  • In this video we are going to look at section 21 evictions. We will look at what is a section 21 eviction and what happens if you receive one and what rights do you have, as well as how to challenge this type of eviction and the pros and cons of doing so.

    I love that hilarious part where it says "You can seek help from your local authority to help you find somewhere else to live". Who writes this ill-informed rubbish? Your local council won't do a damn thing for you, guaranteed!

      I went to the council offices kicking and screaming after I had a letter off the bailiffs saying they were coming to evict as they said they don't help you until you are thrown out of a place!
      They did offer me a place after I did that!

    When i noticed mistakes in the court papers i said nothing and strung them along and they sorted out a hearing in court which gave me more time!

    When we all got section 21 notices back in the july of 2022 i put in a homeless application with the city council as soon as i could!
    I reckoned there was a mistake on the notices but never said and strung them along and in the november of 2022 i was told i was getting another notice as the one in the july was invalid!
    I had tried to reach a deal but kept getting told no at every turn!

    Hi does anyone knows if the notice is valid if I pay the rent on the first of each month and the landlord give me a notice that require from me to move out before the 21st which is over 10 days earlier. I understand that I am required to pay full amount of the rent but should I voluntary move out giving up one third of rent for free. Would notice be therefore invalid as is against consumers rights?

    I had a question. My landlord has just back from holiday and says he wants the rent increase and a new tenancy agreement. I’ve been in the property for over a year… however he’s the mess.
    1. I cannot afford a new rent increase
    - so
    1a. Landlord Not secured my tenancy deposit
    2. No gas electric certification for past 12 months - even with repeated written/texted requests and calls.
    3. No Section 13 notice to increase rent
    4. WhatsApp proof of refusal to do work.
    5. Photos of myself being an exemplary tenant. Fixing boiler, fixing fences, decorating property.
    6. Previous tenants statement to say landlord not given an energy gas certificates for 5 years
    7. Previous tenant statement of gas leaks in property and complete disregard for health and safety in 5 years.
    Me and my landlord are set for warzone. I spoke to council and they have said my landlord is breaking the law in all ways. I also now have come into a financial predicament- wife has had baby and she’s no longer working. So we cannot afford the energy costs and rent. I have applied for housing today and need Advice on how to move on with my family and kids (3).

    Quick question on one point. Does the panel still feel that if a landlord fails to provide EPC, GSC etc prior to the start of the tenancy that Section 21 is prevented? Question is with respect to the recent Trecarrell House vs Rouncefield ruling.
    Furthermore if the landlord had failed to perform say the GSC prior to the start of a tenancy would that be fatal to his case for eviction?

      Doesn’t have to be done at the beginning as long as it’s still valid

      @Hudson it's not valid if the gsc was not performed prior to the signing of the tenancy agreement and thus there was no valid certificate whether served to the tenants or not. Right?
      Otherwise landlords could ignore their legal duty and lives could potentially he put at risk.

      @@just-facts-please-thanku7262 For example your normal gas safety check is say November. Tennent leaves January, new tenant moves in February you don’t need a new certification for February. It can go through to November.
      It’s easier to keep all Gas checks at same time of year so nothing gets forgotten.

      If they have any kind of outstanding maintenance issue which they have not attended to (and if you rent through an agency that's a virtual certainty) that certainly hoes against them in court. As it should - because it prevents landlords chucking out tenants that ask for the services they pay for or because they don't want to pay for issues that affect the health of tenant families. I don't know how this is specified in law but I'm assured of this by two professional landlords (not agents). Make sure you report every fault with your home in writing before you get the eviction notice.

    This is all very good, there are some terrible landlords who are not compliant and driven purely by greed, however there are some terrible tenants, I have a terrible tenant on a 12 month AST, has been persistently late with rent payments, in fact since starting the tenancy has always been late in rent payments and built up to three months in arrears, refuses mediation, garden is not done and is an eyesore, I am experiencing hardship because of this, I have to serve a section 8 to get rent, and then tenant gets under the 2 month threshold then does not pay rent, so mandatory possession is not possible, difficult to get eviction for discretionary reasons, may take me years to get the tenant evicted, as tenant is playing the section 8 2 month threshold loop hole, the tenant has a CCJ with poor credit history, , so cannot get another rental easily, I have a new kitchen waiting to be installed, why should I bother to do this work?, unfortunately I am now thinking that a Section 21 is the only sure fire way of eviction, I am fully compliant with EPC, GSC, EICR, How to Rent, the tenant is working

      Section 21 get them out it’s the only way and nothing more than they deserve, I always do a credit check and they don’t get past first base if they don’t have a landlords reference , they usually say I’ve been living with parents or friends , the application goes straight in the bin, , lots of good tenants out there treat them righ5 and they will be good back, I’ve never had to evict anybody in years

    Around 4min 50sec this guy says carry on paying the rent or the landlord may use this against you. Why is this the reason to pay the rent? How about, pay the rent because you're supposed to!!! Like pay for something in a shop because you're supposed to, not because if you don't you could be arrested. If you live somewhere you should pay for that service because why should you live somewhere for free. This guy boils my piss!!!

      I feel your pain. I see this video as good training ground for the landlord. I’m a landlord and will cross every T and dot entry I before going down this route.

      Or landlords putting immediate family into buy to let properties. It's potentially mortgage fraud. If you have such disregard for tenants then you're in the wrong business. Try loan sharking , might suit your personality.

    EASILY the best way to get rid of a tenant?
    Offer them £1,000 cash. Cheaper than involving a solicitor. They all accept because the think it’s like becoming a millionaire 😂
    They are not usual he brightest and will stay with “ friends” for a while.
    You then get your house back to either sell, do up after the mess they made and re let for hundreds more than before because of the rental costs going up and up.
    Supply and demand, look at South Wales 😂

      Not usually the brightest, bit of a sweeping statement there. You sound like a total d*** landlord, how about putting my deposit in a the deposit scheme like you're legally supposed to rather than stick it up your nose in a coke binge. Could say the same for landlords at times.
