According to Austin's perception, a determinate human superior is a sovereign. Remember this is Austin's perception. What the books have mentioned is also correct but the topic might be essential elements of the state. Population, territory, sovereignty and government are the 4 essential elements of the state. As sovereignty is also an essential element of the state, state is considered to be as sovereign.
The video is very confusing. He was the first to derive the concept of sovereignty. Then how it is said he was influenced by Thomas Hobbes theory of legal approach ? What was this legal approach, you should also explain it. And tell if this theory talk about sovereignty?
1. Thomas Hobbes passed away 111 years before the Birth of John Austin. 2. John Austin IS deemed to be as the father of Modern theory of sovereignty. Later on many modifications were made in the theory of sovereignty but the first formal written theory of sovereignty was made by John Austin. 3. Thomas Hobbes legal approach: Law is what the sovereign commands. This is sometimes known as the doctrine of legal positivism. Law is the command of the sovereign. Sovereign (King) can do no wrong. [the modern concept of democracy was absent in Thomas Hobbes' period] 4. Even though Austin's theory is inspired from legal approach of Thomas Hobbes, he mainly criticizes the theory and rejects the legal positivism. But Austin is inspired by the concept of sovereignty in the theory of Thomas Hobbes, he is discarding his remaining theory.
You can say that in a way. Hitler gets close to the concept of determinate human superior. But Hitler had some rivals of equal status. Some were within his Nazi Party i.e. Herman Goring, Joseph Goebbels, Rudolf Hess and some were outside i.e. the Communists in Germany. Determinate human superior should not have any rivals of equal status. That is he should be accepted by majority of the society. The determinate human superior is the only lawmaker. His commands are laws and without him the state can have no laws. The determinate human has no rival of equal status in the state and nor does he obey the order of anyone. The power of the determinate human superior is sovereignty.
Bro then why here is model auxiliary "can" used .I think there is possiblity that he may or may not be economically , financially and physically strong.
1 question arises, aap human superior ki baat karte ho aur example apne bhagwan ka dete ho? Bro human superior ka matlab toh samjho na pehle... Ya aap apne bhagwan ko ek insan maante ho aap... Almighty can't be a human... Shiva ka example is ok i agree aapke Nazar mein woh human superior hai...
I've just mentioned an example from my perspective. You can always give the examples of determinate human superior as per your knowledge and belief. If you want truly human examples you can give examples like:- G.D. Birla (Business), FDR, Churchill (Politics), Albert Einstein, C. V. Raman (Science), Mahatma Gandhi, Nelson Mandela (Social reformers), Tagore (literature)
Those person who are powerful or having supreme power in society . Strongest tribe are termed as determinate human superior. It’s like monarchy form of government. This theory of sovereignty is not accepted in modern times because now human wants equal liberty not like ancient time when there used to be monarchy based government System.
