      It's not about the $200, it's about the list your name goes on. The AFT knows a braced gun isn't any more dangerous than a regular rifle; this is just the serpent's path to a "legal" registry. The only reason SBRs are in the NFA in the first place is because the OG gun grabbers couldn't persuade the courts to allow them to restrict handguns, and they thought this would provide them with leverage against our rights in the future.

You know, how it was because handguns were forbidden from being restricted in the NFA by the courts? Can you point it out to me? (Also, the electoral college was put in place to give smaller states a better chance at fighting against larger states in elections and is one of the main things that ensures we stay free.)

      @@masskiller9206 That isn't correct. The electoral college was to be made of Congress selected, by congress to elect their executive officers. The Civil Service, which is the army of unelected, unaccountable, permanent staff, I am referring to, was never intended to exist. In fact, a majority of the founders expressly warned of that very system as the core reason for the corruption of other forms of Governance. That system was put in place after the Civil War to make the US government function more like the Corporate Empire system we broke away from in the first place, and then re-affirmed after WW2 along with the standing military, because the threat of Nuclear war brought real risk to the "Sophisticated" among us who had been able to remove themselves from the dirty realities of actual conflict before that. They are also the ones who codified the "continuity of government" nonsense that has led to the American war machine and the "Democracy"" we are being told has always existed at the expense of continuity of the Liberty of Citizens.
      The election of Senators, and the President/VP, was never meant to be done by popular vote or direct democracy. The idea being that the average citizen is either too busy with local/State affairs or too far removed from the National Issues to be burdened with that responsibility. They were meant to focus on creating stable local/State communities, and making certain they elected the wisest and most capable among them to represent them at the National level, which is also why the Federal Government has such strict restrictions placed on their scope.
      Modern Americans have a completely different understanding of our system than was intended, by design. The Republic has been usurped in favor of two competing ideas of elitists, neither a "Democracy" or an Empire were ever to exist on the N. American Continent. It was always intended that the Aggregate of Citizens who were invested enough in the long term health of the total Republic to risk their time, talents & treasure, to make sure it functioned, were to be the authority and structure.

      when you think back on history, remember that only 250 years ago people were willing to fight the british & die just because their taxes were a little too high. compare with today, where people were locked indoors for a year+, businesses and careers ruined unless you bent the knee and risked your life for pfizer profits, and you see how weak and spineless the modern american has become. overweight, low testosterone, only willing to talk but never really putting any substance behind their actions. its a sad reality but you have to realize that when an idea has nobody willing to stand for it, that idea is dead. the pistol brace is just a minor wart on the festering tumor that is the weak & insane modern western society

    It does not seem like owners of legally purchased and responsibly kept pistols with attached stabilizing braces are going to get relief before the ATF’s spectacularly gracious 120 days runs out. It really sucks the wind out of the law abiding, safe, moral, and prudent gun owner’s sails.

    Why isn’t anyone using the Bruen and Heller decisions to go after the Short Barrel Rifle prohibition of the NFA??? The ATF is saying, in the pistol brace rule, that the presence of a pistol brace turns an AR pistol into an SBR. OK, then let ATF have that opinion, but then the 800-lb gorilla enters the room…..Where is the historical analog from the era of the adoption of the 2nd A that shows government is permitted to legislate the length of a rifle barrel? Think about it. MILLIONS of AR pistols with braces were purchased LEGALLY, and are now commonly owned for lawful purposes.

      the SBR rule was created because MOST big cities even in the 1800s had a no concealed handguns rule
      and handguns were often not even sold in the city
      so criminals ( like now) just went around the law bought hunting rifles and shotguns and chopped them down to fit under coats and jackets and in small containers.

      it no longer applies in its intent

      U.S. v. Jack Miller is fitting as well, when you consider the rubric given for what is "guaranteed under the 2nd Amendment" as made in the ruling.

      US V Miller was 1934 or 35 and basically was scotus good old boy nod that "sure you restrict a protected right if it's for safety...." it should not stand.

      1939, actually, but oh well. The NFA was written in 1934.
      Miller has teeth to it, but no one uses it properly- it specifically lays out a rubric of what (at a minimum) is guaranteed by the Second Amendment. The instrument ("arms and equipment" must meet some part of the following criteria:
      1.) Have some reasonable relationship to the preservation or efficiency of a well-regulated militia (so think supplies, support gear, vehicles, etc.);
      2.) Is any part of the ordinary military equipment (think about anything that an infantryman can have, specifically), or;

      The reason the Miller case was a "loss" was because Miller was using his sawed-off to commit crimes, and therefore not covered by the 2nd Amendment. That's the rub, is that he could have argued that it met the standard of being useful for the common defense or something like that (with examples) if he hadn't been using the shotgun for robbing banks, which he was caught for- but he was also dead, so there's that.

      Thank God the NY courts were able to modify a statute of limitations (for exactly 1 year ONLY) for sexual assault allegations to hold trUmp liable for battery in less than a week! At least we know -completely false and made up- cases are moving in a timely manner, IF you’re on the correct -left- team!

    Laws disguised as rules are still laws if one can be prosecuted for them as a federal offense and receive prison time as the punishment.       Their work around to grandfathering is "Claiming" that these "have always been controlled by the NFA" is clever bit of BS to back date their new rule to 1934, the date the NFA was passed.
      So if you had it before the NFA, it might be allowed...

      But it wont help anyone. Lack of registration only means they will pick us apart one by one when they catch us with a braced pistol turning us into felons (so we lose everything) and there won't be anything we can do about that. Personally I'm not registering but I will remove the braces for now and wait for all this to play out in court and if I have to pay for a tax stamp later if all the lawsuits fail then so be it.

    Many people who are not disabled own pistol braces for another reason. Due to ATF regulations pursuant to the National Firearms Act of 1934 and other gun laws, all rifles with a stock and a barrel of less than 16 inches are considered an SBR, or Short Barreled Rifle, which are heavily regulated by the ATF. Shooters who wish to legally own an SBR are required to apply for permission with fingerprints, serial number, and photos, wait an undefined amount of time for processing, and pay for a $200 tax stamp. The other option that was formerly open to gun owners was to remove the regular gun stock in favor of a pistol brace.
    In Nov. 2012, the ATF determined that installing a stabilizing brace on a short-barreled AR-type rifle would not change that firearm’s classification from a regular handgun to an NFA-regulated SBR.
    A 2014 letter issued by the ATF that says the bureau does not classify pistol braces as a stock simply because it can be shoulder-fired.
    “We have determined that firing a pistol from the shoulder would not cause the pistol to be reclassified as an SBR,” reads the letter. “Generally speaking, we do not classify weapons based on how an individual uses a weapon.”
    According to the Congressional Research Service, unofficial estimates place the number of privately-owned pistol braces at around 10 to 40 million, so common use. The CRS says that changing the classifications of these firearms would likely affect millions of Americans.

      If it started as a rifle, it is always a rifle.
      If it started as a pistol, it can go back and forth per US v Mossberg re shockwave 12 gauge pistol with a short barrel.

    I love my AR pistols but ATF couldn’t pay me enough to put my guns on their SBR lists. Hopefully with my A5 buffers and brakes I’ll be able to run them well enough without braces. My concession to the brace rule is to make my pistols as useful/functional as possible without braces.
