I think so because the judge made clear that trump, the man, would not have gotten the protections the office of the presidency got him, but I am not a judge or lawyer. Yes, it would have been completely different. The unconditional discharge is precisely because he will be sworn in in a couple of days. Otherwise he would have received an actual punishment. Jail time was always unrealistic in my opinion though (but I'm ofc not a legal expert). But yes: the sentencing was entirely dictated by the election, and it made the judge's task really complex.
So far nobody has been able to figure what he was actually convicted of. Jury wasn't given a defined charge to return a verdict to. They were instructed they could just make one up. If you can figure it out, please advise. None of the legal consultants on any of the channels could.

This judge has no imagination in how to properly sentence trump in this unusual case. They say that he can't be sentenced in any way that interferes with his duties as a President ( what a joke ) . What he very easily could have done to punish him without that interference is to demand that Trump not play any golf or even walk onto a gulf course for his entire four year term because that would be considered on his own time not under his duties . If he violates any of that he would be subject to high fines for every violation .

Totally disagree with the judge on this panel. Merchan should have sentenced trump to prison and suspended imposition of the sentence until trump leaves office. Trump’s lawyers could then pursue their appeals while trump is POTUS.

No, we won't ever see any accountability for Trump in any of his cases, I'm afraid that ship has sailed a long time ago. But the judge found a way to uphold the verdict, and to let the work of the jury stand, and I think that was important. At least it's important to me.

During the appeal process, the conviction is subject to review and potential reversal. If the appeal is successful, the conviction can be overturned or vacated, effectively clearing the defendant of the charges. So while an appeal is pending, the defendant is not technically considered convicted.
