Hello, I am an international medical graduate applying for a j1 visa soon. I had a question about the ds 160 application. Last year I has received and subway fine foe fare . It happened by accident as my debit card had stopped working and i had not realised it. I was told it was a civil fine and not a misdemeanor. I have paid the fine and have proof for it. Now I want to know if I have to disclose the fine in ds 160 and what are the chances if rejection. I have a 4 year travel history and it was the only time it happened. How should I proceed ? In general, I would tend to disclose something like this but then explain fully what happened and how it was resolved. I'd also get a certified copy of the court or police record related to this fine. @@pacelawfirm it happened in Manhattan new york city. I was not arrested. I was fined with 21 nyc rr part 1050 4a by the transit authority which is not under new york criminal code. It was a civil violation. I was given a notice of violation and and was not required to go to court. I paid the fine. There is no criminal record. I asked a former visa officer and he said I can mark "no" to the question.

I called the MTA transit bureau and they informed me that the fine paid is recorded as a civil infraction penalty and will be available for US immigration at the airport on their database. So if I do not disose the infraction on ds 160 and get the visa and later, if asked at immigration by CBP will my visa be revoked for misrepresentation and obtaining a visa by fraud?
