    Prosecute her.
    She chose dereliction of duty, refused to resign until evidence was overwhelming. Now she is resigning hoping to avoid any more evidence voming out.

      Will her strategy work? As the State Attorney indicated, this situation is unprecedented. I'm fascinated by the legal technicalities, and more importantly which charges will move forward and which will become moot. I would love to see her get disbarred for just cause.

    This entire effort by the defense is Garner trying to avoid discovery. The accounts, how she spent taxpayer money, how she ran the office, what she was doing during the workday instead of doing her job is in question and she is trying to avoid discovery of all that.

    So, she messed everything up, not charging criminals for their crimes and now wants to just walk away. There needs to be accountability at that level of public service. She has already lost their trust. I say jail time and a substantial fine. There has to be consequences for her actions.

    You don't un-murder someone by just asking forgiveness, if that makes any sense. You can't in-ring a bell. How can Ms. Gardner screw people over, do her best to make a mockery of the law and then just, "OH I quit" and somehow expect everything to just disappear?? Put her behind bars.

      I haven't looked into the specifics of this, but there are circumstances where you can sue someone acting in their official capacity, but if they no longer are in that capacity you can't just sue the person. That doesn't apply to criminal cases, but if something is purely civil then sometimes leaving a government position is something of an escape hatch.

    Her scheme to undermine the system and believing things get better by ignoring problems needs to be punished. Her ideals brought upon a problem for those immediately around her and more importantly the community. The message of inept government ability was felt by all. This was due to one person. One. She had one job. One.

      I would DEFINITELY demand her to leave my room IMMEDIATELY! I don't want a nurse as lazy as Gardner is!! Of course, time will tell if she can even make it through nursing school with a passing grade! I seriously doubt it, because it requires work to get through Nursing School, and she's already proven she's far too lazy to apply herself!

      She was no different than the criminals that she was supposed to prosecute, and ran on this premise. She was voted in knowing she was a political activist for criminals. She broke the system, from within the system. The citizens of the city and county have paid for this, since the day she took office. Behind the scenes, these politicians want their job, power, and activism, but not the responsibilities that they SWORE to keep.
      The city of St Louis will continue to be unsafe, for years to come. All of this political theater is just theater to try to make ST Louis LOOK safe, when it is far from that. There is a silent boycott of the city because it is no longer safe to enter. NOW, the city is starting to feel the boycott, and losing businesses, by the day. The city wants to appear safe, now, because nobody wants to go there, anymore.

    Losing her job for reasons of incompetence, neglect, and political leaning (supported by Soros) is not enough of a penalty for what she did to this city.     I don’t think her case should be dismissed. If you are going to show people the system is changing and there will be accountability, you need to start at the top. When you show people that even the DA will go to prison, you show them there will be consequences for your actions. She has created an environment without consequences and you can see the reaction. Show an environment with REAL consequences and watch the progress happen.

    It appears that she stole from her employer by enrolling and attending an educational program unrelated to her duties. One could argue that she was salaried and that she was not obligated to spend a specific amount of time doing her duties. However, sine she was not fulfilling her responsibility it is probable that she was stealing from her employer.

      Becoming a nurse involves hard work and Kim Gardner doesn't do that. I highly doubt that Kim Gardner has what it takes to become a Nurse, but I definitely know that it doesn't have what it takes to BE a Nurse! Being a Nurse is harder work than Kim Gardner is willing to do! What hospital would hire someone as LAZY as Kim Gardner? And what patient would ever allow Kim Gardner to be their Nurse? I know I wouldn't! What Dr. would want her working for them, because she would never be there when they needed it!!

    Isn’t this a common tactic used by police officers trying to avoid court cases and punishment ? They are allowed by their chief to resign the case gets closed and they just move on to another police department escaping any consequences of their misconduct.

    Click baity title even though accurate and it managed to get views and comments by being misleading. The motion is to dismiss the case that would force Gardner to resign. She previously said she wouldnt resign, then she said she would resign June 1, then she resigned the morning of this hearing. Therefore no need any longer to compel her to resign. Hopefully she will be disbarred, held accountable civilly by the victims of her malpractice, and criminally in more than one way. The presence of 5 or 6 AG staff for this hearing could be to send a message that such charges will be forthcoming.

    The authorities MUST take the judicious process to a guilty finding. If the judge dismisses now, she will try to get a nursing license. She needs to be found guilty of all charges so she cannot get a professional license. She needs to go to prison.
