- In this episode, Professor Josh Douglas (University of Kentucky College of Law) discusses the Supreme Court's current practice of deferring to states' voting systems. This deferential approach allows states to pass partisan voting laws with an eye toward influencing the outcome of elections -- that is, the party in power can pass laws that help to keep it in power. To avoid this undesirable result, Professor Douglas argues that more robust judicial scrutiny of state election laws is desirable.
