भारतीय न्याय संहिता (बीएनएस) की धारा 20:
“कोई बात अपराध नहीं है, जो सात वर्ष से कम आयु के बालक द्वारा की जाती है"
Section 20 of The Bharatiya Nyaya Sanhita (BNS):
“Nothing is an offence which is done by a child under seven years of age.”
Children are one of the most valued assets of the future generation who are required to be protected. Recently, there is an unprecedented increase in the juvenile crime rate. This is due to many changes such as behavioral change, lack of education, subjugation, upbringing environment, harassment, lack of parental care, sexual indulgence, violent treatment, poverty, and the advent of modern lifestyle. Shrewd criminals indulge children in criminal activities especially, the ones between 7-12 years because at this point minds are innocent and can be easily manipulated as well as lure them to the world of crime. However, children below 7 years cannot be held criminally responsible for an offense because of a lack of understandability and are known as “Doli Incapax Maxim”.
बच्चे भावी पीढ़ी की सबसे मूल्यवान संपत्तियों में से एक हैं जिनकी सुरक्षा करना आवश्यक है। हाल ही में, किशोर अपराध दर में अभूतपूर्व वृद्धि हुई है। यह व्यवहार परिवर्तन, शिक्षा की कमी, अधीनता, पालन-पोषण का माहौल, उत्पीड़न, माता-पिता की देखभाल की कमी, यौन भोग, हिंसक व्यवहार, गरीबी और आधुनिक जीवन शैली के आगमन जैसे कई बदलावों के कारण है। चतुर अपराधी विशेष रूप से 7-12 वर्ष के बच्चों को आपराधिक गतिविधियों में शामिल करते हैं क्योंकि इस समय दिमाग निर्दोष होते हैं और उन्हें आसानी से बहकाया जा सकता है और साथ ही उन्हें अपराध की दुनिया में ले जाया जा सकता है। हालाँकि, समझ की कमी के कारण 7 वर्ष से कम उम्र के बच्चों को किसी अपराध के लिए आपराधिक रूप से जिम्मेदार नहीं ठहराया जा सकता है और इसे "डोली इंकैपैक्स मैक्सिम" के रूप में जाना जाता है।
The Bharatiya Nyaya Sanhita is the criminal code of the Republic of India. When it entered force, it replaced the Indian Penal Code enacted in 1860. The BNS covers all aspects of criminal law, including offenses, punishments, defenses, and procedures.
भारतीय न्याय संहिता भारत के लिए प्रस्तावित एक नयी न्याय संहिता है। यह एक व्यापक संहिता है जो वर्तमान भारतीय दंड संहिता, आपराधिक प्रक्रिया संहिता और साक्ष्य अधिनियम का स्थान लेगी। 11 अगस्त 2023 को भारत के गृह मंत्री अमित शाह ने लोकसभा में भारतीय न्याय संहिता विधेयक, 2023 पेश किया।
