    Thanks for your video. Would I be right to say that traditional procurement is best for the refurbishment of a grade 2 listed building? (since it's a government funded project thus theres need to have more accountability for value of money etc) and which form of contract would you assume to be more advisable? Jct? Or nec? I might be wrong but I think nec is used more by government bodies.

      It would completely depend on the contractor. Take a look at our procurement routes and see which is best suited. You are correct however, government do seem to prefer NEC contracts.

More collaborations showing how the construction industry differs in different countries would be great. Also sustainable building alternatives.     May I ask, what is the contractors responsibility for delay of materials under JCT SBC AQ?

      Under JCT SBC AQ (Standard Building Contract with Contractor's Design), the contractor is responsible for ensuring that the materials are delivered to site on time. If the contractor experiences a delay in the delivery of materials, they are required to take reasonable steps to avoid or mitigate any delay. If the delay is caused by a fault of the contractor, they may be liable for any resulting loss or damage.

    Is there any clause covering Latent defects in JCT? My same old question of whether contractor is responsible for rectifying Latent Defects after expiry of Defects Liability Period in JCT?

    what are global claims and how to identify them in a contract dispute between client and contractor? i have an assignement in which there is a conflict between consultant and contractor because of delays caused by client and also contractor lost machinery and workforce. i need to put a claim demonstrating an entitlement from contractor perspective focusing on concurrency and global claims.

      In the context of construction contracts, a global claim refers to a claim for damages that arise from several events or causes, rather than from a single, specific event. Global claims often arise when the contractor suffers delays or disruptions that result from a combination of factors, rather than from a single, identifiable cause.
      To identify a global claim in a contract dispute between a client and contractor, you will need to review the contract and any relevant project documents to determine the specific events or causes that have led to the delay or disruption in question. You will also need to assess the impact of each event or cause on the contractor's ability to perform its obligations under the contract.
      In your specific case, where there is a conflict between the consultant and contractor due to delays caused by the client, and the contractor has also lost machinery and workforce, a global claim may be appropriate if the delays and losses were caused by a combination of factors that were beyond the contractor's control.
      To put forward a claim demonstrating an entitlement from the contractor's perspective, you will need to provide a detailed analysis of the delays and losses suffered by the contractor, including the causes of each delay and loss, and the impact of each on the contractor's performance. You should also explain how the delays and losses were interconnected and how they contributed to the overall disruption of the project.
      In particular, you should focus on demonstrating how the delays and losses resulted in concurrency, or the overlapping of activities that would otherwise have been performed sequentially. This can have a compounding effect on the delays and losses suffered by the contractor, and can be a key factor in establishing a global claim.
      Overall, to succeed with a global claim, you will need to present a clear and compelling argument that the delays and losses suffered by the contractor were not the result of its own actions, but rather were caused by a combination of factors that were beyond its control.
