    You can’t copyright a widely used progression of chords. It would stifle creativity in the music industry.

      🖼🎼 ~ I don’t know anything about music but an example that came to my mind is a painting. If one person paints a landscape can you copyright that picture for every other landscape created around the world? Or same thing with a portrait of a human. But that’s take it a step further, if you use the color green in your painting of a person based on their clothes, can nobody else use the color green in any type of painting even on a completely different subject? Just because you use green because someone was wearing a green coat, now nobody else can paint a painting of a greenhouse or the grass?
      And I say this because, As I remember, there’s only 12 individual notes that are mixed up in different orders to make songs. Well there’s not many more than 12 individual colors.f

    My mother is a musician and growing up she always said as long as you learn these 4 Chords you can pretty much play anything. These people are reaching and quite sad.

      Yes. But… one of the way intellectual property monetizes is through infringement (and subsequent lawsuits). They are just doing what they right to do. People who don’t have a whole lot of $ are not going to be getting sued because they target people who have have had great success monetizing their intellectual property.

      @@thomasdickson35 Both. If you have someone that capitalized on your idea but they are broke, there is little point in suing unless you like wasting money. They won’t be able to pay out once you win your case. And if they have money, but didn’t make much money using your idea then there is also little reason to sue since since your claim is not very large and you won’t be able to get your hands on their money. You want someone with money that was successful making a lot of money on your idea for a lawsuit to be worth it.

    The "Thinking Out Loud" singer argued that the trial was a threat to all musicians who create their own music. As a singer / songwriter myself.... YOU ARE ABSOLUTELY RIGHT ED ! This lawsuit (to put it mildly) is DUMB ! Glad you won the case! Thank YOU for your talent ! ! ! ! ! ! ! ! !!

      They got The Roots like that for that Blurred Lines song....and actually won the case....the only thing similar was the aesthetic of the track other than that...case was closed for me....
      Again love me some Marvin and I'm sure if he were alive this wouldn't be an issue to him....glad they didn't get to put Ed in the same trick bag

      @@BlackBerryJones That’s just the way the law works. One of the way intellectual property monetizes is through infringement (and suing). It is very lucrative and can make way more money than you ever did with a lifetime of writing songs. It is no surprised that the songs that make the most money get sued more. But another way to look at it is that these people are making a whole lot of money from copying something from the little guy. Would you like it if someone went on to make millions of dollars from copying the music or the words or the design associated with a song you wrote without paying you anything? It’s not a great system, but it is a system that goes both ways.

      @@jilpok1074 Here it goes beyond that, the family of the songwriter saw Sheeran as a cash cow, and were likely scouring the radio to get hold of a suitable prey, that is one famous enough and ready to settle outside courts to avoid bad publicity. I'm glad Sheeran kept his cool because the songs are not similar even in a remote way. Bad luck, maybe next time they will reel a big fish.

    I’m a musician. I have played guitar for over 20 years . And I can tell you that I can use the same 4 chords to play over 30 different songs. There’s only so many chords you can play . So you got to be creative with the rhythm

      The lawsuit isnt about the chord progression its about the arrangement. Same bpm. Lifted 1/2 step. Bass, drums and pads are almost identical. Sheeran's a goner

    I’m a musician. Those chords are very common among chord progressions. It’s up to you how to create a certain melody or rhythm to it.

      They are deciding on information presented in court. Any outside knowledge can actually be detrimental because you would have your own ideas and opinions that may not relate to the trial at hand. That's why they get experts to come in and only speak to the jury on specifics related to the case. Most jurors probably don't know anything about killing someone in a murder trial either.

Melody, instrumentation, and musical structure are also important and in this case those other components are not the same.

    There are so many chords, so many notes and so many patterns of them that are pleasing to the ear. It is bound to happen. I always loved the lyric where Pink Floyd said, "...and When the band you're in starts playing different tunes, I'll see you on the dark side of the moon." Also, as someone who can hear different songs, when I hear a song, I have never heard Marvin Gaye once when I have listened to that song. To me, they are completely different.

    I feel for Ed on this one. A bunch of people who aren't musicians and know absolutely nothing about writing music trying to tell you (a professional musician) how music works. I would lose my damn mind. There are only so many time signatures and so many chords and scales. Almost every song on earth is inspired by another song

I was sued back years ago for something I genuinely did not do and the girl blatently lied on the witness stand along with her friend. I HONESTLY was innocent BUT truth doesn't prevail it's literallly whatever idiot is on the jury that just makes the final decision even if it's completely wrong and unfair. I ended up losing the case and had to pay money even though I sware I was innocent. This was 20 years ago. I really hope Justice will prevail in the end it's up to God in the end these "jury's" are not God and should not be making decisions that can destroy someone's life just based on their personal inaccurate opinion that probably they could care less about they just had to serve "jury duty" .

If you could sue just because one phrase sounds slightly similar at one section in the song that would result in endless lawsuits as I'm sure there are many songs with similar musical phrases but not identical, like you already pointed out. To be honest I'm familiar with both songs and after all the times I listened to Ed's song I never once even thought of Marvin's "Let's get it on" song being similar until this law suit came up.

    I love the fact that they played the four cord song by axis of awesome. I use to use that to show my friends how easy it was to play once you know some basic chords; it convinced some to follow through with learning to play guitar

    This is crazy. "Thinking Out Loud" sounds nothing like "Let's Get It On."
    Take a look at Megan Trainor's song "Dear Future Husband" and Olly Murs song "Dance with Me Tonight." You can practically play the sheet music for either one of those songs and sing the words to either one and they fit perfectly. No one took the other to court and their songs are very close.
    Marvin Gaye's song, "Let's Get It On," which I've listened to since I was a little kid, and Ed Sheeran's song, "Thinking Out Loud," which has never ONCE made me think of "Let's Get It On," are both songs on my top favorites the moment I heard them.
    It sure seems like someone is trying to make some money off of someone else's work.

    I love how Ed just starts doing a whole music theory lesson in court. It’s just stupid to me that this is even a lawsuit 😂 One, the songs don’t sound that similar and two, there are tons of songs that sound super similar and there’s not always lawsuits for those. Go Ed!

    There are 17 root notes on a guitar. So at most, it'd be only 17^4 = 83521 unique ways to make a four-chord progression, even counting progressions where it's just the same note four times. There are around 1.6 million songs produced every single year.

    G, D, D7, C... this is the most common cord used by musicians. They can change the rhythm or progression, it is still the same cords. That's the beauty of music.

As for cover musicians, if a cover tune is played in any venue, the venue pays a royalty to the performance rights company that monitors that particular song (BMI, ASCAP or SESAC). As for street musicians...not it a venue, so it doesn't apply (not to mention, really shallow pockets).

      It's not just the chords. If you're curious, Beato has a great video on the similarities. Sheeran may have written the song on the guitar without trying to copy Marvin's song, but his producer used almost the exact bass line, drums and pad. Sheeran will lose.

    A similar thing was done by Credence Clearwater Revival v John Foggerty between two different songs. Interestingly, both songs on this John's trial were written by him, so it was a little easier for John to explain on the witness stand.

    Well, I'll tell ya folks, my wife was seventeen when we met and Lets "Get ot On" was very much still being played and of course it was somewhat a theme song for young lovers. Now that we are almost 70 years of age, together for most of our lives, Eds song is very appropriate to us. Are they similar - yes, as many songs are. The difference is they are collective in a beautiful sequence representing lovers, from beginning to end, who experience that wonderful longevity most will never get to understand.

    i wrote a paper for my statistics class in university and showed how a lot of songs use the same chord progression across multiple musicians and genres (classical, country, pop, rock, hiphop, ect.). We found that the same 4 chords were used but styled or tempo differently in each song.

    This whole thing, as most people know is completely ridiculous. Each artist presents their own song in such a unique and meaningful way. Marvin and Ed are both very good at what they do and wonderful performers. That should be their legacy. This just appears to be another example of only in America and a money grab from some very greedy people, or people with SOOO much money they simply have nothing better to do, which is very sad, considering how many people are starving and suffering across the globe.

    If there are only 12 chords in music then there is only 2401 possible 4 chord progressions. I have over 400 songs on my phone. If every song had a different progression then I would have 1/6 of the world's songs. I'm sure Marvin Gaye copied the 4 chord progression from someone else

    Gaye's song is a I iii IV V progression. Ed's is a I I6 IV V. Sure the I6 is like a play on the iii.
    But so many major progressions start on the I and end on the V for that smooth resolution. IV leading into V is always super common. The inclusion of a minor adds character and the iii sits right on the major third of the key and being the prime choice, but rather than stick to convention he spiced it up with a I6, D/F#.
    I don't have any problem with the progression. But it's timing of the chord changes are equally on point. So it's fundamentally the same chords played in the same timing. Not an uncommon timing though.
    However, that's just the underlying progression of the verses and everything else is uniquely different. This case is pretty frivolous.

      What about the bassline, exactly the same, same timing? What about the kick, same pattern ? The hi-hats, same? And the arrangement? It's not that Ed took the sheet music and copied it, but probably had the Gaye song in his mind without realising it...

      Whole thing is ridiculous.. note it's not Marvin Gaye's estate making the claim, it's the estate of the co-writer who don't sound like they have a musical bone in their collective bodies and are just out for a quick buck.
      Let's hope the court makes the best decision for music and throws the case out promptly.
