Hi Jon - your own food wrappers are not commercial waste. She needs your permission to film inside your premises otherwise any ‘evidence’ gained is inadmissible. I would have told her she didn’t have permission to film inside your premises and to make an appointment to speak with you at a future date. Then told her to do one. Anyway - I would appeal the fixed penalty on the grounds that you don’t produce any commercial waste at all. Get rid of the bin bag - which I am sure you only use as packing material- Job done. You should be getting an award for innovation within the circular economy with 0% and even less than 0% waste production. All the best to you from me and ‘er indoors 👍

@@BrumReseller ok buddy - even if you have paid the penalty you can still appeal it as the usual advice is to pay the penalty then appeal it - this puts you in a better position. I trust that you were cautioned by her before being asked to make any comment - considering she knew when she entered your premises that it was her intention to enforce some statutory ‘instrument’? You can get 20 mins free with a solicitor- this is usually enough to obtain an opinion. All the best 👍

I used to own a coffee shop, on opening week we popped a couple of small corrugated plastic signs up on the lamp posts in the street to show we were now open. Yeah, I got fined £50 a sign. Mint that was. As you said, there is no manual to opening and running a business. We live and learn as we go.

We have a BID scheme too that I’m forced to pay for which came sniffing around for my waste license (BiD schemes are run by other businesses so its neighbour against neighbour on behalf of the council for money in those businesses pockets that sell their souls) I already pay for a toxic waste license,which they accepted at first but then came back for a separate one for my sandwich wrappers! It’s hard running any high street business,the councils would rather we all just gave up! My mate in the barber shop just got a fine from the PPLPRS for playing music on his phone speaker and not using his headphones for £2000 if it helps you feel better…

I run record fairs and did markets for 40 or more years and got accused of polluting the country with plastic till I pointed out that I've been recycling plastic for 45 years. I don't understand why you need a waste licence when you pay rates, could never work that one out.

All you require is a Waste Transfer Note from a waste company. Non payment of the Fixed Penalty should make the Council generate a report to the Court for consideration of prosecution. I cant see that happening the courts are swamped with far more serious offences.
I thought you only needed a licence if you were carrying waste... and a lot of it, not a few cartons. These people love the feeling of authority they get from doing these jobs.
What sort of waste licence are the council expecting you to have? If it is registration as a Waste Carrier / Broker/ Dealer with the Environment Agency, then you only need a FREE Lower Tier registration if it is your own commercial waste (unless it is construction/ demolition waste, which I doubt yours is). A Fixed Penalty Notice seems really harsh, especially as they haven't given advice and guidance first. Also, they should have shown a warrant card and provided you with a notice of their powers and your rights (under Code B of the Police & Criminal Evidence Act), and they should have told you up front that they were recording with a body worn video. It all seems like very sloppy practice taking advantage of you ignorance (with all due respect). Perhaps consider appealing it.
Seems like the lower tier waste license might of been an option but it would still require me to dispose of the waste myself like taking it to the tip or something along them lines and they charge £50. Will be interesting to see if they will actually go ahead and fine me i done exactly what they asked within the timeframe. But your right the way it was handled seems like i would have a case anyway which would all the evidence would be on her bodycam.
You could have had the free one and not needed to proceed further you literally grassed yourself up you could have Said you empy others to dispose of your waste however you've not built up enough to warrant a quote However as it stands legally they are in the right

Also I would say any personal waste is used in packaging items for protection 😂

I was thinking about putting a sign out into grass saying record store this way but I may need to look into it as I could see the same happening

I got the waste transfer notice and uploaded it. The uploading of the doc seemed to be also an appeals process fingers crossed i avoid it
