I remember representing someone who had been framed and imprisoned for life. The lower court file went missing. It took the intervention of the high court judge for file to be traced. The appeal succeeded. The client was released.

@@Kakwasi very bad. In fact in the case I was handling, I was brought on board at the appeal level. The person did not have an advocate during the trial in the lower court. He was remanded for 4 years until judgement was delivered. When I took over the file had been missing for around 2 years. To make it worse, the appeal file also was missing. It took the intervention of the resident judge for both files to be traced. And then, the evidence that the court relied on to convict my client was very weak. The doctor had proved that there was no penetration but the magistrate went ahead to find him guilty and sentence him to life imprisonment. I thank God that decision was finally overturned by the high court.

The magistrates should be held accountable for this nonsense. How can you jail an innocent person. They do it all the time.
I once heard court clerks say that in Kenya if you have money, you can't be jailed. If you don't have, you're jailed.
This Magistrate Juma together with the other perpetrators must be investigated and held accountable. This forgiveness bull shit must stop forthwith.

Judges cannot be punished for the decisions they render, no matter how riduculous they may seem. The only recourse provided for in law is to appeal for a lower sentence or for acquittal. It's a priviledge judges and magistrates have that is open to abuse. A judge can only be sanctioned if there is evidence of corruption - such as taking a bribe etc.
One can petition JSC to deal with wayward judges. We are not completely helpless
