread the communalism and riots in j&k ...so target state subject should be placed in concurrent list and effective judicial scrutiny is conduct..

Thank you for explaining everything in detail. I believe that Article 35A should be repealed as it is discriminatory. Also, it won't help the people of Kashmir and Rest of India either. Going further, it would be better if Article 370 gets repealed too. Our biggest problem is about sovereignty and security which will be solved only if these articles are removed.
