While we are discussing laws, lets look at this one: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. It seems to me that regulating speech in the form of radio communications are a regulation of free speech. Just saying.
When people can communicate with each other, especially over long distances, the Government loses it's ability to control the people. Recently a Carrier pigeon flew 8000 miles to Australia. What a Miracle. But the Aussie Government killed it because they feared it would spread Covid.
And who, exactly, is 'regulating free speech' by issuing a reminder? Here's the complete 'warning'. Please indicate where it violates the 1st Amendment. FCC ENFORCEMENT ADVISORY DA 21-73 Released: January 17, 2021 WARNING: AMATEUR AND PERSONAL RADIO SERVICES LICENSEES AND OPERATORS MAY NOT USE RADIO EQUIPMENT TO COMMIT OR FACILITATE CRIMINAL ACTS The Enforcement Bureau (Bureau) of the Federal Communications Commission issues this Enforcement Advisory to remind licensees in the Amateur Radio Service, as well as licensees and operators in the Personal Radio Services, that the Commission prohibits the use of radios in those services to commit or facilitate criminal acts. The Bureau has become aware of discussions on social media platforms suggesting that certain radio services regulated by the Commission may be an alternative to social media platforms for groups to communicate and coordinate future activities. The Bureau recognizes that these services can be used for a wide range of permitted purposes, including speech that is protected under the First Amendment of the U.S. Constitution. Amateur and Personal Radio Services, however, may not be used to commit or facilitate crimes. Specifically, the Bureau reminds amateur licensees that they are prohibited from transmitting “communications intended to facilitate a criminal act” or “messages encoded for the purpose of obscuring their meaning.” 47 CFR § 97.113(a)(4). Likewise, individuals operating radios in the Personal Radio Services, a category that includes Citizens Band radios, Family Radio Service walkie-talkies, and General Mobile Radio Service, are prohibited from using those radios “in connection with any activity which is against Federal, State or local law.” 47 CFR § 95.333(a). Individuals using radios in the Amateur or Personal Radio Services in this manner may be subject to severe penalties, including significant fines, seizure of the offending equipment, and, in some cases, criminal prosecution. 47 U.S.C. §§ 401, 501, 503, 510.

Not exactly. Everyone with a HAM license just got lumped into the category of policemen of the radio bands. If the ham bands become a threat to national security, which would not take a lot of people to provoke, how quickly could the FCC order the shutdown of bands with heavy QRM (radio warblers and noise emitters), as is used in certain bloc countries? If I were at the security planning table, I'd certainly recommend readiness to shut down the bands at a moment's notice. Your job as a good ham: Police operators on the bands, report malfactors, and keep the bands open. Access is a priviledge, not a right.
@@misterguts Makes one think: if the airwaves are public, then what authority does the FCC have to deny access? FCC ENFORCEMENT ADVISORY
DA 21-73
Released: January 17, 2021
WARNING: AMATEUR AND PERSONAL RADIO SERVICES LICENSEES AND OPERATORS MAY NOT USE RADIO EQUIPMENT TO COMMIT OR FACILITATE CRIMINAL ACTS
The Enforcement Bureau (Bureau) of the Federal Communications Commission issues this Enforcement Advisory to remind licensees in the Amateur Radio Service, as well as licensees and operators in the Personal Radio Services, that the Commission prohibits the use of radios in those services to commit or facilitate criminal acts.

Welcome to the club.
What's to say someone can't have a stash of Part 90 radios and use frequencies outside the ham bands? (Even though in "good" times, this would be illegal)
This starts to evolve into a political topic on government authority, as with many other things. It seems people have truly stretched the imagination as to what is included in the constitution. More people are killed with screwdrivers than with beachballs. Does this mean limiting the rights of everyone with a screwdriver? Apparently a lot of the countries more ignorant citizens think so.
That's not what the "Gun Free Zone" law does. It enhances penalties for committing gun crimes near places like schools.
The signs don't tell the whole story.

The "Event" of Jan 20th. You mean the regime that has taken over the USA. The regime that has and will continue building a wall around themselves to protect the dictator party. Just like walls and interior compounds that protected all other dictators from south and central america to the middle east. Are their capitals open to the public for tour? Or do they keep large population free zones to protect their illegitimately elected treasonous ba*tards?
Great job speaking to this Jim. We are all shaking our heads as well....
I thought I agreed to them terms when I passed my test
As far as that goes...? I know a Ham that had a conviction for selling counterfeit Viagra - although got it expunged - but all you have to do is Google search his name and you'll find the story on a local news website; so much for the expungement. And. I know another Ham that has a conviction for buying and using crack cocaine and had a license up until it expiring recently but still has the option to renew it! So, that being said, to one extent the FCC really doesn't care about Amateur Radio until a Ham spews obscenities while running 10kw about a the government and politicians in some manner or another and to that extent the FCC comes down with the full weight of federal violations, prison time and fines at which the sale of their QTH wouldn't cover in a hundred lifetimes!

@@charleswoods2996 - Yup, I agree with ‘ya. The FCC doesn’t care too much about amateur radio unless there’s a big enough complaint. I know a licensed amateur operator that has a felony conviction for pedophilia... with his own children. He uses a 2 meter repeater that belongs to one of our clubs, one of the members has petitioned the board to ban him from using as there are under age operators on occasionally. He, and another ham, also contacted the FCC with all the conviction info and it was ignored.

He was able to renew his license recently from prison by using an address in his home town. I know the question is on the application that asks if the person is a convicted felon. A few other offenders who are hams were brought to my attention as well. The FCC doesn't care. They allow convicted felons to obtain a license at their discretion. I have even heard hams say that it doesn't matter if a person is a convicted felon. So be it.

Exactly. I purchased a hand held Wouxun and was scheduled to take my Technician examination; however, after hearing this report on the Sunday that it was released and coupling it with the current totalitarian mindset of the new regime, I put the examination on hold. In addition, I did not like the idea of an overreaching government department having the right to inspect my "Amateur Radio Station" on their whim. I just have to be content on being a passive listener.
@@MrInfoUnderground59 Yes, they assert a right to inspect equipment, but realistically if you're licensed and broadcasting within the bands and power levels you're supposed to, they're not going to come bother you. I became a licensed amateur radio operator in 1958, at age 13. I got my general ticket in 1959, at age 14. Have been in amateur radio for 62 years. I have a basement and an attic full of synthesizers, oscilloscopes, spectrum analyzers, waveform analyzers, pulse generators, high and low voltage supplies, signal generators, logic analyzers. So they are saying they want to shut down your freedom to assemble and peacefully redress your government for grievances.
Leslie, 60, I would like to start.
I think that we all have a pretty good idea why this was issued at this time. I further think we will eventually experience censorship of various noncommercial radio services, as well. This government is very afraid of the people.
A government for the government, of the government, and by the government so that it shall not perish from the Earth.
I live in SC. I'm over 60 years old. I've been told since I was a child, using a radio to commit a crime is a felony. Amateur radio operators now are being targeted specifically, in exercising Free Speech.
Where did this notice from the FCC say anything about exercising free speech?
The government does not want ham radios to tell others about gun confiscation when it happens.
With all that had been coming from the new Biden administration these past few days, I fear it won't end well for them.
Is it possible that this latest piece of info from the FCC is actually a shot across the bow? Meaning: Are they planning on outlawing Ham radios and their operators because it's our last line of defense against censorship everywhere we look and our ability communicate with each other?
The big concern is that no example of what a crime is is given in the letter. Therefore they can make it up as they go. Never good.
Our elected officials are afraid of "WE THE PEOPLE".

I used to do CB radio, was a member of REACT and when hurricane Agnes came thru here, we saved lives - there was over 130 of us who kept watch, provided information on flood conditions, emergency requirements and so on. As a Trump supporter, isn't it true that you have to worry about what lefties define as "crime" to know what exactly is meant by a crime? With the way the media is raving about how Trump supporters attacked democracy or started insurgency and all the other nonsense, seems like everyone can define anything however they see fit. The rest of the world is fed up with how this has all gone down and think the lefties are a laughing stock and BS.
The illegitimate adminstration is scared of the people.... They would not have made it five minutes in the troubles. Desperation and fear is all I'm seeing from the government right now.
This is happening to the model aircraft hobby. They’re currently punishing remote UAV pilot operators and accusing them of crimes by strapping a remote ID to our aircrafts. I’m thankful that they want to enforce a knowledge exam because the community has been wanting one to prove to the FAA that we are capable to performing safe and legal flight, but we have to be given the opportunity... and here we see ham radio operators who ARE LICENSED the same kind of accusation I am seeing in the remote model aircraft community!!
The government is searching for a crime, that’s it. They want to find illegal operators... they want to eliminate our hobbies for commercials reasons. You know the 5cm band? It’s a ham band that is now being used for wifi...... 5G and LTE took some bands away from us too... The government is picking away at us.
It’s a slow process, but the government wants to remove our privileges bit-by-bit.... Only leaving behind the scrap they don’t want...
When we get licensed thru the FCC or the FAA for UAS we agree to all the laws surrounding it. Criminals will not take the time to get licensed. The FAA requires a Homeland security clearance and TSA background check. The FCC may start implementing this as well.
I wonder if FCC got wind of something they can't explain openly. So weird...
Nothing "odd" about this message from the FCC and ARRL at all. There are indeed "extremists" that are using ham radio, GMRS, CB, and FRS for their "activities", it's happening in the area where I live, and they're not even trying to hide it. As a matter of fact I have stopped associating with several people in the area because even though I support President Trump, they are and have been "off the deep end" for quite some time. With what happened with the ATT building, cell/phone/tv service was knocked out for a wide region down there. With the increasing riots, vandalism, destruction and.....oh shoot....I mean peaceful protests, I suspect many people are looking for other ways to communicate in emergencies, in case it happens in their area.
