Cadw is the Welsh Government’s historic environment service responsible for the designation of heritage assets such as scheduled monuments, listed buildings and protected wrecks, and associated casework concerning consent, grants, and heritage crime. As part of the civil service, Cadw does not possess any powers to investigate or prosecute heritage crime offences. We are dependent on the police to investigate cases and The Crown Prosecution Service to bring prosecutions to court.
This presentation will provide an overview of Cadw’s role and activities regarding the prevention, investigation, enforcement, and prosecution of heritage crime offences in Wales, and will summarise the findings from two recent court cases relating to scheduled monuments. The importance of presenting reports and impact statements in which archaeological concepts and vocabulary can be understood by a lay audience of police officers, prosecutors, and judge and jury will be emphasised.
