Hello, I av a question; in a scenario where there is an agreement between party A(promisor) and party B(promisee) party A would only fulfil is promise if a third party C fulfil a performance, which he fulfilled, but party A then backed out, party B can not execute the contract since they did not furnished the consideration, and for party C that executed the consideration there was no acceptance and offer between them, my question is can party C seek action since furnished the consideration on behalf of party B
You need to look at all the rules on Privity of Contract as well as cases such as Tweddle v Atkinson, white v Jones, Dunlop Pneumatic v Selfridges (see Viscount Haldane's remarks in that case), Beswick v Beswick, Scruttons v Midland Silicone, as well as Contract (Rights of Third Parties) Act.
