    I'm currently experiencing an issue with the HOA management company. They seem to have their own agenda and may not necessarily represent the HOA itself. When you refer to the HOA, I'm unsure if you are talking about the HOA board or the HOA management company, as these two entities are very different in my situation. I am a member of the board and I don't necessarily agree with the way the management company interacts with our homeowners. Unfortunately, it's not easy to replace the HOA management company. I wish it was. I feel like they are abusing their power after we hired them.

      Many modern HOAs are not HOAs at all, especially in Texas. Developers like Lennar, DR Horton etc have a loophole in the law that allows them control over the HOA for potentially decades. Thats where you usually will have 'HOA' meetings with a rep from the development and it's not really a board. And yes, a lot of times they will farm the management of the HOA out to a management company

      That's their strategy. Get in cheap, stay and make as much money as possible. Meanwhile take control of the board and HOA. They also make it worse not better. Paying money to let a gestapo scare tactics board is bad enough, but twice worse when the owners members of the HOA are paying them to take advantage of the Benjamin's rolling into their bank accounts monthly. 😉🤔😲😳😱

    CAI (Community Association Institute) CONTROLS THE HOA’S THRU LOBBYING LEGISLATORS TO TAKE OUR PROPERTY RIGHTS. According to our plat, it states “HOA maintains perimeter walls”. The Plat has never been amended and HOA had made repairs previously until new board members decided that homeowners are responsible. In one year the HOA Attorney gave us three reasons where he assumed homeowners were responsible for the walls. Yes, he assumed because it wasn’t in writing. We took the HOA to court and that same attorney stated “That Plat is old and was made before the development was completed, therefore, not enforceable”. Then he stated “The subdivision doesn’t have perimeter walls”.
    Judge ignored the legal recorded plat and agreed that we did not have perimeter walls. Our subdivision has “Clusters of Townhomes which are surrounded by perimeter walls as indicated by the city, along with the approved Development agreement.
    CAI, MANAGEMENT COMPANIES (which are not regulated across the U.S.), HOA BOARDS, LAWYERS, LEGISLATORS, even the cities won’t enforce the ordinances that they required and approved on the development plans, if one lives in an HOA. AS YOU SEE ABOVE, EVEN THE COURTS ARE AGAINST HOMEOWNERS.
    THE HOA’S MAKES THE RULES so,that the only recourse for homeowners is to file suit which costs thousands if we lose. No other solutions are indicated purposely due to HOA knowing most homeowners won’t sue and the HOA will still do as they please! Such as charging the homeowners’ thousands of dollars for maintaining perimeter walls which is clearly stated on the plat which was legally conveyed to us upon purchase by warranty deed.
    Their are a lot of coalition’s against HOA’s and sometimes they help in legislation but the CAI has lobbyists, which homeowners indirectly pay for thru assessments. Every management company pays for membership with the CAI or a few others. All homeowners coalitions across US should band together to make HOA’s regulated and laws to protect our property rights. If not, I would hate to see 10 years from now. They already can foreclose on your property when you reach only $1200 in assessments, fines, etc. One could live in a million dollar house that’s almost paid for and developed a terminal disease and the HOA’S would foreclosure no exceptions. I’ve seen it happen. Just research and you’ll find.
    In our community, I have proof that the HOA foreclosed on a home that valued around $325,000 and the HOA bought it back at a sheriff’s sale for $25,743. Supposedly the only bidder, which would have never happened in Phoenix, because we have so many investors. Recorded documents show it was conveyed to a someone without mention of even $10.00. The passed president signed the conveyance .
    I’M SO IRRITATED THAT NO ONE SUPPORTS HOMEOWNERS AND HOA’S CONTINUE TO DO AS THEY PLEASE.

      No real laws to protect homeowners members of any HOA COA POA etc... in USA. CAI is a lobbyist and has been for many decades. CAI started in 1960's to protect owners back then, but then flipped to protect HOA COA POA boards, lawyers, property managements. They lobby to continue to strip HOA COA owners of their rights, money and homes/property. Sell and get out and don't buy in any HOA COA POA etc... communities.

    My on a HOA Board, of only four people. All the meeting are closed. The homeowners have consistently requested the Open Meetings. How can we force the Board to have open meetings? The Homeowners are only invited to an annual meeting.

    My HOA Board sent me a slanderous letter (with NO prior discussion), when I challenged the accusations in their letter, they could not explain what they interpreted as the nasty comments they made. While they apologized about their false statements when I met with them at a board meeting, they would not retract their statements and in fact embellished and exaggerated actual events further. I would like legal advise.

      That's done all the time by boards and property managements all over USA. Nothing new here. Anything to take your money, property and anything else they can. Good luck all. That ain't stopping. Sell and get out of the Gestapo's grip on you and your property.

    We joined an HOA to protect the aesthetics of our neighborhood, our HOA have let the rules slacken, so our area looks a real mess, so our house prices arent protected

      They are not protected when you have HOA in a first place. It is a replant - people see house is listed in HOA and they run away in other direction. HOA made a name for themselves over the years....as abusers, cheaters and extortion racket. I am looking for a house now and when I see HOA I skip the house all together.

      Yes. File a fair housing complaint against disability discrimination

      @@laurarenfro5136 In my experience of filing disability discrimination complaints, HUD passess the complaint to a state workforce commission that are worthless to solve disability discrimination, all they do is sit back in their cubicles stuffing their faces & play on facebook.

    My HOA are the admins for the community FaceBook page. Everything posted among the neighbores they jump in and get involved. I recently asked about the increased on year after year of fees and they quickly jumped in to respond stating l attacked. I dont believe l crossed the respect line. I want to know how other neighbors feel about the increase ..what is the law on this

    Easier to ask the HOA before hand, providing they know the rules, which ours dont, yet they have fines in place in case you put a foot wrong, if you see a violation and report it, they do nothing, what can we do about that? I was told by our management company when I asked why a rule wasnt being enforced, that she wouldnt entertain my games and our President of the association told me to F**k off and never approach him again.
