- पटना : है तो पुराना, लेकिन अब ये आडियो वायरल हो गया है. नालंदा का है. निकाय चुनाव के पहले का. मामला शराब की जब्ती से जुड़ा है. जिलाधिकारी एस एम त्यागराजन एक थानेदार को फोन कर रहे हैं. उधर थानेदार के फोन में यह कॉल रिकार्ड किया जा रहा है. बाद में यह रिकार्डेड आडियो वायरल हो जाता है. अब बताने की जरुरत नहीं कि नियम से कॉल रिकार्ड करना गुनाह है. पर अब कोई किसी का भी कॉल रिकार्ड कर लेता है. थानेदार जब डीएम का कॉल रिकार्ड कर ले,तो बात बड़ी जरुर हो जाती है.th-cam.com/users/livecities

Investigation is needed, DM is concerned that an innocent should not be published, and Police ka bayan is not accepted for lodging FIR. DM is right that investigation should be done and mere recording is not taken, as Video can be recorded under pressure also

क्या गलत बोला है DM ने , वह सिर्फ यही बोल रहा है कि क्या पुलिस को डायरेक्ट FIR करने का power है और DM यह भी कह रहा है कि चुनाव की वजह से यह भी हो सकता है कि एक पार्टी किसी का नाम खराब करने के लिए भी कर सकती है तो इसका इन्वेस्टीगेशन करके FIR करना चाहिए। क्या गलत बोला है DM ने ?

Officer is absolute right....police can take FIR at the instance of its own police officer if the offence is cognizable in nature as golden rule of criminal law is that criminal law can be put in motion by anyone not necessary that it has to be aggrieved person only and thereafter police can go ahead with investigation by recording statement of witnesses u/s 161 of 164 of Cr.p.c. And collecting evidences and finally filing of charge sheet

Dm is wrong in the sense that how thanedaar can file FIR without investigation. During complaint the first and formost action taken is to file an FIR and then do investigation. After investigation if a complaint is found to be true then the further processing is done on the FIR case or if complaint found to be flawed then FIR is quashed. SHO is right on his side. Further, i don't know whether DM is under pressure or not but i am sure that he doesn't have his basics cleared while preparing for upsc.

DM is clearly overstepping his authority ; he is admin he cannot tell what to do to cops . Secondly as per law if such a large stock of liquor is being stored by someone at home without liquor licence it is an offence . It doesn’t require investigation to file fir . People in india need to understand laws first
First of all u need to understand, that he is DM means having powee of executive Magistrate. He can order to write FIR, arrest, lathicharge, police fire, under CrPC. So first u should know law before speaking anything
