    Just pass a law that says that any officer involved in an illegal detainment must pay a $500 fine for their first infraction and $1,000 for each and every infraction thereafter and this will stop. Any and all officers involved in any infraction will have to pay their fines personally.

    The obsession with giving directives is a real issue, the supervisor literally just said "As long as you're not on the property you're fine" and he said "I never go on private property" but that last cop HAD to throw in the "they don't want you on their property" because it's an obsession

      Plus there was no apology from the cop for illegally detaining the auditor, failing to investigate and unnecessarily asking for ID. BUT he couldn’t help himself from having to have the last word with a pointless directive, it must be in their DNA. What a pair of unprofessional clowns.

      I think the problem was that this auditor didn’t (and most auditors don’t) understand what an easement is. A utility easement doesn’t give you the right to be there. A utility easement gives the utility company the right to run their utilities and maintain their utilities. You can absolutely be trespassed from an easement.

      @@mroberts566 He was on the right of way along the road...which he does have the right to be. 33' from center line seems to be fairly common width, I think he said 23' or something. Regardless he clearly was on the edge of the road which IS legal. My property doesn't start till 15' from the back of the curb, no sidewalk. So it may look like people are walking on my yard/grass...but as long as they're within 15' of the curb there's NOT a darn thing that can legally be done. Even though most walk in the street. Many counties now have online GIS data website one can look up property lines. Many falsely believe if you're on their driveway 3' off the road, it's private...it's not regardless if you have to pay for it or maintain it.

    Ive watched over 10,000 civil rights auditor videos in the last few years. I have learned that the actual Law plays no role in law enforcement. Explaining Rights to cops is like trying to teach quantum physics to a park bench.

    DO NOT say you will provide your ID under threat of arrest. You spent the entire video explaining the law, and what you did right or wrong. If you are 100% correct, stand your ground and do not provide ID. All the cops have to say is ill arrest you, and get your ID.

      IF they threaten that, it's a violation if they have no authority to demand it. That gives you Standing to file on without going to jail and having to deal with that. Most of these auditors have educated themselves on what is needed to solicit from the officers to make an effective case. Most officers are so dumb the step in it nearly every time.

      You do not have to be arrested to get the same result, the threat of arrest is a violation of his 4th amendment rights. (Provided he hasn't committed a crime). No need to take the ride if you don't have to. Imo

      I watched a recent video of a kid walking down a dark street detained, accused by the cop of drinking, body cam footage of the two cops stating they didn't smell any alcohol, but he wouldn't identify and asserted his rights, was arrested and detained in jail , cameras there picked up threats to smash his face in and strap him in the chair by the supervising officer, after collecting and cataloging his property, they illegally searched and pulled out his ID, and released him something like 40 minutes later, but he never voluntarily gave up his identity the entire time. The jailer who threatened him and the female subordinate were both fired, and the department is being sued for multiple rights violations. You're exactly right, never give up your ID for an unlawful detention or arrest! They like to use term like "that's a direct order" which doesn't necessarily make it automatically lawful!

    I don't watch many of these videos, but the ones I have seen have convinced me that cops need a serious block of training that teaches the Constitution and what cops cannot, must not ever do, with emphasis on the first and fourth amendments. If that were to happen, perhaps cops might get back some of the respect that they've lost , instead of earning the hate they've had heaped on them.

      Local ordinances are superseded by state laws, state laws are superseded by federal laws, all laws are superseded by the Constitution.
      Seems to me, all you need to learn is the Constitution, as it has supremacy over all other laws.

    There seems to be alot of confusion on what is trespassing or being trespassed. I can walk up to any private home , knock on the door, if they tell me to leave I have to. The camera is just an extention of your eyes, if you can see it you can video or photograph it. Police , if called can only advise you ( order you ) to not go back on the property again, but you committed no crime of trespassing for entering the property in the first place, unless it's posted.

    Auditors be aware, NEVER say phrases like "I'll be honest with you" as you are all ready expected to be honest when you are talking to the PD. When a person says I'll be honest with you, it looks like you have something to hide.

    The local cops and prison security patrol at a Federal Prison where I live pull this crap constantly. Folks only video tape and take camera shots from the EASEMENT which is perfectly legal under federal law. But, as I said before all involved persist on lying until someone shows them the printed laws concerning this.

    This is why I hate private property audits. They don’t know or care about your rights, nor do they need to. They just want to do their job.

    No. They are required to grant him access for the purpose of the easement. That is the part you missed. In this case the purpose is maintenance.

    What they call an "easement" is actually state, county or city property boarding the roadway and the owner of the property boarding that is required to keep it mowed. That is why the property lines don't go all the way to the edge of the road.

      Not always true. My deed goes to the middle of the road. There is a right off way for a certain distance from the center of the road. If the state were to abandon the road, the property is mine by deed. It may be different at other places.

    the biggest lie, is we got a call and we had to come. Tens of millions of calls for service go unanswered every year.
    The easements is a tricky area, as in many, many cities you do not own that property. If you think you own it, then plant something like a tree on it. Essentially many local courts have basically agreed that the easement is no longer the properties owners because of all the restrictions as to what you can do with it. Because if you own it, then if it is legal to plant sticker bushes in your yard, then by gawd you can plant them on your easement, but you can't.
    . It varies a lot from place to place. In my old home town you did not own from the sidewalk to the street but you were obligated to take care of it. Because if you let the grass grow they city cited you. I know all this as the head of the cities maintenance dept used to tell us the stories of the folks fighting against it. My favorite was the guy that got into trouble so many times for not cutting his grass that he threatened to blacktop it, but they drug up something about it greenery but no shrubs. So he blacktopped it and painted it green.

      Not trying to be disrespectful, but you clearly do not understand private property law. Especially the parts of it pertaining to public easements, rights of way, and eminent domain. Your own words in your comment contradict themselves. I would like to know which local courts have agreed that the easement no longer belongs to the property owner because of the restrictions. And your anecdote about green blacktop sounds like a tall tale or what is known as an urban legend, like the one about alligators living in New York sewers.

    awesome supervisor. they didn't understand the whole easement issue but overall, very professional police. gj all the way around. that officer was not offended when he asked for a supervisor, just a yes sir let me get one. he didn't get offended like a lot of them do.

      He also doesn't understand what a trespass is, you have to refuse to leave when asked inorder to be criminally trespased. The cop can't unreasonably detain you, then claim you refused to leave while being detained. And without evidence or a confession, they can't just escalate straight to a trespass by taking the property owners hearsay that he was on and also refused to leave the property. A good police interaction by an informed oath respecting officer would have been a quick "Hey! You aren't wanted on that persons property, if you get caught in it now that I've informed you, you will be criminally trespased" "Haven't left public property yet and have no intention of doing so in the future" "sounds good citizen, have a nice day" interaction over
