    Please don’t say “sex with a 13 year old” and say what it is, RAPE. Otherwise it contributes to the victim’s self blame.

      I don't know if this is the reason they avoid using that word in this particular video, but other TH-cam channels avoid that and similar words bc the TH-cam algorithm picks up on keywords and it will get their video demonetized.

      Yep. But I have also learned so many things about being careful with strangers. I have always been friendly and outgoing and have a hard time saying no. Not anymore, not with complete strangers. I owe a stranger nothing. I have been approached so many times with requests for money or some have offered to sell me things for cash. I'm extremely loud and rude with them. One guy followed me to my car after I got off of work and I knew he was following me, and as soon as I got to my car I yelled so loud for him to get away from me. He turned and left. Then I watched him approach 2 cars that were pulling in. I called the cops and I yelled at him that the cops were on their way and he looked at me and said "good, I kill cops" but then he ran out of the parking lot. Because I had given them so much detail, they did stop him, but that's all I know. Dispatch called and told me that they got him not far from where I worked. I don't think they could charge him with anything tho. I've also learned that if a guy offers to help you and you tell them "no thank you", if they keep offering, then they shouldn't be trusted. A "normal" guy will leave you alone once you say no. And NEVER EVER let someone force you in a vehicle. Fight and scream and yell, even if they have a weapon. I've heard it said on many true crime shows that if you are taken to a secondary location, you're pretty much dead. But if you put up a huge fight, they don't want attention drawn to them and they will more than likely give up. Maybe not every time, but I will never go and will fight with everything I have.

      true, if a parent was a bully growing up then his children will be the same, there are so many out there men and women who have no empathy no consideration for anyone but self! and a beautiful woman with her back turned, this young woman should've had a can of pepper spray or a stun gun in her pocket, when my granddaughter gets old enough to understand the twisted and perverse' world around her i will make sure she has these items and like my nieces a permit to carry, and they've known how to be markswomen from the age of 10, the moment she thought someone was after her was the moment she should've called 911 and even taken a picture of who she thought was after her, you dont have to have the camera in your face to get a pic. down by your side with the camera facing the direction of the pic or enemy you wat can be taken with your hand down by your side! something to practice teens! you live in a world where every form of perversion is acceptable and the hero is the evil one! keep in mind this young woman stepped into judgement as we all will, Hebres9:27 took place, it doesn't matter how we die that still happens, so people/ teens need to get their heads out of the in crowds ass's and see where you stand, or you could end up like this young woman food for a heartless predator!

      i know the families pain, a friend of mine had a beautiful wife she had a model body, everywhere she went she had the attention of all men, she was married to a friend of mine he was a short overweight Mexican, quite the odd couple, the fact was she loved him with all of her being, then one day we got off work i went to his place and what i saw can never be erased from my memory, Vicky was 36 years old and 9 months, when we got there the front door was half open, he ran inside before i could even reach for my door handle, there on the floor was Vicky she laid there in a pool of her own blood, what would have been the daughter laid next to her still attached by the cord, the only thing missing were Vickys legs, her murder had a leg fetish and he followed her on a bicycle, and he was caught going through a Walmart parking lot with her legs hanging out of a basket by Walmart security cameras thats how we got him! Cecil never set foot back in that house, its not like TV the crime seen doesn't simply vanish when the investigators walk away, no i had to clean up the mess, i had to pack all of their belongings because i trusted no one else to many family members and morbid souvenir collectors around! after i had finished i had given him a list of every item i had accounted for from her jewelry to her lingerie, and the boxs they were in, its been 20 years to the day and he never remarried his heart died with her that day!

    I did some background reading and watched the 4 hour closing testimony online. Here are the reasons I think there was not even close to enough evidence to convict him. Apologies for the length but there's a lot to cover (in order of importance, least to most). TLDR at the end.
    1. THE PHONE - They DID NOT track the phone to his house. Phone and bag were found in a ditch a mile from the murder scene, which is 30 miles from his house.They made it sound like they tracked the thing to his house and while that may make a good story, it is obviously far from reality.
    2. CELL PHONE TRACKING / BIKE- They have Fitbit data from her phone however, it was discarded a mile from the crime and does not link Vancallis whatsoever, despite what the video title would lead you to believe! Vancallis admits he was at a local gas station as this was en route to his brothers house, where he showed up not too long afterward. The question is did he take a side route down the trail from there? He says he didn't and went straight to his brother's house. The prosecution showed very grainy surveillance photos from various locations that would have been consistent with his either approaching the trail or leaving it, if he had gone there from the gas station. Have a look at those photos from the closing argument yourself...they are just not clear enough to say it was his bike. TBH, this is their strongest evidence linking him to the trail at that time and IMHO it is weak. We know killer likely had a motorbike...question is, was it him?
    3. HIS BROTHER’S HOUSE - He arrived at his brother's house (which was reasonably close but would still have been hard to get to in that timeframe...but admittedly doable) shortly after the attack but his brother testified that he did not see blood on his helmet or sneakers and that he did not act strangely. He stayed there for a few hours shooting the breeze as if nothing had happened. I would have thought a little cool down period would have been in order after you'd just spontaneously killed someone...not go directly to your brother's house to pretend nothing happened, and not cause any suspicion either. Obviously, it's possible he did this, it just sounds weird to me. Perhaps the brother was lying? However, there were FIVE non-family members also present - they all said he never went to the bathroom and didn't notice anything strange about his appearance or actions.
    4. THE SHOES. The shoes are the flimsiest evidence of all. The video made it sound like the shoes were a slam dunk and that the footprints on her body matched a pair of shoes he had previously owned but were subsequently missing. However, during the trial the prosecution had to admit to the jury that they could NOT actually provide an accurate match with ANY of the footprints on her body and the shoes he had lost. I’m sorry but this is as circumstantial as you can get. My guess is that they pressed the GF on it and she said it looked like he lost a pair of his shoes, after which they tried to make that shoe fit with the prints on her body. But when push came to shove at the trial, they had to admit to the jury that they did not accurately match. But you would not have come away with that idea after watching the video, that's for sure.
    5. HIS LACK OF INJURIES - When the cops questioned him a mere two days after the murder, there was NO evidence he'd just been in an altercation even though he dragged her through the brush and there was a protracted scuffle. Killer's helmet was off after the crime, as testified by the 3rd witness. No scratches on Vancallis face at all.
    6. GIRLFRIEND TESTIMONY - Then there is the GF's testimony of him cleaning his shoes and helmet in the middle of the same night and telling her he'd “done wrong and that she needed to have his back”. When you consider she told the jury on the stand that he was abusive and controlling and that she couldn’t get away from him, then this is not a reliable witness and one with a big motive to go to great lengths to extricate herself from this relationship. On top of this, she said that next day he asked her to wash the clothes he was wearing the previous day even though she admitted that he NEVER normally asked her to wash his clothes for him. This is when she said she found grass and a big chunk of hair in one of his sleeves after they came out it the wash. Now I ask you, if the guy had just committed a crime and he always washed his own clothes, then why would he suddenly turn over his murder clothes to someone else to clean and with human hair easily discoverable? I'm sorry but NOT LIKELY! Plus, there is no autopsy observation that April lost any hair during the attack. She also stated that he told everyone in the house next day to lie about the shoes and tell the cops he wasn’t wearing them that day. But nobody else in the house could corroborate this. Just her story. And this was BEFORE the cops even made an appearance at the house and he knew he was a suspect. To top it off, she changed her story multiple times during the investigation..no mention of shoes until much later. IMHO, her testimony is not credible…she’s not credible. AND SHE WAS THEIR STAR TESTIMONY!
    7. THE WITNESSES - There were 4 witnesses from the trail that day. First was a man that was adamant he saw VanCallis ride by on his bike, even though he had his helmet on and visor down so that he could just see his eyes through the visor. Now, if it was correct, this would put the witness in the top echelon of recognition skills worldwide HOWEVER, he couldn’t identify the girl he saw walk past just afterward as April. So take his recollection with a pinch of salt. Second witness was a friend of April’s from school and saw a man on a motorbike talking to her but could NOT ID him as Vancallis. Final two witnesses were a mother and grown up daughter and are the most credible. They saw a motorcyclist beside his bike with helmet off, in brush with April’s dog nearby, likely just after/during the crime. So this is almost certainly the killer.
    The mother didn't see him while the daughter (Amy Spinella) said on the stand IT WAS NOT HIM, saying the man she saw was younger, possibly a teenager with sandy hair! This is despite her positively ID'ing Vancallis at the gas station a little earlier...you'd think that if he was the killer then she'd be even more likely to remember when they saw him a second time, right? This is CRUCIAL! The day after the crime, the daughter provided a sketch artist rendition of the person she saw and I urge you all to look at that online alongside Vancallis mugshot taken 3 days afterward. They are very different in that the sketch has a full head of curly hair and no goatee, whereas the accused had short straight hair with a receding hairline and a goatee (which was omnipresent on him from many years prior). On top of that, none of the witnesses could positively ID the bike as Vancallis’s even though it is a distinct dirt bike, or his helmet, which had a distinct logo on the front. This places a man on a motorbike at the scene of the crime. It does not place Vancallis there. In fact, the only person that saw the killer at the scene with his helmet off said it WAS NOT VANCALLIS! The prosecution tried to say her memory was clouded by the innate fear she felt but in my experience, fear is when you remember things the most vividly.
    8. COMPLETE ABSENCE OF DNA EVIDENCE - Then there is the most damning lack of evidence of all...the complete absence of his DNA in what was a frenzied attack where her clothes and undergarments were removed and where the police claim that she fought back hard. If he was there then it is almost impossible to explain how his DNA was not on her. NOWHERE! And the cops admit they swabbed every part of her body and could not find any. Or on the bag they recovered. Even if he was wearing gloves, how is this remotely possible on a balmy evening when some sweat, spit or hair of his would surely have to have fallen on her? The cops admit she put up a protracted fight - there would have to be some DNA on her hands from the struggle...on her fingernails. At the very least, some of his DNA from his helmet would have ended up on her head after he hit her with it. When all cyclists and motorbike riders put their helmets on they do so WITHOUT gloves as it is very cumbersome to strap in with gloves on - NOBODY does it with gloves on! So there would have had to have been his DNA all over that helmet prior to striking her, which would have transferred across. She died of strangulation - but none of his DNA anywhere? He MUST have had gloves on but they found no glove fibers on her and no witnesses recall gloves! Body was fresh so decomposition was not a factor. It's possible they found an unknown male's DNA on her body but they did not disclose this to the defense. It most certainly would not be the first time this kind of thing has happened.
    TLDR: Evidence is circumstantial & a complete lack of DNA evidence from a violent, frenzied attack to my mind more than cancels out all of the flimsy evidence suggesting he did it. If you came away from the video pretty certain that he did it then it is because the documentary makers considerably bent the truth to make it seem like he did but they most certainly did not tell you the full story. This is what I think happened. This was a horrific crime in a small community and everybody wanted to find the killer fast. The cops found what was in theory a perfect suspect (due to his dad’s prior sexual assault conviction, bike ownership and acknowledged proximity to crime) and they made whatever flimsy evidence they had fit. If this guy could afford a proper attorney, there is ZERO chance he'd be in jail right now. Could he have done it? Yes. Did the evidence show beyond reasonable doubt? Absolutely not. Happy to be corrected on any of this, cheers.

      It's true, there really isn't enough evidence in all honesty. As much as I would like for him to just be the guy, if there's a doubt, it might mean some sick asshole not only got away with it but is emboldened to repeat. I'm wondering about the evidence from the struggle, as well. They didn't find any DNA under her fingernails?

    • @secullenable
      @secullenable 2 ปีที่แล้ว

      @@xanbell7723 Not one shred of his DNA on her bro, on what was a balmy summer evening where he would have at least been sweating during the struggle and some of that would surely have fallen on her (ie in the extremely unlikely scenario that she did not touch his exposed skin in the scuffle and where some of it would otherwise have been in her fingernails etc..). Think about that...it's just not credible. And when you tie it in with the rest of their evidence. His only crime seems to have been on a motorbike in the general area at the general time (which he does not dispute). Could he have done it? Of course, but the evidence is just not there IMHO.

      @Sean Cullen >> Regards and great respect for Your intensive work; if I´m interested in a case, I do the same, but not in the way You do. On the other hand, it's not my language. I have nearly the same doubts as You and others - but at least it´s all second-hand, we are not at the scene. The other doubts, in another opposite direction, is the father, and his background may be he teaches his son to good for beware of evidence.

    • @secullenable
      @secullenable 2 ปีที่แล้ว

      @@howdeedoodee6603 If you convicted every son for the crimes of their fathers then prisons would be more overflowing than they are. The son's prior convictions were for drug and resisting arrest. He was never charged for any violent crime and his GF never called the cops on him. In fact, she had just moved back into the house with him 2 weeks prior.
      Do I think he could have done this? Yes, he acknowledges himself that he was in the area at the general time the murder took place. Would it have had to have been a coincidence that a different motorcycle guy was in the vicinity and did the crime? Yes.
      Also, check out the actions of the cop who claimed that Vancallis said he learned everything from his father (a convicted sexual abuser): 10:46. You'll rarely see such a clear tell that someone is lying as the cop is there. And besides, why the hell would Vancallis say something so incriminating? To me, there's a lot of effort to make evidence fit this case where it doesn't really.
      For me, this case balances on the weight of the lack of DNA evidence in a crime where there should have been plenty, along with no good witness identification (when you consider only person who saw him with helmet off said it wasn't him). The prosecution's evidence hinges on the killer most likely being a guy on a motorbike and that Vancallis was on a motorbike in the general area at the time. They have no real solid evidence. Do I think he did it? Quite possibly. But for me, this was not proven beyond a reasonable doubt - not even close. I could not have convicted if I was on that jury.
