@@blasslaw Can a police officer conduct a field sobriety test on a suspect and not follow proper instructions on how to perform the tests and scream and yell at the suspect telling him to raise his foot 6 "" higher and yelling asking suspect if he went to school and he is not going to repeat himself after I didnt understand a question.?

Just because a police officer conducted field sobriety tests doesn’t mean they conducted them correctly. It’s so much fun to teach a jury the correct way to conduct field sobriety tests and watch the cop try and talk their way out of it. Jurors don’t like that.

@@blasslaw If the police failed to correctly ask me how to perform these tests and were rude and aggressive yelling at me,will that be enough to prove no probable cause to arrest.?

If they determined no probable cause, would that still show up on your background check

The arrest would still show up on your background check.

Hello. In my case, they found no probable cause, yet, they asked me to " sign a Stipulation of Probable cause." Can a judge do that ?

Is this something that happened in Texas?

@@blasslaw It happened in New Jersey. What can you advise me on that, sir ? What step should I take ?

Typically you can stipulate to anything. Did you have a lawyer with you at the time?

The defendant could also receive a directed verdict, which is only warranted when there are no facts with which to determine criminality. A directed verdict in the favor of the defense is a good indication that there was probable cause for the arrest.

The judge told me, " you can fill out a Stipulation for Probable cause Motion before trial... She's bias because I put in a TORT claim on them. I have court with them in June, ( TRIAL ), she cannot do anything because I never signed that probable cause.

Are you doing this pro se or do you have a lawyer?
