    I refrained myself from commenting on Part 1 because I wanted everybody to see the full story before I do so. It is really disgusting in my opinion.
    Actions I will be taking - Request the police to review the footage by attaching the videos.
    Asking for help - How can I escalate this with the Fire Brigade? Surely, they must be held accountable if they have any Code of Conduct. Lying to the police and covering up an assault & battery must not be in accordance with that Code of Conduct.
    There were just failures on so many levels:
    1. Stupid, ignorant and aggressive members of the public
    2. Lying London Fire Brigade and covering up a crime
    3. A joke investigation by the police and they were not even interested in looking at my recording. They took the word of the fire brigade as golden.
    This is what the tax payers money are going for! Disgraceful!

      Adapt this Letter Before Claim:
      We have been instructed by the above-named client to claim damages in connection to an incident that occurred on the xxxxxx xx at around xpm at the Claimant’s address - xxxxxxxxxxxxxxx
      This matter has not been subject to an investigation by either the Professional Standards Department or the Independent Office for Police Complaints.
      Incident
      On or around xxxxxxxxxxxx, an allegation was made against the Claimant for damaging property outside of his home. Subsequently, he was arrested and handcuffed for Criminal Damage.
      The Claimant was taken to xxxxxxxxxx Police Station and detained. During his hold in custody, he suffered with a seizure which was not recognised by the Police Officer’s until 30 minutes later. He was then taken to xxxxxx Hospital.
      The Claimant was transported back to the Police Station and held for 24 hours without interview. When the Claimant was released, he was informed there would be no further action.
      Liability
      False Imprisonment
      We do not consider that:
      a) The arrest was founded upon reasonable suspicion that the Claimant had committed an offence or was about to commit an offence. Considering the decision of the Court of Appeal in Castorina v The Chief Constable of Surrey (1988) Lawton LJ held: ‘Suspicion by itself, however, will not justify an arrest. There must be a factual basis for it of a kind which the Court would adjudge to be reasonable’;
      b) The information, which was in the mind of the arresting officer, warrants the opinion that there were reasonable grounds to suspect the Claimant’s involvement in the commission of a criminal offence;
      c) Your Officers did not have objectively reasonable grounds in this case. Whilst the bar for establishing reasonable grounds for suspicion may be low, ‘it is not non-existent’;
      d) The test of necessity to arrest was met as required by S.110(4) and 5(a-f) of the Serious Organised Crime and Police Act 2005) and in considering the cases of R. (on the application of L) v Chief Constable of Surrey [2017] EWHC 129 (Admin), [2017] 1 W.L.R. 2047, [2017] 1 WLUK 623; Hayes v Chief Constable of Merseyside [2011] EWCA Civ 911, [2012] 1 W.L.R. 517, [2011] 7 WLUK 934; Richardson V Chief Constable of the West Midlands, 2011 WL 1060148; MR v Commissioner of Police of the Metropolis Queen's Bench Division - [2019] EWHC 1970 (QB
      e) Your Officers demonstrated a rational justification for rejecting an alternative to arrest. Your Officers are subject to a high standard of accountability in the “uniquely momentous” operational decision to summarily deprive a citizen of his/her liberty. The Claimant relies upon Reay and Sherlock v Chief Constable of Northumbria Police [2020] EWHC 3246 (QB);
      f) Your officers sought cooperation from the Claimant, negating the existence of reasonable grounds for believing that it was necessary to arrest. The Claimant relies upon Rashid v Chief Constable of West Yorkshire Police [2020] EWHC 2522 at [90];
      g) The actions of your Officers amount to false imprisonment and the right to freedom of movement without fear of arbitrary arrest or detention is a fundamental civil liberty. The Claimant relies upon Warner v Riddiford (1858) CB(NS) 180.
      h) The lengthy period of detention was proportionate to the seriousness of the alleged Offence
      Assault/Battery
      We consider that:
      a) The use of force upon the Claimant (handcuffs etc) was unlawful and constituted Assault/Battery.
      b) The use of force was unlawful in the consequence of an unlawful detention and subsequent arrest of the Claimant. Alternatively, the use of force was wholly excessive in the circumstances.
      c) Your Officers handcuffed the Claimant constituting an assault/battery and trespass to person. The fundamental principle of the tort of battery is that everybody’s person is inviolate and even the slightest touching of another person may amount to a battery as set out in the case Collins - v - Wilcox (1984);
      Value of the Claim
      As a result of the incident the Claimant claims the following:
      a) False imprisonment;
      b) Assault/Battery
      c) Injury to feelings;
      d) Pain, suffering and loss of amenity including stress, anxiety, paranoia, and embarrassment suffered by the Claimant;
      e) Special damage;
      f) Aggravated and exemplary damages;
      g) Apology.
      Response to the Claim
      In accordance with the Practice Direction re Pre-Action Conduct, please provide a prompt acknowledgement of this Letter of Claim within 21 days. As you will be aware, the Practice Direction envisages that for many claims, a normal reasonable period for a full response may be by three months.
      Unless you/your Client accepts the entirety of this claim, please set out in your response the reasons why the claim is not accepted, identifying which facts and which parts of the claim (if any) are accepted and which are disputed and the basis of that dispute.
      Pre - Action Disclosure
      Finally, as is the standard procedure for claims of this nature, we request pre-action disclosure of the following:
      CAD Log;
      101/999 Call Logs;
      Incident Reports;
      All video footage (including CCTV, Body Worn Video, Police footage and any other available footage) showing relevant events;
      All CCTV footage showing the Claimant at the police station;
      Full and complete copies of the custody records and detention log;
      All records disclosing the basis for the Claimant’s detention;
      Search form;
      Pocket notebooks/contemporaneous evidence of the officers involved;
      The audio tape and the accompanying transcripts of the Claimant’s taped interviews at the police station;
      All notebooks and/or statements and/or other contemporaneous accounts prepared by officers involved in the events (e.g., the arrest, detention, use of force on the Claimant);
      Any CRIS reports (or local equivalent) in relation to the Claimant’s arrest;
      All MG documents created by police officers in the course of the events;
      Any and all substantiated disciplinary and/or criminal allegations against officers who are to give evidence in the proceedings on behalf of the Defendant;
      Settlement and Alternative Dispute Resolution (ADR)
      In accordance with the above-mentioned Practice Direction, Court proceedings should be a last resort as ‘the parties should consider whether some form of alternative dispute resolution (ADR) procedure might enable them to settle their dispute without commencing court proceedings’.
      Although ADR is ‘not compulsory’, the Court ‘will expect the parties to have considered ADR’ and ‘a party’s refusal to engage with ADR (including its failure to respond to an invitation to participate in ADR) might be considered unreasonable by the Court and could lead to the Court ordering that party to pay additional costs’.
      The Claimant confirms that they are willing to engage in without prejudice discussions, negotiations, mediation and early neutral evaluation (ENE). It is for you to decide whether you wish to agree to the same too.
      Costs
      On the basis of a successful recovery, we will be seeking costs for the Claimant on the standard or indemnity basis as appropriate.

    I expect this from the police but not the fire brigade, absolutely disgusting liars!
    Take this further, and find out which station these particular stations these fire fighters are from. I've always had respect for the fire service, but this lot should hang their heads in shame.
    They should be prosecuted for perverting the course of justice.

    Right mate, I'll give you advice, back up that video up to your computer. Send a Freedom of Information Request to the fire brigade, basically asking if firefighters at the scene of a crime are allowed to make false statements to the police. Within that FOI request, ask for the station those appliances are based at, their area, and where their area HQ is. Listing their number plates, and the night may help. If you can see their callsign, or the nameplate on the side with their station, that will also help. I believe the police officers said where they're based as well. Whenever you get the reply, with your information. March down to that area HQ, with that footage, and ask to give that information to the officer at that station/area HQ. at 30:38 I can clearly see that the callsign on the appliance is Alpha 501, include that in the FOI request, it will help. Then do the rest of the police shit, if you know what station they attached to, report it at that station, if not, just a general MET Police station can help you. Their shoulder letters were CW, which identifies the station I think.

    Fireman saying he called the Old Bill & collaring the OB, leading the copper away so he could could diffuse the situation and give a cover for the lad who did the fireman’s dirty work. It’s not hard to pull all the details together. The Fireman gave his name, number & station ~ Shoreditch they are attached to. The 1st copper gave her collar details. Job done. Watch over it again & it’s all there for You.

    The lady at 16:55 witnessed the attack. She was the one who stopped the attacker when you went down onto the floor. You can see her smirking as you ask who witnessed the attack?!!     The disgusting thing about the behaviour of the people who witnessed the assault is they somehow seem to think it is justified. They have managed to get so distorted that they think filming is illegal but assault isn’t.

    Hi I A G C, this one starts with a violent encounter with people who think they can invent their own laws! and can attack citizens in the street, while this is the sort of thing that does happen here because of the appalling lack of good public information and reliable legal advice. That however does not justify or excuse this sort of behaviour and the abject failure of the police to deal with it properly compounds the problem, This episode alone fully justifies all the sterling efforts of all the Auditors up and down the country who not only draw our attention to these transgressions but also call these tyrants to account.
    The clear and sensible way you report this incident on the telephone embodies everything we could hope for in the way of clarity accuracy and calm rational description. Combined with the footage from your camera this must be enough to support a proper investigation and probable prosecution for the assault, failure to do that can only be laid at the door of the police involved.
    For us it is bit of a shame that we cannot hear what the other end of the 'phone call is saying but I am sure they have more than enough to go on.
    Hardly ten minutes after it happened they turn up and I call that rapid response!, so far so good.
    The pleasant enough police woman asks you what happened, you tell her straight and simple.
    After three minutes one of them starts to ask for your name, he does not explain why he needs that information not does he explain that you do not have to tell him!.
    At seventeen minutes the fire brigade officer who first told you not to film him then denies being a witness to the assault, I am not sure that it is the brigade that is responsible it is just that deluded individual who is so dedicated to his prejudice that he will not take responsibility for the justice that he would expect in similar circumstances.
    The stupid ignorant cop comes back and tells you that he has been given a pack of lies that he is happy to accept and then tries to bully you into leaving, he has no right to do that at all!, to be getting in the way of them at their work you have to get between them and what they are trying to do.
    I honestly do not know exactly what you can do next but I am sure this video will get a good deal of exposure and that fire brigade team will be getting more audits!, at the same time all the people actually involved will know what really happened and who did what and what they did or not do to cover it up, this will not correct them as it should but it will linger in their n=memories and they won't feel good about it, that will show in the ways they justify themselves to each other.
    Well done for enduring such dreadful treatment and describing it all so calmly!, Good work.

      One thing to note is that the dispatched told me that it would take to the police between 15 and 60 mins to attend. A police van was passing by and waved at it, that is why the response felt so rapid.

If no one seen the incident then you either have been in the building with them or messing with the fire engine to be obstructive🤔 strange when your laying on the pavement opposite the gated entrance, did you telle port over.     The fire service have always been seen as t he e caring respectful service but they proven to be no better than the police in not helping this gentleman who was doing a legitimate activity, I'd make sure they are reporting for failing in their duty of care, let's hope none of you need a member of public to help you sometime.

    Firstly... What is the purpose of your videos? I completely agree with the police officer, who mentioned the stress of the person evacuated due to a fire; how would you like having a camera pointed in your face post incident.
    The purpose of your videos is purely to antagonize and provoke public service workers, to then complain when they ask you respect their privacy by not filming. If you turned up and did an audit and had no response and we're welcomed with open arms; that wouldn't exactly make for an interesting video would it?
    I understand that you are right - it is your legal right to film, but whatever happened to common decency; they asked politely not to have their faces shown.
    How about you show us your face? Leave us your full name? Really... you were lucky you truly didn't get "battered".

    Make a formal complaint against the fire crew as it was one of them who moved the man who attacked you also show the full video on social media report that cop as he hadn't asked to see your video footage of the assault

    Is everyone just going to bypass the fact that this guy was getting in the faces of victims and being obstructive to the people who are just doing their jobs? Would you record a restaurant server without their permission? Would you go up to a victim of a violent crime and start behaving like this? While I can’t condone the violence, the circumstances are not ideal either. Why was this guy even filming the scene of an active incident?

    I can understand why you are upset, this incident needs a full investigation. Going on your video evidence I believe the chap in black who did not want to be filmed actually passed your camera walking away so missed the assault, however the very plain looking female in the red top and another unidentified male in khaki defo witnessed the assault. Please take this further and best of luck

    Why are you assuming that these firefighters lied? You can clearly see they were all busy, heard something going on and then turned around seeing the aftermath, so how have they lied? (Rhetorical question as I don’t even care for your response) They didn’t witness anything happen in that moment so how that is lying ?
    And the police did exactly what they should have done, they turned up and defused the situation. No one was there to arrest or tell off. End of.
    If someone pushed someone over they probably deserved it from what I can see watching this video, the man was nothing but a nuisance; and all those firefighters and that couple look so uncomfortable with that camera following them around. Harassment comes to mind.
    You are all so mind numbingly stupid to agree with this fake journalist who is clearly just seeking attention and stoping people trying to do there jobs.
    As for saying firefighters aren’t working and just standing around; they obviously were working for the entire 30 minute video which is why this idiot could get so close to the fire engine which he clearly shouldn’t have been doing.
    Firefighters and police have to deal with members of the public who think they are high a mighty all the time, this is no exception.

    The police think it is right for someone to attack you for video in public, that's the same shit i see the police use to vblobers when they are video police stations from the public sidewalk, they accused them under section 43 of the terrorism act of acting suspiciously and then arrest them and serch them, some do it politely, others do it aggressively, when they are sued in court most of them do not turn up and settle, other s are found guilty and the court agree what the commissioner of police should pay. I saw one video where this vbloger sued the police and won his case, he went back to the same police station and the police who arrested and searched him saw him and stuck his middle finger up at him, which is the same as sticking two fingers up at someone, police in this country as well as in America hate vblogers, because they exposed all their wrong doings, so they are not going to help them, it is not call protect and serve, it call f-ck you. That's why police in this country has lost all respect and people treat the same way police in America are treated like crap in a toilet bowl.

    disgraceful. LFB have allowed these firefighters to basically exaggerate things to the police and somewhat lie. it is quite stupid, because they are all on film doing something different to their statements.
    it is far fetched to say the uploader was "obstructive", as he was filming there for ages without fire crew even commenting or getting annoyed. it is just when the one fire staff in black personally didn't want to get filmed, that things went downhill. even then, that's not obstruction. thats him being unhappy with the fact he's on camera and that he was then distracted because of his own discomfort of being filmed. you was not in any of their faces. they were free to go and free to stay.
    not liking being filmed is not the same thing as "sticking a camera in someone's face". you wasn't even following the lady and assailant when they went away from the camera the first time before you got pushed over (yes "pushed *over* " not "pushed away"
    "we didn't see anything"? looks like we've got a new gang on the streets now
    edit: not even gonna lie, part of the problem is that the uploader let the police give their version of events to him at the end and he did not correct them. could have offered to show the footage at that point again. is it worth arresting someone over? not sure about that but lets at least get the facts straight

      Thanks for the comment. Re the last bit, I then felt that all was set up against me and it would not have made any difference if I wanted to show them the video. I preferred to follow up on this and show the video to unbiased police officer / investigator rather than waste efforts to try to persuade the two muppets. I hope this explains why I did what I did.

    Common assault no brainer and it would have been worse had the others not "Finally" done what they were supposed to do, sorry if you don't like being filmed in public places, but we all are filmed EVERWHERE, so don't get your back up and learn the law.
    What was clear to me was the young lady was being "defended" by someone, who was acting like a 12-year-old trying to impress her. And her stupid assertion of the law was like the Fireman (NHS, Fire services, Police) all of which we are grateful to get assistance from are in many cases "Institutionalized" Into believing they are "special" and must be treated as such, hell it's not like it is a job? or they are getting paid for it. As such, they form a gang like Rangers supporters or Liverpool supporters. You know like this lot did

    You're getting angry with the firefighters because someone accosted you, for being extremely annoying. They firefighters were just trying to do thier job. Clearly and quite rightly they are too busy to get involved in your drama! Personally I think the police handled this correctly, you were being obstructive, rude and inconsiderate and basically wasting police time. Especially when you want to report a crime, then refuse to give your name when asked. Which is totally ridiculous!
