    That cop just couldn't accept that he was wrong, but still arrested him anyway after making this guy perform like a circus animal. Every other country uses a scientific portable breathalyser to determine alcohol impairment, yet America still persists in this foolishness. They insisted on a blood draw hoping to find some kind of drug in his system

      we do too, we just have to be arrested before they give you one. They offer it, but you have to literally be arrested to get one and at that point, why do it? Just put them in jail.

    But as usual they just lied when they couldn't find their drop stash.
    These are the people determining our freedom, and they are absolved after conspiring then imprisoning innocent people.
    All law enforcement has is excuses. It's not hard to understand this criminality is encouraged.

      The problem is the ambiguous nature of the word 'drink'. To you and me and of course the rest of the world that could mean water, milk, soda or any beverage. To a cop who is looking for an excuse to do what we just seen here. Drink means entirely alcohol. Say no and they say you are lying. Say yes and you've just incriminated yourself. Best and only answer to any and all questions is, "I invoke my 5th amendment right to remain silent, and my 6th amendment not to be asked questions without the benefit of a lawyer."

      The only problem with that is: If you refuse to do the field sobriety tests, they will arrest you anyway - they assume that if you refuse, you must be guilty. Also, have you ever seen any example of these tests being conducted, where the officer comes to the conclusion that the "suspect" is not drunk / intoxicated / impaired after the testing is complete? I know I haven't, even after watching literally hundreds of videos like this.
      Basically, if they ask you to undergo field sobriety tests, they have already decided that you are under the influence. It doesn't matter how well you perform the tests, it makes zero difference to the outcome. I have even seen several examples where people have performed the tests perfectly (or near enough), the officer decides to arrest them, and then they protest by asking how they failed the tests or which part of the test they failed - and then the officer claims "it's not pass or fail", and/or "that's not the way it works". This video was even one of those examples.
      So the field sobriety tests are "not pass or fail" according to the same police officers who administer them. Which tests to do and how many tests to do is decided arbitrarily. The outcome of the testing (when carried out by police) is always the same - suspect is deemed to be drunk, even in cases where they demonstrably had no alcohol at all in their system, and no other drugs either. Which is hardly surprising when the tests give a false positive of being under the influence in at least 30% of stone cold sober people tested the same way. So they are not even close to accurate, which is probably why courts don't accept the "evidence" generated by the tests.
      All of which means they are completely pointless. Especially when police have breathalysers on hand anyway (either portable units in their cars, or mains powered units at the police stations. As such, the only real purpose of field sobriety testing is to waste the time of everyone involved, as well as aggravating any "suspects" who agree to participate.

      He gets a prize for DUI arrests, they don’t have to be
      Legitimate arrests.
      Call his BLUFF! MAKE HIM ARREST YOU WITH NO PROBABLE CAUSE!
      And demand he take you to a HOSPITAL for blood test.
      I’ve read of people who wait for MONTHS for government tests to come back.
      You can lose your job, and be evicted from an apartment before a government test comes back!

    To me this is scary , I can never pass one of those sobriety test. I don’t drink alcohol at all and o never done drugs . But being autistic with adhd , my brain don’t work that way . This would be a nightmare to prove . This police officer should be fired , and in a perfect world charged .

    Having some experience with the rehab system, i learned that those drug tests take however long the government wants them too. If they'll hurt you, or it doesn't really matter, then they'll be completed in a day or two. If it hurts the state though, then suddenly they take months or even years to complete.

      @ygrittesnow1701 I didn't copy and paste anything. People are reading what they want into it, not searching for the truth. The word "drugs" does not begin with an S, and the S is clearly audible. You and the other sheep will believe whatever you are told to believe, half a second of paying attention would have proven their assertion wrong... but even if that wasn't enough, you could have taken five minutes to enhance the audio if you were actually after the truth. If they wanted to search the car, all they had to do was tow it, then they could have done a vehicle inventory. They also had enough probable cause to search the immediate surroundings of the driver if they wanted since he was under arrest. This made up story about them just trying to get into the car to plant drugs is dangerously stupid. Especially when the only "evidence" is mishearing a word. If you had half an understanding of police procedures and standards for those procedures, you would have known that the police already had all the access they needed to plant something if they wanted to. The only thing they could not have forced was a PBT. But don't ever let the truth get in the way of a good story.

The officers had all the access they needed to the vehicle and stopped short of actually towing it which I'd bet their procedure said should have been done, which is another avenue to gain access to plant this stash of drugs during an inventory that you're so desperate to be real.       filed falsified reports. Even with witness’s affidavit.-
      All in vain, my license suspended for 3 years when I finally got it back. Suspension on my record that I can’t get insurance. DMV again, revoked my license w/o insurance. The evil deeds conspired by FCPD and DMV.

I honestly don’t know enough about the law to say. He should have something actionable with everything that is on tape. I hope he becomes a very wealthy man.

      Taya here! You make a good point that officers get credit for the arrest even if the arrest is a bad one or unjust one and does not result in a guilty verdict. So, there are everything from burglaries to murders that are considered "cleared by arrest." This means the arrest is considered a success for the officer even if the real guilty party is still loose!!! It is a system that needs serious reform!

      Thank you so much for watching! I thought it was important for people to see with their own eyes how flawlessly he performed those tests at 3 a.m. in 30-degree weather in Michigan. When I checked the weather for April 10th at 3 a.m., it was 34 degrees. It's incredible how calm he was while he was put through those tests. But if he had even said one word of profanity... it would have gone even worse. The officer even said later "as long as you stay respectful to us there is no problem but if you start saying I don't want to take this test and start a hassle..." The implication was he had to be an absolutely perfect human being. The injustice seems so obvious to everyone who watches... except, of course, for the Michigan Police Department..so far. we are still waiting for comment on this. Hopefully, some hire ups will decide to do something meaningful to prevent this from happening again -taya

    SMH. I feel so bad for this gentleman and his guest. This is like a movie. This is so horrible. He had to wait 5 months to get an edited version from the body camera. He still hasn’t received a letter saying he doesn’t have a criminal case on him. Was the cop jealous that this gentleman had a nice car or that he has a job that pays him well. Just sad.

    The way the cop asks if it has been at least 2 hours and the guy says yes because if you don't drink it has been at least 2 hours since you've had a drink, it's a correct answer. It's a setup question like "have your stopped beating your wife" that if answered yes or no you can assume that it's an admission of drinking. Cop then turns that misinterpretation into "changing his story." I've never done plenty of things and also haven't done those things in the past 2 hours.

    I can poke holes through any DUI FST medically. I can explain how the test is intended to make even sober people fail. Plus explain the lack of relevance that each test deals with the ability to drive.

    I know of a female bus driver who was falsely charged with a DUI . When she passed all the tests, they said she must have taken drugs. Long story short, she eventually had charges dropped, but meanwhile, she lost her license to drive for the bus company!

    If the main stream media gave a damn about the truth and what is happening with law enforcement in our country, They would focus on stories like this, The criminal acts of police is not only disheartening, It is actual crimes, These officers should each do at least 10 years in federal prison for this alone.
    The fact that one of the officer's got promoted, is completely disgusting, He should not be on the force at all, This should become a RICO case as it is organized crime.
    The fact that the DA Has not stepped up is telling, They are all in bed together, This must not stand, It is at least a fireable offense, And at most serious prison time... There is no excuse that would make any of this ok.

    BTW. DO NOT REFUSE THE FIELD SOBRIETY DANCE IN CANADA, that carries a automatic conviction with incarceration, in some provinces you do not even get the right to involve a lawyer, trial or appeal! Just up to a 5 year incarceration and lifetime ban from entering or flying over Canada (like flying to Europe/Asia)! C'est la vie!

    This is not the first time I have heard this "has it been atleast two hours since your last drink" and someone answers yes to that only for an officer to use that answer to say "it's been 2 or 3 (hours) or what?"
    Meaning you have now created PC by answering that question.
    Also they obviously learned to lie a bunch for their body camera to create a narrative that will match with their lie of a report.
