My unsolicited advice: Don’t talk to property managers EVER. Everything discussed, do it via email. You will never regret it. Refuse to answer phone calls, everything goes through text or email messages. I do this with any property management and recently won $13k in a lawsuit with them and it was easy because I had everything in writing.

@@thriftyminiaExactly! At the the very least, follow up the conversation with an email detailing everything that was discussed and agreed to. If they don't dispute it, then it counts as an agreement or "contract" (in my judge Judy voice) 😂

Yeah, my first gut reaction is F that landlord and F that store. Go back to the old days, selling from your home. My son taught me something - EVERY entity, landlords, banks, insurance, Uncle Sam, etc etc. - is out to make money off of you. The DO NOT CARE about you.

I used to watch you all the time and you were happy working from the basement. I was upset when you opened the bin store and knew it would be hard. Dealing with all those people, employees, landlords etc. Don’t let them take your sparkle away from you. It is NEVER a failure in anything we do and you can always take a step back. Remember what you used to love and go back to that. I wish you the best. Take good care of yourself ! You look so tired. Sometimes we just have to pick our battles and walk away to save our soul!

Do yourself a favor. Get out of that building. That landlord will continue to cause problems with your business. Even if you have to liquidate and start out of your basement again, you will be better off in the long run. You could always try a store again when the time is right, just not with that landlord.

Absolutely not to disparage anything you have been going through. However it does make me realize my eBay business struggles are not that bad in the grand scheme of things in comparison to others struggling through much bigger obstacles.

You need to come to Australia, this story would be illegal here. Tenants have all the rights over landlords. In fact so much I got out of rental property completely.
Class action lawsuit? I am probably ignorant, and this may not be the type of case that a class action lawsuit could serve, but several businesses all suffered from this one corporation. You're strong and awesome. Hang in there❤

There was a highly desirable shopping center in Phoenix Az and it started to become vacant… the original owners sold the center and the new co doubled rents and everyone left including the chilis, the big name movie theater… maybe the new landlord made money when it sold the place… it was eventually sold and another company re developed it… the original center was very charming and they sort of left that in tact and it seems like it’s doing ok but it’s not the same to those of us who knew it before, but its filled now… but yeah… best to let these landlords take a hit

Situations like yours just make me sick…and really mad. What has this country come to…this country was built on small business. No one can survive in our current state. Not sure if it's feasible but you might talk to your lawyer about a class action suit. And make it very very public. I know it's expensive but we cannot let these kinds of people railroad us. They're scum and all they care about is money.

Hang in there. I know exactly what you are talking about. My business was racketeered against. When you do well the slime comes out of the cracks. And immediately before that I had brain cancer and before thrived past a serial killer. You must hang in there and thrive. I dealt with tooooooo many jealous people and really, I was so busy that I didn't have a life.

This is why you see so many empty strip mall stores, we just had a large strip mall convert to a storage facility. They took down the walls between the stores and put in storage bins.

Maybe if you and the other tenants of this company all had similar leases that your attorney thinks could be fought and won, a class action should be considered as an option. It should help ease the financial burden on the individual tenants and still allow those involved a chance at a fair resolution.

Try finding another location with a different property management company.
It's probably more cost effective to buy a commercial property instead of leasing one, especially if you expect to do this in the long-term. Landlords/property management companies are the worst!

well at least you tried I would never have gambled that much . Many commercial real estate owners put businesses in hoping that the business will grow and succeed and then they can kick out that business and out their own business in . Had a friend who owned a bakery and that happened to her , her and her husband worked all hours to make that coffee shop nakery a success and when it did becaome that the landlord refeused to renew their lease so they had to move ... long story short they bought their next building and made a success out of that property

Stay strong … and really think about closing the store and maybe work out of a warehouse if you need the space..
What if you rented a storage unit and put the higher value in items that you get off the pallets into the storage units and then drove the customers who like the higher value items and are unhappy about the change to your Facebook marketplace to buy at the higher slightly higher value assuming it was $10 an item or so, that way you can maximize a little bit of profit while retaining those customers and they can shop with you separately from a much cheaper location that they can meet you at?

I'm 50 and had a "what the hell am I doing moment"... it gets better, you will find your way. Maybe the bins store isn't the answer. I wish someone told me it was 100% okay to give up and move on. The important thing is that you tried... but to lose all your money trying to save something is a bad idea. If you think the bins store can become profitable AND it brings you joy, push forward... if not, cut your losses, and move on from that store. Just think of how fantastic your 2023 taxes are going to be... a loss gets carried forward :).
When your lease expires, MOVE! advertise your new location when you go.
From my experience, commercial property managers are crooked. Their business is money not people. I will never have anything to do with them. Sorry you are going thru this. My only advice would be to tell you life is short and constant stress affects your body in so many ways. Decide what you need to do to make you and your family happy and make it happen. Blessings to you and your family.

Sounds like these landlords are shady mfers who use loopholes to place small business owners between a rock and a hard place, knowing they don't have the money to fight back. I'm so sorry. Contact the Better Business Bureau and see if this landlord has similar complaints. If your original lease was ambiguous yet the previous landlord was upholding your payment agreement than that's legally binding and this new manager cannot request back pay.

A guy who lived through the Great Depression told me when the economy went south everyone started screwing each other. I've seen it a lot in business myself. I've made up my mind that I'd never be involved in any type of partnership again. Or landlord situation.
100 % true. One effect that money has on people is making partners greedy. How easy people change from amiable to evil when money comes into play.
