Admission and Discharge of Person with Mental Illness under Mental Healthcare Act 2017

  • The Mental Healthcare Act (MHCA) 2017 has come up with some major changes in the mental healthcare by introducing the concept of advance directives and nominated representatives and aims at strengthening the human rights of person with mental illness (PMI) and clearly emphasized the responsibility of the government. The objective of this article is to give a brief overview of the admission and discharge of patients under MHCA, 2017.
    Any person, who is incapable to make mental health care and treatment decisions independently and needs very high support in the mental health establishment. Admission and treatment of persons with mental illness with high support needs in mental health establishment up to thirty days (supported admission under sec 89) and beyond thirty days (supported admission under sec 90) under Mental Healthcare Act, 2017. The medical officer or mental health professional in charge of a mental health establishment shall admit every such person to the establishment, upon application by the nominated representative of the person, under sec 89 and 90.
    The person has been independently examined on the day of admission or in the preceding seven days, by one psychiatrist and the other being a mental health professional (under sec 89). Two psychiatrist need to examine independently examined on the day of admission or in the preceding seven days (under sec 90).
    Mental Healthcare Act 2017 mandates that proper discharge planning should be done and documented before any discharge is done from MHEs. Discharge planning should be based on a thorough assessment of the needs of the patient. Family should be actively involved in the planning process. Necessary steps should be taken for referral to other services, especially those in the community. Discharge planning helps us to balance the goals of the treatment at admission, to reality check at the time of discharge.

    Sir, can a scizophrenic patient be forcibly dicharged from a mental hospital without the signature of his representative person?

      MHCA 2017-If patient has mental capacity, he/she will decide

      @@SureshBadaMath he was admitted through court order of acgm. He was not voluntary admission. Can he be self discharged?

    Sir, in the case of an independent admission, is it required to give a certificate for admission or just allowed to admit and sign is sufficient on the patients application!?

      No need of any certificate
      But
      There is a need to assess capacity and sign the capacity assessment certificate
      Signing for admission order is as per the hospital administration policy

    Dear sir, my brother is an schizophrenic as well he has a epilepsy. He is very unpredictable, aggressive, self harming as well as harm to my family. My family is living under constant fear and life threat.
    Any suggestions please sir?

      Please do consult a nearest psychiatrist. Approach District Legal Services Authority (Situated in District Court) for help with all treatment details (slips) with your parents and meet the Member Secretary of the legal service authority. Request the legal services authority to help you in admission and treatment of your brother at the nearest hospital

      There is no such provision. Admission can be only under sec 86, 89 and 90. However, sec 94 is for emergency ‘treatment’ only. You need to choose one of these sections wisely for observation

      Please read Sec 89 and Sec 94 of the MHCA 2017. It is not the diagnosis, which determines the admission, but severity of the illness, loss of capacity and NR’s consent determines. Sometimes, it is difficult to decode. Issues will be interpreted based on the symptoms during the time of admission. Please do talk or take opinion or discuss with a psychiatrist (in person). Please do talk to your family members.
      If you are not happy with the answers or response, you can also approach Mental Health Review Board of your jurisdiction. If not formed you can directly approach High Court for justice

      @@SureshBadaMath I'm also advocate 2year ago this happens sir doc say forcefully admit on that time can I call police or told that iwill be fine ready for examination from any government psyctrist and psycologist if they forcefully do that than they take my phone i had anger issue 1year ago but in that section if person recently harmed someone or self harm than they can but this even not happen my issue resolved by doc medicine etizolam so on that time what should I have done if that doc convince my family

    Sir, How about fee or charges in NIMHANS for admit a psychiatric patient. Your reply will helpful for us to further proceed as my brother is facing challenge as you mentioned in video inability to care him self he left family sleeping in road side.His childrens are very upset & they don't no what to do further.
