Because.... RM is very castly as compare to EM... example wagon r is for 5 lakh and having low safety features and same mini looper is of worth 30 lakh with safety features... Still people buy wagon r 😀

Sir, I've taken loan from a NBFC, they have taken both registered as well as Equitable Mortgage. What are the benefits for me as Borrower? Am I secure from any legal cases (in worst case) raised by any former owner of the property? What is benefit of RM for borrower as such?
@CA Ankush Jain...In Maharashtra price for Equitable and Registered Mortgage are now same.( Maharashtra Stamp Act).Uptill now for majority of the loans I have done Registered Mortgage only....It's more convenient & safer in the sense it is Registered with Sub registrar office...
but actually bank is following hybrid method of both the documents of property as well as registration. Lender opting the good feature of both the mortgage , taking the property original paper as well as registration of loan agreement just in order to secure their exposure

Somewhere it is written that simple mortgage and equitable mortgage are same while somewhere it is written that registered mortgage and simple mortgage are same. However considering that equitable mortgage is simpler as compared to registered , i think simple mortgage is another name of equitable mortgage only

Ideally avoidable but it depends on internal policy of the bank.. normally third party property guarantee cases goes to senior authorities level for approval

With this, if the borrower tend to sell the property then he will not be able to do any changes in property records without noc from bank. Further since it is a public record, any buyer of the property can also verify whether the property is having charge of other bank or not. Exclusive charge means that we are having sole right/charge over the current assets in the event of default. Any recovery from sale of assets shall be used to knock off bank dues first

Sir I work in semi urban area, during my audit the auditor has commented on many loans that EC is not obtained,even for housing loans……whereas EQM is sufficient to possess our banks charge…..kindly comment @AnkushJain

Two question- 1. Whether original documents required to submitted to bank in case of registered mortgaged till the repayment? 2. Is there any way that advocate while providing legal report states whether is there any equitable mortage or not..Usually we have to raise Cersai request while creating charge?
@@art_soul_words you are right. I am just stating that I have not seen lawyer capturing about it in his title search report. Although this information is critical as u said and need to specifically captured somewhere before granting loan.
Hi shahrukh, cost is high in registered mortgage further equitable mortgage is easy and quick process. Bank do all safeguard all its interest in equitable mortgage also 👍

There is no benefit to you for this.. only bank is benefitted due to security created in a proper process

Please check if it is due to any particular state law or due to the property chain not enough to create an equitable mortgage.
