Fentanyl Trafficker in Stolen Mercedes Benz Leads FHP Criminal Interdiction Units on Wild Chase

On 01/11/2024, at approximately 2:16 PM, I, Trooper Zigler ID# 604, a member of the Florida Highway Patrol's Troop D Criminal Interdiction Unit (CIU), along with my CIU team members Trooper C. Wademan ID# 1116, K-9 handler, and CIU Sergeant J. Diaz ID# 226, were actively patrolling in the area of Old Canoe Creek Road and Kissimmee Park Road within Osceola County.
Troop D consists of the following counties: Brevard, Lake, Orange, Osceola, Seminole, and Volusia.
I, Trooper Zigler, have been assigned to the CIU as a "Felony Officer" for five years. The mission of CIU is to increase the effectiveness of the Florida Highway Patrol in the detection of crime and the apprehension of criminal offenders on the highways of Florida. I have received additional training on criminal behaviors and detection of possible criminal activity.
I, Trooper Zigler ID# 604, observed Sergeant J. Diaz attempting to conduct a traffic stop on a white Mercedes Benz SUV with a Florida temporary tag DVS2817, which did not match any vehicle. All police vehicles were fully marked with overhead light bars and FHP insignia. The vehicles had their overhead blue lights on, clearly identifying them as law enforcement officers.
The vehicle fled the traffic stop recklessly, leading Sergeant Diaz, Trooper Wademan, and me to pursue. During the pursuit, the suspect drove at speeds over 100 miles per hour, sideswiped another vehicle, drove on the shoulder, and ran multiple red lights, endangering the lives and property of the motoring public.
I, Trooper Zigler, took over as the primary pursuing unit. I observed the vehicle traveling at over 100 miles per hour in a 45-mile zone and called out on the radio. The vehicle failed to negotiate a curve, crashed into two vehicles, and traveled off the roadway.
I called out the crash and drew my state-issued service weapon on the crashed vehicle. The windows were too dark to see inside. I gave verbal commands, and the driver, identified as Jonathan Nicola, complied. In the driver's door pocket, I observed a digital scale and numerous small baggies, consistent with drug sales. Nicola was the sole occupant of the vehicle.
Nicola was secured in handcuffs and stated there was a gun in the vehicle. He was detained in the back of my patrol car until emergency medical personnel could treat him for possible injuries.
Trooper Wademan arrived and had his K-9 inspect Nicola's vehicle, which gave a positive alert for narcotics. A probable cause search of the vehicle was conducted, and the following items were located:
- A digital scale and numerous clear plastic bags in the driver’s door
- A 9mm gun in plain view on the rear passenger seat
- A box containing approximately 10,000 to 20,000 pills, presumptive tested positive for Fentanyl, packaged to mask the odor of narcotics
The vehicle was confirmed stolen from Lee County on July 2, 2021. The temp tags were fake.
The defendant, Nicola, had a Florida ID card and several credit cards belonging to other individuals, indicating possible additional criminal activity. Nicola was a habitual traffic offender.
Nicola was arrested and transported to the Orange County Jail without further incident. All events occurred in Orange County and were recorded on in-car video camera.

Well depending on how the phone was manipulated he could be correct on his rights being violated. Law enforcement need a warrant to go through your phone that is to unlock it and look in it. If a message comes across on the lock screen and they can view it nope nothing violated. However i believe he is just grasping at straws here to find something that will deadin the other charges and possibly get them thrown out.

Police don't need warrants when they have reason to suspect a crime is being commited. This applies at least to homes, not sure about phones, but in a situation like this the police might not even need a warrant to go through his phone.

For the most part people at least stop or try to move over. When high-speed chases like this come up out of the blue, it can take a few seconds to figure out what’s going on and how to respond - such as how best to move out of the way. Not everyone is a clueless and careless idiot.

I understand these troopers are driving through traffic very fast, maybe faster than a majority of folks to react to, but the general lack of situational awareness by other motorists is astounding.

Looks like the fentanyl on its own carries a mandatory minimum of 25 years plus all the others which carry varying guided sentences rom probation through to life although cannot see him getting life for possession of a gun. Hopefully the state doesnt allow him to plead it down too much and he gets locked up for the next 25 or so years.
I even sent a message to Governor DeSantis…Once a perp is lit up the tracker begins counting and for each 1/10th mile of felony evasion gets a additional month added to the “hard labor” sentence.

Everything involved in the crimes he committed can be seized without a warrant.

California in 2014, which established that cell phones are not subject to the same immediate search exceptions as other personal items.

Edit: Checked County Records, he was released on own recognizance by Judge Vincent Chiu. However, was sent to jail 3 weeks ago for just failure to appear.

It’s my single biggest frustration when driving on the highways. There’s always that one idiot barely doing the speed limit in the left lane, matching speed with the trucks in the other lanes with a line of 20 cars behind them trying to get by, which causes more accidents when frustrated drivers make aggressive passes.

It takes a police vehicle with lights and sirens using the left shoulder at high speed for people to MOVE OVER.
At those speeds they are out running the sound of their sirens and the people have less than a second to react and you would be no different if you were on the road there at that time.

After searching the car some more, troopers found a loaded 9mm handgun, drug paraphernalia, and a box containing a clear vacuum-sealed bag containing 15,000 Fentanyl pills made to look like Oxycontin.
The car was also discovered to be stolen out of Lee County with a fake temporary tag and cloned VINs on both the door and the window.
Nicola was taken to the Orange County Jail without bond and charged with the following:
Trafficking in Fentanyl 4 Grams or More-Felony
Synthetic Narcotic Manufacturing Schedule I or II-Felony
Possession of a Controlled Substance Without a Prescription-Felony
Possession of Drug Equipment/Paraphernalia used to Manufacture/Transport Drugs-Felony
Grand Theft of a Motor Vehicle-Felony
Possession of a Vehicle with Altered Numbers-Felony
Weapons Offense-Use/Display Firearm During Felony-Felony
Flee/Elude Police-Aggravated Fleeing with Injury or Damage-Felony
Moving Traffic Violation-Reckless Driving with Damage to Person/Property-Misdemeanor

To all those criminals out there: a cop doesn't need a warrant if he has probable cause to believe that evidence of a crime is present. Like, you know a phone belongs to a drug dealer.
You can't call him a drug dealer because he is innocent until proven guilt in a court of law. We know he is, but he has rights. BTW he knows his address, but doesn't want to give it because the cops will find even more drugs there. Not a lawyer, but brief Google search suggests that some circumstances allow police to both seize and search your phone. In this case, a fleeing suspect with a long list of priors who is in procession of narcotics left his phone unlocked at the scene and any contacts, gps, messages or otherwise may be vital to the investigation. That is the same reason they are free to search the car and seize anything found inside and use it as evidence.
